The two History of State and Law Departments of these universities published the best student presentations in the book entitled Sic itur ad astra I. (ISBN 978-963-284-935-5, Eötvös Loránd University Faculty of Law, Budapest, 2017, 64 p.). Our second summer school was held in Zagreb in 2017. The topic was “Croatian and Hungarian Public Administration and Constitutional History 1848-1991’. Fourteen students (from the Master and Ph.D. level) held their presentations, all of them are listed in this book. We hope that our students will actually reach the stars and that we will find their names and scientific achievements in similar publications in the future as well. Zagreb–Budapest, 2018. Definition In my work, I intend to introduce a part of exceptional power’s history in Hungary. In the period between the 1848–1849 Revolution and World War II the legal institution’s content has gone through changes because the government got more and more authority. Before I introduce the history of exceptional power, I would like to give its definition: usually by constitution or separate act ensured right of the government, in order to ensure the inner safety in special occasions, it can manage with edicts the legislation’s case, moreover it can narrow the individual rights with it.1 2. History of exceptional power The exceptional power, as a legal institution was created with the Act accepted in 1912. Its content was used in other periods of history of law. The martial law was the same in the 16th century. In this age the deputy-lieutenant travelled around the country with servant judges in order to enforce the law and to resettle the piece in the territory of the country.2 Usually opportunity of martial law was made for the situation, when in the country the disorder was typical. This ensured the background of the breaking-down of the outlaws and of the serfs’ movement in the 18–19th centuries.3 A royal rescript was also about the delegation to martial law which had a justification about why they established these kinds of courts. Act 1 of 1849 Though the Act 1 of 1849 had not lead the legal institution of exceptional power into Hungary’s legal system, but in its content could be found the martial laws rules, which appeared in the Act 63 of 1912 too. The Act 1 of 1849 delegated the civil and the criminal jurisdiction to courts that was established by the Országos Honvédelmi Bizottmány [National Defence Committee], what led the country as a government in this stand of the revolution. This delegation had narrows: they were allowed to use this power only on that part of the country which were war zones and were important in favour of the revolution. These courts stood out of five people and its competency included civilians and soldiers too. Regarding the judges there were criteria: in a council had to be two civilian judges and two military judges. The leader of them could come out of both social groups. The prosecutor was represented by the Országos Honvédelmi Bizottmány. The Act regulated the crimes which could have been judged by martial law. For example: armed action against the country or made someone do this, helping the enemy and obstructing the army. The members of the parliament had immunity and this was only suspended if they had not found any other opportunity. If someone was caught in act anyone could capture him or her, but he or she had to be given immediately to the civil or military authority. After the capture he or she had to be brought to justice in twenty-four hours. One of the five judges wrote the record. The defendant could have a defence attorney. If he or she had not a lawyer, the court allocated one for the criminal. The process could be suspended in order to let the defendant get evidence in his or her defence. To adjudicate the five judges had to share the same opinion by sentencing the defendant or releasing him or her. If they had an agreement and sentenced the defendant that meant a sentence to death, which was executed by bullet. If the judges were unable to sentence the defendant or release him or her, he or she was given to the ordinary court. By sentencing to death, the execution had to be done in the next three hours counted from the sentence. The whole process, with the execution had to last less than three days. 4 4. Act 63 of 1912 The first act that was made about the exceptional power after the Austro–Hungarian Compromise was the Act 63 of 1912. Before this, Austria tried to institute a similar institution, but the Hungarians did not accept it, because the military leader would have taken over the force, over the civilian leaders during the war or during the threatening of war.5 In the background stood that its acceptation would have been against the acts of 1848 because the exceptional power could have been delegated only to the government.6 This act was known also by another name: the delegation act. The legal institution of exceptional power was not defined by it. It only listed the right of the government during war or during threatening of war. The reason of this act was that the exceptional power had been only interpretable with the interest of the state but after the statute was made the politician were able to refer to an act. This means that it had expediency and constitutional backgrounds.7 After the war, the government that lived with the opportunities ensured by the

