The Latvia, Lithuania and Belarus Cross-border Cooperation Programme within the European Neighbourhood and Partnership Instrument succeeds the Baltic Sea Region INTERREG IIIB Neighbourhood Programme Priority South IIIA Programme for the period of 2007-2013. The overall strategic goal of the programme is to enhance the cohesion of the Latvian, Lithuanian and Belarusian border region, to secure a high level of environmental protection and to provide for economic and social welfare as well as to promote intercultural dialogue and cultural diversity. Latgale region in Latvia, Panevėžys, Utena, Vilnius, Alytus and Kaunas counties in Lithuania, as well as Vitebsk, Mogilev, Minsk and Grodno oblasts take part in the Programme. It was not only political rights » that were violated but social, economic and cultural rights as well. These viola- tions are constant and conditioned by the authoritys voluntary policy, with Lu- kashenka at its head. At the same time, human rights violations are not merely VIASNA a side-effect of the authoritarian state control; they are deliberately used as a « means of eradicating political opponents and creating an atmosphere of intimi- dation in the society. The negative dynamics is characterized by the growth of the number of victims of human rights violations and discrimination. Under these circums- tances, with a high level of latent violations and concealed facts, with great obstacles to human rights activity and overall fear in the society, the growth points to drastic stiffening of the regimes methods. Human Rights Situation in 2014: Trends and Evaluation The situation of human rights during 2014 remained consistently poor with a tendency to deterioration at the end of the year. Human rights violations were of both systemic and systematic nature: basic civil and political rights were extremely restricted, there were no systemic changes in the fi eld of human rights (at the legislative level and (or) at the level of practices). The only positive development during the year was the early release of Ales Bialiatski, Chairman of the Human Rights Centre “Viasna” and Vice-President of the International Federation for Human Rights.

    LITHUANIAN HISTORICAL STUDIES 21 2017 ISSN 1392-2343 PP. 1–30 THE MODERNISATION OF THE COURT SYSTEM IN THE GRAND DUCHY OF LITHUANIA: CHANGES TO THE ORGANISATION OF THE LOCAL DISTRICT COURTS AND REGULATION OF JUDGES’ DUTIES IN 1764–1793 Ramunė Šmigelskytė-Stukienė (Lithuanian Institute of History) ABSTRACT In the mid-18th century, with the spread of the ideas of the Enlightenment, fundamental reforms of the state’s governance were introduced in the Polish-Lithuanian Commonwealth. Part of the state’s modernisation concerned the reform of the court system, considered by 18th-century politi- cal theorists to be one of the composite branches of the state administration (alongside the treasury, the police and the army). During the reign of Stanislas Augustus Poniatowski, the work of the courts of first instance underwent reform on several occasions in Poland and Lithuania: with the passing of laws in 1764, 1792 and 1793 on the structure and organisation of the activities of the castle and land courts, the existing court system was changed, as was the procedure for electing judges, also defining the scope of competency of the courts, regulating court activities and the duties of judges, introducing new requirements for the handling of court procedural documents, and the calculation of judges’ working hours. During the course of the introduction of these reforms, principles reflecting the administrative ideas of the Enlighten- ment were gradually entrenched in the court system of the Polish-Lithuanian Commonwealth, which concerned the election of judges and other court of- ficials, the acceptance of collegial decisions, the elimination of the influence of any blood and marital ties, and the principles for remuneration, seeking to introduce stricter requirements for the qualification of judges.
