UPDATE ТО ТНЕ SUМMARY OF FORENSIC EVIDENCE - EXHUМATION OF ТНЕ GRAVES AND SURFACE REMAINS RECOVERIES RELATED ТО SREBRENICA - JUNE 2013

The purpose of this report is to provide an update concerning Srebrenica-related mass and other graves and the results of DNA and other analysis of some of the human remains located following thc fall of Srcbrcnica cnclavc. This rcport updatcs Dusan JANC's 13 January 2012, 21 April 2010 and 13 March 2009 reports (ERN ХО19-7282-ХО19-7368, ХО19-5972-ХО19-6050, ХО19-4231-ХО19-4295 and ХО19-4305-ХО19-4305), as well as Dean MANNING's 27 November 2007 report (ERN 0614-8656-0614-8822). It should Ье read in conjunction with MANNING's previous reports covering exhumations related to Srebrenica for the periods 1996- 1999 (ERN 0095-0901-0095-1041), 2000 (ERN ХОО6-5658-ХОО6-5684) and 2001 (ERN ХО16- 7708-ХО16-7721).

Srebrenica victims identified via DNA and other methods in graves 6056

An examination of the records provided to the ICTY Ьу the International Commission on Missing Persons ("ICMP") in April 2013 (D000-3779 and D000-3784) 1 and Ьу the BiH authorities, 2 indicates that the remains of at least 6023 individuals recorded as missing following the fall of Srebrenica have been identified 3 in graves (including mass graves, smaller graves or individual graves) to date. This number also includes 142 unique Srebrenica-related DNA profiles which have not yet been matched to а missing person.

In addition, 33 individuals were identified before the ICMP commenced its DNA identification process in November 2001. These identifications were based on ante and post-mortem data collected Ьу Physicians for Human Rights ("PHR") and the International Committee of the Right Cross ("ICRC").4

The tаЫе below lists the total number of identifications of Srebrenica-related victims as found in the January 2012 Janc report and as found in the April 2013 Update, broken down Ьу individual

1 Containing an updated List of Srebrenica related DNA Matching Reports (identifications) as of 28 February 2013 and Unique Unmatched DNA Profiles as of 7 June 2013 ("April 2013 ICMP Update"). Included into this counting are also the 22 unique Srebrenica-related DNA profiles, which were provided to the ICTY in March 2009 (D000- 2768) and February 2010 (D000-3294) and December 2011 (R067-8779-R067-8784) respectively, and do not appear on the April 2013 Update (see the ICMP responses ERN R067-1561-R067-1566 and R067-8814-R067- 8818). 2 Including the Tuzla and Sarajevo Prosecution Files, Tuzla Canton Сошt Files, BiH State Сошt Files, as well as the BiH Institute on Missing Persons Files. 3 The term "identified" refers to an individual with а unique DNA profile - whether matched to а missing person or not yet. 4 As indicated in Dean MANING's report from Мау 2000 (ERN 0095-0996-0095-0997), 45 individuals were identified in total. The ICMP re-identified 12 of them and are therefore included in their April 2013 Update. ??24- Srebrenica Investigation -DNA and Forensic Summary of June 2013. Page 3/6

Srebrenica victims identified via DNA analysis оп the surface ??24- Srebrenica Investigation -DNA and Forensic Summary of June 2013. Page 6/6

An examination of the April 2013 ICMP Update and the records provided to the ICTY Ьу the BiH Authorities indicates that the remains of at least 756 individuals have been collected on the ground or in shallow unmarked graves to date.6 А more detailed description of the surface remains findings is attached at Annex В. Additionally, lists of individuals identified from these surface remains can Ье found in the "Surface Remains" portion of Confidential Annex D.

The number of victims identified via DNA analysis Ьу the ICMP should still Ье considered а conservative figure as not all the human remains have been examined, matched or even located.7

Update to the January 2012 Janc report

Detailed information concerning new or newly discovered exhumations, as well as the most recent ICMP Matching Reports (identifications), can Ье found in Annex А. This Annex updates the January 2012 Janc report.

Annex С refers to а DNA connections between disturbed primary/primary, primary/secondary and secondary/secondary mass graves, as well as to one DNA connection between execution site and secondary grave. In total, 1001 DNA connections have been estaЫished between these sites. А detailed listing of these connections is set out in the DNA connection tаЫе, index and charts of the Annex С, and in the "DNA Connections" portion of Confidential Annex D.

Annex А concludes with а list showing the total numbers of individuals currently identified in primary and corresponding secondary mass graves connected to five largest mass execution sites ( and others, Orahovac, Petkovci Dam, Kozluk and Branjevo Military Farm/Pilica).

