CapeNature would like to thank you for the opportunity to comment on the Draft Basic Assessment Report for this application and wish to make the following comments:

1. The proposed borrow pit site was historically covered by Swartland Shale Renosterveld, which is a Critically Endangered vegetation type with less than 6% of its original extent remaining. However, the site has been entirely transformed by agriculture and there is no natural vegetation remaining.

2. There are no Critical Biodiversity Areas or Ecological Support Areas on the site. One issue we would like to clarify is that some maps (e.g. Cape Farm Mapper) have placed the Grotto Bay Private Nature Reserve label on this portion. The nature reserve is in fact located on portion 2 of Farm 721 which is located west of the R27.

3. The nearest natural surface water is more than 400m away and the borrow pit should thus not pose a risk to the river. We would however, like some clarity on the proposed mining depth and confirmation that it will not affect any ground water resources.

4. Mining and rehabilitation should occur concurrently and mining blocks should be no larger than 1ha as indicated. Ideally, at least 50cm of topsoil should be stored to ensure sufficient coverage during rehabilitation.

5. There should be ongoing monitoring and control of erosion and alien clearing should be undertaken regularly.

The Department of Environment, Forestry and Fisheries (DEFF)’s Protected Areas Register (PAR) was consulted to ascertain the location of the Grotto Bay Private Nature Reserve. According to the DEFF’s PAR, the locality of the Grotto Bay Nature Reserve is depicted correctly in the draft BAR.

The Cape West Coast Biosphere Reserve (CWCBR), of the UNESCO: Man, and Biosphere Programme, aims to implementing sustainable development principles along the West Coast, in addition to integrating rapid growth with biodiversity and heritage conservation. The CWCBR extends from the Diep River in the south to the Berg River in the north and inland to Malmesbury and therefore the proposed development is located within the CWCBR. In this regard, the CWCBR would like to comment as follows:

Our concerns are the following; Why was the printed report placed in the Mamre public library, the closest towns to this site are Yzerfontein and Darling and the closest office accessible to the public are those of the Cape West Coast Biosphere on the R27. The farm is in the Swartland Municipal area and not in the City of Cape Town in which Mamre lies.

The mining area is in the Grotto Bay Nature Reserve. This is raising concerns as no mining should take place in a nature reserve.

The area is inside the Yzerfontein State Water Control Area and on the Grootwater Aquifer, no mention is made thereof in this report. Groundwater  Aquifers are the most important source of potable water on the West Coast as surface water sources are very scarce. Therefor a groundwater impact assessment should be undertaken to determine the impact the proposed mining operations will have on groundwater sources.

S Socio-Economic Development  The project must make use of local labour. Statistics of the origin of labour used in both construction and operation must be reported on a monthly basis to the Environmental Control Officer (ECO).  Potential contributions by the company to social and economic upliftment should be detailed as a condition of Environmental Authorisation (EA). As both the local schools at Modderrivier and Groote Post have been closed financial benefits can be made to Vooruitsig in Darling and an environmental offset could be made to the Darling Wildflower Conservation Trust (NPO)which will use it for management of renosterveld vegetation in the bigger Darling area.  Potential contributions to local gross domestic product (GDP) and total jobs created should be detailed in the report.

Tourism  The West Coast has been identified as an area that has high potential for economic growth in both the mining and the tourism sectors. These sectors are however not always compatible. The Darling Hills Road is the road used by tourist to visit the Groote Post Winery located at Klawervlei. To prevent conflict on the gravel road, maintenance should be increased to the cost of the developer and only trucks and equipment registered in the Western Cape should be used to get some of license fees into the local coffers. Maybe a lower speed limit could also help to mitigate.

Monitoring and Rehabilitation  An independent Environmental Control Officer (ECO) must be appointed to oversee all phases of the mining operation. Am ECO should not only be on site for 3 months, but on a permanent basis till the end of the project. Monitoring must be according to the approved Environmental Management Plan (EMPr) and Environmental Authorisation. Monthly reports must be submitted by the ECO indicating compliance or non-compliance.  We as the CWCBR can offer our services to act as an ECO, as we have the skills, experience, capacity and local knowledge at board level and in company. We are independent, BEE compliant, an NPC and are for sustainable development. We will do this at professional fee.  A monitoring programme must be established to determine the potential increase of pollutants (including dust pollution) emitted by the proposed mining operation. This must include baseline data from prior to the initiation of operations.  A search and rescue programme for fauna and flora must be undertaken prior to any clearing of vegetation. The specimens must be relocated to the natural area within or adjacent to the development. Search and rescue specimens must be transplanted as soon as possible to ensure survival.  Rehabilitation of mined and impacted areas must only use species indigenous to the West Coast and endemic plants from the area.

