“I care for Počitelj” - “I care for Stolac” 07 – 15 July 2016 This unique medieval settlement, on the list to be declared a cultural heritage by UNESCO, is situated in the valley of the Neretva River, twenty five kilometers from Mostar, on the way to the Adriatic Sea. In the 1960s, Počitelj began to grow as an art center, promoted also by the famous writer - Nobel Prize winner Ivo Andrić. Počitelj, with its jumble of medieval stone buildings, ancient tower overlooking the river and proximity to the seaside, giving artists and will give you the peaceful and scenic place to work and stay. In the year 2000, the Government of the Federation of Bosnia and Herzegovina initiated the Programme of the permanent protection of Počitelj. This includes protection of cultural heritage from deterioration, reconstruction of damaged and destroyed buildings, encouraging the return of the refugees and displaced persons to their homes as well as long-term preservation and revitalization of Počitelj historic urban area. The Programm is on-going. NASER ORIĆ SUMMARY OF JUDGEMENT International Please find below the summary of the judgement today read out by Judge Agius: Criminal Tribunal for the former Introduction Yugoslavia Tribunal Pénal Trial Chamber II of the International Criminal Tribunal for the Former Yugoslavia is sitting today to International pour deliver its Judgement in the trial of Naser Orić. l’ex-Yougoslavie This case deals with crimes of murder and cruel treatment of prisoners and of wanton destruction of cities, towns or villages alleged to have happened in Srebrenica in 1992 and 1993 for which the Accused was indicted on 13 March 2003. The Accused stood trial for the following charges: first, under COUNT 1, he is charged with individual criminal responsibility under Article 7(3) of the Statute of the Tribunal (“Statute”) for murder as a violation of the laws or customs of war pursuant to Article 3 of the Statute. Under COUNT 2, the Accused is charged with individual criminal responsibility under Article 7(3) of the Statute for cruel treatment as a violation of the laws or customs of war pursuant to Article 3 of the Statute. The Prosecution never alleged that these crimes of murder and cruel treatment were committed by the Accused, but only accused him pursuant to Article 7(3) of the Statute as being responsible for these crimes committed by his subordinates whilst he was holding a position of superior authority. -

International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Rapporteur Report The Hague June 29-July 1, 2015 International Decision-Making in the Age of Genocide: Srebrenica 1993-1995 Conference in The Hague, June 29 – July 1, 2015 Executive Summary Leading decision-makers from more than a dozen countries gathered in The Hague from June 29 to July 1, 2015, to consider the failure of the international community to protect the United Nations “safe area” of Srebrenica, resulting in the largest massacre in Europe since World War II. Participants included three former members of the UN Security Council, senior government and UN officials, peacekeepers, and eyewitnesses to the Srebrenica tragedy. Over the course of four working sessions, a public event, and numerous informal meetings, conference participants focused on a disastrous two-year chain of events that culminated in the fall of Srebrenica in July 1995. They examined the origins of the “safe area” policy, beginning with the March 1993 visit to Srebrenica by French General Philippe Morillon, and disagreements on how to implement frequently impractical Security Council resolutions. The discussion revealed sharp disconnects between the policy-makers in New York, the peacekeepers on the ground, and the people the “safe areas” were ostensibly designed to keep safe. “I saw this conference as a kind of truth commission,” said Srebrenica survivor Muhamed Duraković. “Twenty years on, we cannot bring back the dead, but we can learn from what went wrong in Srebrenica. If we are not able to go through the process of fact-finding, truth, and reconciliation, we may be creating problems for future generations.” At the heart of the international failure in Srebrenica in July 1995 was the inability of the major powers to devise and implement an agreed strategy for ending the defining conflict of the immediate post-Cold War era. -

THE LEGACY OF SREBRENICA: POTENTIAL CONSEQUENCES OF REDUCING LIABILITY FOR TROOP CONTRIBUTING COUNTRIES IN MODERN UN PEACEKEEPING OPERATIONS KELSEY GASSELING* Abstract: In 2014 the District Court of The Hague returned its decision in a case concerning peacekeeper (Dutchbat) wrongdoing during the 1995 massacre at Srebrenica, Bosnia-Herzegovina. The district court dismissed the UN as party to the suit, basing this decision on the organization’s statutory immunity from pros- ecution. As a basis for holding the Netherlands liable for Dutchbat’s actions, the district court utilized the effective control standard.