Examination methodology of the ICMP Data

The April 2013 ICMP Update represents data for calculating the numbers presented in this update. Each of the entries (16,057 from the ICMP List of DNA Matching reports and 263 from the ICMP Unique DNA list, including main cases and reassociations) was selected Ьу case ID (which contains grave site information) and separately copied into new spreadsheets. Each of the new spreadsheets was related to one of the graves or surface remains sites presented in this update. Only the main cases of the entries separated Ьу grave or surface remains sites were then selected and counted. The only exception to this method was in the case of estaЫishing DNA connections, where the reassociation cases were also taken into consideration.

6 This number represents only those profiles matched to missing persons. Unmatched DNA profiles from surface remains cannot Ье affirmatively connected to Srebrenica. 7 Demographic expert Helge Brunborg concluded in the Popovic et al Trial ( IТ-05-88), that the minimum number of persons who went missing or died following the fall of Srebrenica in July 1995 was 7,826. Based on this figure around 970 individuals are yet to Ье located and/or identified. ??24-0740

Page 6 ??24- Srebrenica Investigation - DNA and Forensic S?nmary of June 2013. Annex - A the roadway and others were left on the surface of the slope. Many of these bodies were caught at the base of trees and on а fence running along the slope.

А portion of the site was exhumed Ьу the ICTY exhumations team and designated as Ravnice 1. The remainder of the site was exhumed Ьу the Bosnian Federal Commission on Missing Persons 1 and monitored Ьу the ICTY. This portion of the site was designated as Ravnice 2. The Ravnice site should Ье viewed as а single mass grave.

During the exhumation of Ravnice 1 and 2 numerous physical items such as concrete, plaster and other building material were located within the grave. These items are considered to Ье indistinguishaЫe from those found at the Kravica Warehouse execution point and the Glogova 1 and Glogova 2 mass graves, as well as the secondary mass grave of Zeleni Jadar 5 and 6. Of particular interest was а dual coloured piece of painted polystyrene foam located in Ravnice 2 and designated artefact RV02/008/A. This piece of foam is identical to foam lettering located on the Northern face of the Кravica Warehouse above an entrance doorway.

In addition, the personal identification documents of two individuals were found during the Кravica Warehouse crime scene investigation on 12 April 1996 Ьу the ICTY investigators. They were assigned ERN АООО-0812 and АООО-0815, respectively. The remains of these two individuals (ICMP ID numbers 15678 and 4144, respectively) were found and identified from Ravnice 2 grave.

It is therefore considered that the Ravnice 1 and 2 mass grave site is linked to the execution point of the Кrаvica Warehouse and contains bodies from that execution.

Ravnice 1

Partially exhumed in August 2000 Ьу the ICTY Exhumations team under the direction of Archaeologist Fredy Peccerelli, а separate report was not prepared.

The autopsy of the bodies recovered at this time was conducted Ьу а team led Ьу Chief Pathologist, Doctor John Clark, who also prepared а report in relation to the relevant findings (ERN 0200-5375-0200-5402).

Ravnice 2

Between July and August 2001, ICTY members monitored the exhumation of the remainder of the grave Ьу members of the Bosnian Federal Commission on Missing Persons and the International Commission for Missing Persons. This exhumation was designated as Ravnice 2. АП the bodies removed during these two exhumations were however examined Ьу ICTY pathologists at the Visoko Mortuary complex.

Breakdown of identified individuals per mass execution site

The tаЫе below presents the total number of the individuals identified per mass execution site - primary and corresponding secondary graves linked to these sites. However, not all of the currently identified individuals for the Kravica execution site can Ье attriЬuted to this site. It has been estaЫished that the corresponding primary and secondary graves also contain some individuals from the sites or incidents other than Kravica. Although the most of these 1385 identified individuals must still Ье directly connected with the Кravica Warehouse execution point, it is impossiЫe to provide the exact number. 5

Cancari road secondary graves are, through estaЫished DNA connections, firmly linked to either Branjevo Military Farm or Kozluk primary graves. In addition, strong DNA connections have been estaЫished among the Cancari road secondary graves themselves (see the Annex С). Apparently, DNA connections are one of the best, but

Page 33 ??24- Srebrenica Investigation - DNA and Forensic S?nmary of June 2013. Annex - A not the only evidence when linking the secondary graves to а particular primary grave and/or execution site. An additional source in estaЫishing the connection(s) between the graves are the forensic and other evidence found during exhumations. The Tuzla Canton Court Prosecution Files and/or the ICMP Summary Reports indicate that pieces of green glass were located within the Cancari Road graves 1, 2, 4 (small amount), 5, 6 (small amount), 7 and 13. Although the primary mass grave at Kozluk has previously been linked to the secondary mass grave at Cancari Road 3 Ьу the resence of pieces of green glass at both sites, the DNA connection analysis links the Cancari Road 4, 5 and 6 graves to the Branjevo Military Farm primary grave.

