Suthers On January 4, 2005, John W. Suthers was appointed as Coloradoʼs 37th Attorney General. In November of 2006, the voters of Colorado elected Attorney General Suthers by a large margin to serve a full, four-year term. As Attorney General, Suthers is charged with representing and defend- ing the interests of the People of the State of Colorado, and serves as chief legal counsel and advisor to state gov- ernment, its statewide elected officials, and its many state agencies, boards, and commissions. Attorney General Suthers graduated magna cum laude from the University of Notre Dame with a degree in government in 1974, and from the University of Colorado Law School in 1977. From 1977 to 1981, he served as a deputy and chief deputy district attorney in Colorado Springs. From September of 1979 to January of 1981, he headed the Economic Crime Division of the DAʼs office and co- authored a nationally published book on consumer fraud and white-collar crime. In January of 1981, Mr. Suthers entered private practice as a litigation partner in Colorado Springs firm of Sparks Dix, P.C. He remained with the firm until Novem- ber of 1988, when he ran against and defeated the incumbent district attorney for the 4th Judicial District. He was elected to a second term as district attorney in 1992.

The Housing Credit is our nation’s primary tool for encouraging private investment in affordable rental housing. While rental assistance is critical for keeping renters in their homes during this time of financial instability, the need for more affordable housing production and preservation in cities and towns preceded the pandemic. Since its creation in the Tax Reform Act of 1986, the Housing Credit has been the primary financing source for the production and preservation of affordable rental housing. It has financed nearly 3.5 million apartments since 1986, providing affordable homes to approximately 8 million low-income households, including families, seniors, veterans, and people with disabilities. The Housing Credit brings together private-sector resources and oversight by state agencies, resulting in a durable solution to the need for affordable housing. The AHCIA of 2021 includes a number of provisions that would enhance the program and enable cities like ours to better serve the affordable housing needs in our communities.

SUTHERS Attorney General The Department of Revenue has requested an opinion concerning its obligation to update the coal severance tax rate under section 39-29-106(5), C.R.S. (2006), in light of the limitations imposed by article X, section 20 of the Colorado Constitution, the Taxpayers’ Bill of Rights (“TABOR”). Questions Presented and Answers The specific questions received from the Department are: 1. Must the Department of Revenue increase the coal tax rate pursuant to section 39-29-106(5), C.R.S. (2006), or does that statute violate the prohibitions of Article X, Section 20 (“TABOR”), on tax increases or new tax policies absent voter approval? 2. If the Department must enforce the increases in the coal tax rate, must the rate be adjusted to the 1978 index of producers’ prices, or does the Department have discretion to raise the tax by a smaller increment? Answers: Section 39-29-106(5), requires a one percent increase or decrease in the coal severance tax rate whenever the index of producers’ prices rises or falls by one and one-half percentage points. Because this statute was enacted prior to TABOR’s November 4, 1992 effective date, it does not conflict with TABOR, and a vote is not required prior the Department assessing the increased coal severance tax rate as required by statute.