The moment was not chosen by mere accident, because the previous years had witnessed an upsurge of legislative acts striving to legally settle the ques- tion of who should belong to the states of Europe. The bill was discussed and opined by the Naturalization Committee of the Parliament. The most important problems were the naturalization and the absence. The first regulation of Hungarian citizen- ship according to the contemporary constitutional reforms and legal practice only took place in 1879. It is a major milestone in Hungarian citizenship law, since it also incorporated in its system the cases of acquisition and loss of citizenship. The law contains detailed provisions on how the legal relationship between the citizen and the state could be established and terminated. The objective of the law was to make the system of citizenship clear and transparent.     A brief history of the University of Szeged and its predecessors “The intellectual power of teachers creates the good reputation and blessed opera- tion of a university, not its silent walls.” (Áron Berde, November 10, 1872) The era of the Jesuit Academy in Cluj The beginning of higher education in Cluj, exiled to Szeged in 1921, dates back to 1581. István Báthory, Prince of Transylvania and King of Poland, on May 12, 1581 issued a foundation letter in Vilnius, taking measures to establish a Catholic university consisting of two faculties (Arts and Theology), within the framework of the Jesuit Collegium in Cluj which had been founded in 1579. The Jesuit Order sent 20 to 30 well-renowned excellent professors to Cluj (e.g. Jakub Wujek, István Szántó, Alphonso Carillo, Petrus Maiorius). The foundation letter of the Prince provided five villages and five larger ecclesiastical buildings (the Benedictine Abbey in Mănăştur, and the Fran- ciscan and Clarist monasteries in Cluj) in Kolozs county for the development of the institution. At the end of the 16th century the Academy in Cluj was the sole higher educational institution in the Carpathian basin In 1603, amidst the Long War (1591-1606) and religious upheavals, the Abby was demolished and two years later the Jesuit order was expelled from Tran- sylvania. In 1616, Prince Gábor Bethlen allowed, however, for the Jesuits to open a school in Mănăştur which was namely a middle school but there was a teacher (Gergely Vásárhelyi) who, having been teaching at the University founded by Báthory, ensured a certain personal continuity between the two institutions.

    The thesis of the PhD dissertation Dezső Csaba Dér The dawn of the 1st Hungarian Corps in 1848-49 (Organization in the period of the self-supporting corps) I. Aims The specialized literature on the topic of the Revolution and War of Independence of 1848-49, that introduces the military history, is remarkably wide , however it also shows some weak point in higher units, like history of the corps. The main purpose of the dissertation is to reveal the actions and the coherence of the corps – which is first of all based on the organization of the army, in the second place based on natural forces and the aptitude of the enemy –from December 1848 to February 1849 that happened behind the actions of war. The further aims of my work is to present an analysis based on the available sources, which can be definable in time and space and be the model of a self-supporting higher unit. I analysed four interconnected issues in my dissertation: 1. Why did the Pulszky-corps lost the battle of Budamér on the 11 th of December 1848? What information did the National Defence Committee have about the expected attack, and what actions were made by the local commissioners to defend the attack? What was the result of the organization of the corps before the battle? 2. On the 4th of January 1849 the newly arranged army was disastrously defeated, which could have had negatively effected the success of the resistance that was organized behind the defence line of River Tisza. I analyse what could have been the reasons that lead the ‘Northern Mobile Corps’ into such a rout, after this huge organizing.

    BETWEEN EMANCIPATION AND ANTISEMITISM: JEWISH PRESENCE IN PARLIAMENTARY POLITICS IN HUNGARY 1867–1884 Árpád Welker THE PERIOD UNDER STUDY The early 1880s were both difficult and extraordinary from the point of view of Hungarian Jewry. Political antisemitism had been present for half a decade, but it became violent and influential during these years, though only for these years. In other words, this was a time of crisis within the ‘Golden Era’ of the Hungarian Jewry, as some researchers of Hungarian Jews call the period of the Austro-Hungarian Monarchy 1867–1918. [1] Besides antisemitism ‘normal’ political debate took place in parliament simultaneously, namely that related to the bill on Jewish–Christian marriages, which was also decisive from a Jewish point of view. The ‘antisemitic wave’ started with the attempts to establish a nation-wide movement, the Central Association of Non-Jewish Hungarians, following the example of Wilhelm Marr’s Antisemitenliga in Germany. [2] This period of virulent antisemitic activity culminated in the events related to the infamous Tiszaeszlár blood libel case, including a series of riots threatening the safety of Jews in numerous counties, and the foundation of the National Antisemitic Party in 1883. After the clear defeat of the antisemites in the elections of 1884, antisemitism practically became insignificant. [3] It took ten years until a political party incorporated antisemitism in its programme again, but the antisemitism of the Catholic People’s Party was ‘less virulent’, [4] and neither their only nor even their main goal. THE ‘DOUBLE PROGRAMME OF EMANCIPATION AND ASSIMILATION’ András Kovács in an article about the relationship between politics and Hungarian Jews argues that ‘independent Jewish politics has no tradition in the history of Hungarian Jewry’.