Based on the presented facts, some of the total numbers below (Kravica and others, Kozluk and Branjevo/Pilica) should Ье considered а conservative figure.

SURFАСЕ REMAINS

In early 2008, the ОТР received updated surface remains data from the BiH Commission for Missing Persons ("Commission") (ERN ХО18-9696-ХО18-9781), pertaining to surface remains collected between 1996 and 2007 which are related to the events following the fall of the Srebrenica enclave in July of 1995 ("Surface Remains Data"). 1 In addition, data on surface remains collected between January 2008 and June 2013 were received from the Commission, respectively (ERN ХО19- 3495-ХО19-3495, ХО19-5915-ХО19-5915, ХО19-7142-ХО19-7142, ХО19-7174- ХО19-7174 and ХО19-7461-ХО19-7462). 2 The Surface Remains Data was reviewed together with the April 2013 ICMP Update in order to determine the current number of identified persons from those remains.

The analysis estaЫishes that 756 Srebrenica-related individuals in total have currently been identified from 1033 surface remains cases. This figure consists of 724 identified persons on the April 2013 ICMP Update together with 32 identified persons 3 on the Surface Remains Data only ( see "Surface Remains" portion of Confidential Annex D). The 724 individuals from the ICMP Update were determined to Ье surface remains based on their case IDs, which correspond to the case IDs found in the Surface Remains Data (ERN ХО18-9698-ХО18-9712). 4

The locations where Srebrenica-related surface remains have been collected are consistent with the locations through which the Muslim column leaving from Susnjari and JagliCi was passing in July 1995 ( see Мар of Column Movement with ERN 0505- 4370-0505-4370). These locations can Ье categorized into the following wider areas:

the Pobudje area (stretching south of the Bratunac-Konjevic Polje road) the Baljkovica area (stretching north-west of Zvornik) the Snagovo area (stretching south-west of Zvornik) and the other areas (outside the above-mentioned areas, but still relatively close to them).

The concentration of the surface remains in these areas can Ье seen on maps prepared Ьу the Commission in July 2008 (ERN 0545-1593-0545-1608).

1 This Surface Remains Data is an update of the initial data (ERN ХО18-9549-ХО18-9623). The only difference is the addition of 52 cases collected from the surface Ьу the Finnish Team in 1996, out of which 20 individuals had been identified as of 28 December 2007. The overall number of collected "cases" therefore increases from 877 to 929, and the number of identified persons increases from 464 to 484. 2 104 new "cases" of surface remains were collected between January 2008 and June 2013 and the overall nшnber of "cases" therefore increases from 929 to 1033. 3 These 32 identified individuals included in the Surface Remains Data cannot Ье found on the December 2010 IСМР Update. In addition, three of the identified persons included in the Surface Remains Data appear to have gone missing in 1993 (see ERN ХО18-9763-ХО18-9763 and ХО18-9774- ХО 18-9774 (person listed under nшnber 3)). 4 16 of the individuals (RAНOlВRA, PAR-1, S.ZUT-1, S.ZUT-2, VL.МR-1, КALOlВRA, НRN02BRA, LIP02BRA, B.LOL-1, B.LOL-3, КRKOlВRA, POT02SRE, as well as both GAVOl ZVO and KOPOlМIL) do not appear in the Surface Remains Data. They were, therefore, estaЫished to Ье surface remains Ьу reviewing the individual case files, received from the BiH Tuzla Canton Prosecutor Office (within the ERN ХО21-7053-ХО21-7670, 0629-1906-0629-2222, ХО19-5644-ХО19-5914, ХО23-8385-ХО23-8394, ХО24-0678-ХО24-0702, ХО23-5418-ХО23-5458 and ХО24-0597-ХО24-0609).

DNA CONNECТIONS

This section points out any DNA connections between disturbed primary/primary, primary/secondary and secondary/secondary mass graves, as well as the DNA connection between the execution site and secondary grave. А "DNA Connection Case" means that the remains of one individual were found in at least two different graves. 1 An analysis of the April 2013 ICMP Update (based on identifying information, including the Protocol ID, as well as ICMP ID, Site Code and/or Name) shows the following number of "DNA Connection Cases" between these graves:2
