Immigration Ordinance (Chapter 115) (Section 37E(4)) NOTICE OF SEIZURE OF A SHIP Notice is hereby given under section 37E(4) of the Immigration Ordinance (Chapter 115) that the following ships were seized by me on 16 August 2012 pursuant to an approval in writing of the Secretary for Justice dated 26 June 2012 under section 37E(2) of the Immigration Ordinance:— — An unnumbered wooden fishing vessel, about 13.05 metres in length, 2.76 metres in breadth, fitted with one inboard engine, with 8 persons on board, intercepted by the police on 21 April 2010 at the sea off southwest of , ; — An unnumbered wooden vessel, about 10.7 metres in length, 2.9 metres in breadth, fitted with two inboard engines, with 5 persons on board, intercepted by the police on 15 May 2010 at sea off south of Shek Lam Chau, Hong Kong; — An unnumbered motorized sampan, about 7.6 metres in length, 2.06 metres in breadth, fitted with one outboard engine, with 3 persons on board, intercepted by the police on 27 March 2009 at sea off south of , Hong Kong; — An unnumbered motorized wooden vessel, about 7.92 metres in length, 1.52 metres in breadth, fitted with one inboard engine, with 6 persons on board, intercepted by the police on 21 October 2009 at shore of Sha Kiu, Hong Kong; — An unnumbered wooden sampan, about 4.22 metres in length, 1.03 metres in breadth, with 2 persons on board, intercepted by the police on 21 October 2009 at sea off Sha Kiu, Hong Kong; — A motorized sampan, ‘粵汕尾 55178’, about 6.15 metres in length, 1.9 metres in breadth, fitted with one outboard engine, with 7 persons on board, intercepted by the police on 31 August 2007 at shore of Lung Ha Wan, Hong Kong; — A motorized sampan, ‘琼澹州 14072’, about 5.95 metres in length, 1.95 metres in breadth, fitted with one outboard engine, with 2 persons on board, intercepted by the police on 10 September 2009 at sea off Black Point, Lung Kwu Tan, Hong Kong; — A wooden vessel, ‘番自用農 W1750’, about 7.32 metres in length, 1.39 metres in breadth, fitted with one inboard engine, with 5 persons on board, intercepted by the police on 14 November 2009 at shore of Sha Kiu, Hong Kong; — An unnumbered wooden fishing vessel, about 11.6 metres in length, 2.71 metres in breadth, fitted with two inboard engines, with 11 persons on board, intercepted by the police on 4 March 2010 at sea off Tai , Hong Kong; — A motorized sampan, ‘粵陽西 33138’, about 5.78 metres in length, 1.83 metres in breadth, fitted with one outboard engine, with 5 persons on board, intercepted by the police on 9 March 2010 at sea off Sha Kiu Village, Hong Kong; — A motorized sampan, ‘粵深圳 8106’, about 5.76 metres in length, 1.8 metres in breadth, fitted with one outboard engine, with 9 persons on board, intercepted by the police on 18 January 2010 at sea off east of Crescent Island, Hong Kong; — An unnumbered wooden vessel, about 12.9 metres in length, 2.7 metres in breadth, fitted with one inboard engine, with 1 person on board, intercepted by the police on 20 June 2010 at sea off Fan Lau Kok, , Hong Kong; — An unnumbered wooden vessel, about 6.4 metres in length, 2 metres in breadth, fitted with one inboard engine, with 15 persons on board, intercepted by the police on 20 June 2010 at shore of Fan Lau Kok, Lantau Island, Hong Kong; — A wooden fishing vessel, ‘粵陽西 24173’, about 10.35 metres in length, 2.83 metres in breadth, fitted with two inboard engines, with 6 persons on board, intercepted by the police on 6 September 2010 at sea off Fan Lau Tung Wan, Lantau Island, Hong Kong.

CHAN Director of Immigration ID163C Note:— Under section 37E(5) of the Immigration Ordinance, any person who has a claim to a ship which has been seized (in this section and in section 37F referred to as the claimant) may, within 30 days of the publication in the Gazette of notice of the seizure, give notice in writing to the Director that he claims that the ship is not liable to forfeiture. Under section 37E(6) of the Immigration Ordinance, a notice under section 37E(5) shall state an address within Hong Kong at which the claimant may be served in any proceedings arising out of the claim and in any such proceedings a document addressed to the claimant and sent by post to, or delivered at, that address shall for the purposes of this Part be deemed to be duly served on the claimant. Under section 37E(8) of the Immigration Ordinance, if, on the expiry of the period of time specified in section 37E(5) for the giving of a notice of a claim, no such notice has been given in writing to the Director, the ship shall thereupon be deemed to be duly forfeited to the Government. Under section 37E(9) of the Immigration Ordinance, a person has a claim for the purposes of this section and section 37F if:— (a) he is the owner of the ship, or of an interest in the ship, or is the agent of the owner; or (b) he was in possession of the ship at the time it was seized.
