Fax 530-265-9862 Date: July 19, 2018 To: LAFCo Commissioners From: SR Jones, Executive Officer Subject: Commission Review of Preliminary Draft East County Wastewater Municipal Service Review Nevada LAFCo’s consultant SWALE, Inc., has prepared a draft of the East County Wastewater Municipal Service Review (MSR), and the Commission is now asked to provide direction to staff and the consultant to ready the draft for release to the public. The MSR reviews wastewater services as provided in eastern Nevada County. Service re- sponsibilities are handled by three separate agencies: the Truckee Sanitary District, the Tahoe Truckee Sanitation Agency and the Donner Summit Public Utility District. The Truckee Sanitary District and the Tahoe Truckee Sanitation Agency work in partnership as the former is responsible for sewer collection and conveyance while the latter handles treatment and disposal. The MSR process involves the Commission adopting written determinations on seven factors specified by statute: • Growth and Population Projections for the Affected Area • Location and Characteristics of any Disadvantaged Unincorporated Communities • Present and Planned Capacity of Public Facilities and Adequacy of Public Services • Financial Ability of Agencies to Provide Services • Status of and Opportunities for Shared Facilities • Accountability for Community Service Needs • Any Other Matter Related to Effective or Efficient Service Delivery The draft Municipal Service Review lists suggested written determinations and sphere boundary options for the Commission’s consideration for the Truckee Sanitary District, as Nevada LAFCo is the principal county LAFCo for the district and is therefore responsible for all sphere of influence actions for the agency. The chapters on the Tahoe Truckee Sanitation Agency and the Donner Summit Public Utility District are excerpted from the Placer LAFCo’s Municipal Service Review on the North Tahoe and Martis Valley, which is in the final stages of completion. Placer LAFCo is the principal county LAFCo for both agencies, and will therefore be responsible for all sphere actions. LAFCo law (Section 56430 (a)) requires a commission to conduct a service review of municipal services provided in the county or other designated area. Although the stated purpose of the MSR is to prepare and to update spheres of influence, Section 56430 (b) indicates an MSR should review all municipal services in the area subject to the study: In conducting a service review, the commission shall comprehensively review all of the agencies that provide the identified service or services within the designated geographic area. […] Page 2 Donner Summit Public Utility District serves the Soda Springs community, an area recognized by Nevada County as a Disadvantaged Unincorporated Community. LAFCo law calls for the Commission to be cognizant of DUCs and the provision of water, wastewater and structural fire protection services to those communities. At this time, LAFCo staff is requesting that the Commission review the draft MSR and give direction to staff and the consultant as to preparation of the public review draft. The public review draft will be circulated to the public and the subject agencies for a period of at least 30 days. The consultant will prepare written responses to comments or make appropriate modifica- tions to the draft, which would be presented to the Commission in final form at a public hearing tentatively scheduled for the Commission’s regular meeting on September 20, 2018. The MSR discusses service delivery and efficiency, including an analysis for each of the following analytical factors: • Growth and population projections for the three affected areas; • Disadvantaged unincorporated communities; • Present and planned capacity of public facilities; • Financial ability of each agency to provide services; • Opportunities for shared facilities; • Accountability for government service needs; and • Any other matter related to service delivery as required by Commission Policy. The areas of description and analysis contain the essential operational and management aspects for the three service providers and together constitute a review of each provider’s ability to meet the service demands of the customers within their respective boundaries. Only wastewater collection, treatment, and disposal services are considered in this MSR Update. These services are primarily provided to residents and visitors by the three special districts, in cooperation with Nevada County, Placer County, and the Town of Truckee. These agencies operate under “principal acts,” which govern the provision of one or more public services. Boundaries and spheres of influence (SOI) are determined by the Local Agency Formation Commission (LAFCo) of each agency’s principal county (the county having the greater portion of the entire assessed value of all taxable property within the district, pursuant to Section 56066 of the Government Code). Several options for the Commission to consider when they next update the SOI for the Truckee Sanitary District are described in Appendix 1. Executive Summary 1-1 Eastern Nevada County – Wastewater Services DRAFT MSR Nevada County is considered the principal county for the Truckee Sanitary District, while Placer County is the principal county for the Tahoe-Truckee Sanitation Agency and the Donner Summit Public Utility District. Since Nevada LAFCo is the Principal LAFCO for the Truckee Sanitary District, this MSR also presents a written statement of conclusions, known as determinations, for this District. The key facts that support each determination are discussed in Chapter 3. 1.1 SUMMARY OF DISTRICTS The Truckee Sanitary District (TSD) and the Tahoe-Truckee Sanitation Agency (T-TSA) were last reviewed by Nevada LAFCo in a 2003 MSR called the ‘Eastern Nevada County Wastewater MSR.’ The Donner Summit Public Utility District (DSPUD) was last reviewed by Nevada LAFCo through an MSR in 2005.
