The London School of Economics and Political Science Mediated tensions: Italian newspapers and the legal recognition of de facto unions Marina Franchi A thesis submitted to the Gender Institute of the London School of Economics for the degree of Doctor of Philosophy, London, May 2015 1 Declaration I certify that the thesis I have presented for examination for the MPhil/PhD degree of the London School of Economics and Political Science is solely my own work. The copyright of this thesis rests with the author. Quotation from it is permitted, provided that full acknowledgement is made. This thesis may not be reproduced without my prior written consent. I warrant that this authorisation does not, to the best of my belief, infringe the rights of any third party. I declare that my thesis consists of 88924 words. Statement of use of third party for editorial help (if applicable) I can confirm that my thesis was copy edited for conventions of language, spelling and grammar by Hilary Wright 2 Abstract The recognition of rights to couples outside the institution of marriage has been, and still is, a contentious issue in Italian Politics. Normative notions of family and kinship perpetuate the exclusion of those who do not conform to the heterosexual norm. At the same time the increased visibility of kinship arrangements that evade the heterosexual script and their claims for legal recognition, expose the fragility and the constructedness of heteronorms. During the Prodi II Government (2006-2008) the possibility of a law recognising legal status to de facto unions stirred a major controversy in which the conservative political forces and the Catholic hierarchies opposed any form of recognition, with particular acrimony shown toward same sex couples.

  • Visit to Italy: the Gasparri Law Observations and Recommendations
Organization for Security and Co-operation in Europe The Representative on Freedom of the Media Miklós Haraszti 7 June 2005 Visit to Italy: The Gasparri Law Observations and Recommendations The OSCE Representative on Freedom of the Media, Miklós Haraszti, accompanied by Advisers Alexander Ivanko and Roland Bless, visited Rome, Italy, from 30 March to 1 April 2004. This was the Representative’s first visit to this participating State. The trip was made at the invitation of, and was organized by, the Ministry of Foreign Affairs of Italy. The purpose of the trip was to assess the current situation in the television broadcasting sector, one year after the adoption in 2004 of the Gasparri Law1, Italy’s first comprehensive regulation of all broadcast media, and of the Frattini Law2, on the conflicts between public duty and private interests of public officials. The Gasparri Law was enacted after repeated calls by Italy’s Constitutional Court, as well as by European political bodies, for an overhaul of the highly concentrated television system in Italy. The Representative appreciates the co-operative approach of the Italian authorities and their willingness to discuss all issues raised by him openly. Miklós Haraszti met with government officials, parliamentarians, scholars, and media lawyers. Among those he had talks with were, in order of the meetings: - Minister of Communications Maurizio Gasparri and his Deputy Giancarlo Innocenzi; - Members of the Italian Delegation to the OSCE Parliamentary Assembly, Senator Luigi Compagna and Member of the Chamber of Deputies, Mister Fabio Ciani; - President of the Justice Commission of the Senate, Senator Antonino Caruso; - Professor Mauro Masi, Secretary-General of the Presidency of the Council of Ministers (Prime-Minister’s Office); - Senior officials from the Foreign Ministry.

A special thanks to all the administrative staff of the ISCTE-IUL, their support desk, and of the Centro de Investigação e Intervenção Social (CIS-IUL) for their kind assistance. I am indebted to Professor Lígia Amâncio for her insightful and attentive feedback. It has been a privilege to cross paths with her. Francisco, Francesco and Emanuela were again invaluable. Thank you for the security and love that you offer me. ABSTRACT After many years of heated debate, in 2016 the Italian parliament passed a law to regulate same-sex civil unions. Although the law extends to same-sex couples most of the rights of married heterosexual couples, the law preserves legal differences between heterosexual marriage and same-sex civil unions; moreover, the possibility of a partner in a same-sex couple adopting the biological children of the other partner was so controversial that it had to be deleted in order for the law to pass.
