INDICTMENTANDCHARGES TheindictmentagainstŽeljkoRažnatovićwasfiledon23September1997andconfirmedon30September 1997. Accordingtotheindictment,ŽeljkoRažnatovićwasformerlypresidentofthefanclubofBelgrade’s“Red Star” football team. He used this group as a base for the establishment, on 11 October 1990, of a paramilitaryorganisationknownasthe"SerbianVolunteerGuard"or,alternatively,as"Arkan’sTigers."He led this group in fighting in the Eastern Slavonian region of in 19911992 and then in various locationsinBosniaHerzegovinain1992.In1993,Arkan formedthePartyofSerbianUnityandputforth candidates,includinghimself,fornationalofficeundertheparty’sauspices.In1995,heledparamilitary troops of "Arkan’s Tigers" into fighting in northwestern BosniaHerzegovina. He commanded this force whileitwasdeployedinthecityofSanskiMostduringSeptember1995. The indictment alleged that, as the Bosnian forces (“ABiH”) neared Sanski Most in September 1995,a stateofpanicsetinamongtheSerbciviliansandsoldiersandmanycontinuedtofleeinthedirectionof BanjaLuka.Around15September1995,attheinvitationoflocalSerbleaders,"Arkan’sTigers"entered theSanskiMostareainordertorestoreorderand tochecktheadvanceoftheABiH."Arkan’sTigers" establishedtheirheadquartersattheHotel“Sanus”inthecentreofthetown,andArkaninstalledhimself in the office of the hotel manager. It was from this location that he directed the activities of his paramilitarytroops,whosetupcheckpointsthroughouttheareaandbeganforciblydraftingSerbmento fightagainsttheABiH.InadditiontoestablishingcheckpointsinSanskiMost,"Arkan’sTigers"alsoengaged insystematicpatrolsaroundthetown,inordertoidentifyanddetainMuslimandothernonSerbmen,to extortvaluablesfromnonSerbfamilies,andtoobtainnonSerbhomesforusebySerbrefugees.During thesepatrols,theperpetrationofbeatingsandrobberiesby"Arkan’sTigers"werecommonplace.Manyof theMuslimandothernonSerbmenwhowereabductedweretakentotheHotel“Sanus”forinterrogation byRažnatović andhissubordinates.Theyweresubjectedtorepeatedbeatingsandharassmentby"Arkan’s Tigers"andalargenumberofthesedetaineeswereimprisonedinasmallboilerroom,approximatelyfive squaremetersinsize,locatedinthebasementofanadjoiningbuilding. Željko Ražnatović was charged on the basis of individual criminal responsibility (Article 7(1) of the Statute)andonthebasisofsuperiorcriminalresponsibility(Article7(3)oftheStatute)with:

— Murder,otherinhumaneacts,rape (crimesagainsthumanity,Article5) — Murder;crueltreatment,rape (violationsofthelawsorcustomsofwar,Article3) — Wilfullycausinggreatsuffering,wilfulkilling (GraveBreachesoftheGenevaConventionsof1949, Article2)