 An Alien eradication programme must be initiated on farm 721. Various declared invasive spesies do occur on this property. Acacia Saligna and Acacia cyclops are visible on the property. Echium plantigeneum is also becoming a serious ecological problem in the Western Cape and on the West Coast specifically. These 3 declared invasive spesies are schedule 1b category under the NEMBA regulations and there is a responsibility on land- owners to control and eradicate them. All environmental legislation should be adhered to.  No further illegal clearing of indigenous vegetation should take place on farm 721. There are procedures to be followed, contact DEA&DP or the Dept of Agriculture. This has happened in the past. Only a third of this farm is arable and although the proposed mining area is small it still is a farm and the cumulative impacts of mining will impact on agricultural potential, food security and agricultural land need to be protected.

1.1 The mining permit is for the proposed establishment of a borrow pit on the Remaining Extent of the Farm Modder Rivier No. 721, Grotto Bay. The intended use of the gravel material is for the improvement of internal roads and for the sale to third parties. According to the Draft BAR, the proposed site is located within the Grotto Bay Private Nature Reserve. Per available information, the Grotto Bay Private Nature Reserve was proclaimed as a nature reserve on 8 March 2002.

1.1.1 The Norms and Standards for the inclusion of Private Nature Reserves in the Register of Protected Areas of South Africa were gazetted in Government Notice (“GN”) No. 1157 of 3 November 2017, promulgated in terms of section 11 read with section 10(2) of the National Environmental Management: Protected Areas Act, 2003 (Act No. 57 of 2003) (“NEM: PAA”). One of the purposes of these Norms and Standards is to provide for the recognition of private nature reserves as bona fide protected areas in terms of the NEM: PAA. All declared private nature reserves, including the management thereof, must adhere to the mentioned Norms and Standards. 1.1.2 According to the Department of Environmental Affairs’ Protected Areas Register, Grotto Bay Private Nature Reserve is included in the Register that contains a list of all Protected Areas. 1.1.3 The relevance and importance of the NEM: PAA, Norms and Standards for the inclusion of Private Nature Reserves in the Register of Protected Areas of South Africa, and other subordinate legislation of the NEM: PAA, must be included in section 5 (Policy and Legislative Context) of the Draft BAR.

1.2 Section 48 of the NEM: PAA provides for restrictions of prospecting and mining activities in protected areas. “48. Prospecting and mining activities in protected area (1) Despite other legislation, no person may conduct commercial prospecting or mining activities- (a) in a special nature reserve or nature reserve; (b) in a protected environment without the written permission of the Minister and the Cabinet member responsible for minerals and energy affairs; or (c) in a protected area referred to in section 9(b) or (d)….

(3) The Minister, after consultation with the Cabinet member responsible for mineral and energy affairs, may, in relation to the activities contemplated in subsection (2), as well as in relation to mining activities conducted in areas contemplated in that subsection which were declared as such after the commencement of this section, prescribe conditions under which those activities may continue in order to reduce or eliminate the impact of those activities on the environment or for the environmental protection of the area concerned.”

1.2.1 It is advised that the competent authority consult with the national minister responsible for environmental affairs before a decision is made on the application for environmental authorisation (“EA”). In this regard, the High Court Judgement (Gauteng Division, Pretoria) delivered on 8 November 2018 in the matter between Mining and Environmental Justice Community Network of South Africa and Others vs. Ministers of Environmental Affairs and Mineral Resources and Others (Case No. 50779/2017), must be considered.

1.3 Given that the proposed site was used for agriculture on or after 1 April 1998, Activity 28 of Listing Notice 1 of the 2014 Environmental Impact Assessment (“EIA”) Regulations (as amended) is triggered by the proposed borrow pit. Please note the following: 1.3.1 Listing Notice 1 of the 2014 EIA Regulations (as amended) defines development as: “means the building, erection, construction of establishment of a facility, structure or infrastructure, including associated earthworks or borrow pits, that is necessary for the undertaking of a listed or specified activity, but excludes any modification, alteration or expansion of such a facility, structure or infrastructure, including associated earthworks or borrow pits, and excluding the redevelopment of the same facility in the same location, with the same capacity and footprint;”. 1.3.2 The proposed borrow pit constitutes the establishment of a facility and is regarded as a commercial development. The application for EA should therefore accordingly be amended to include Activity

28 of Listing Notice 1 of the 2014 EIA Regulations (as amended). This determination is made as the proposed site is located outside an urban area and will be approximately 2.65ha in extent; and the proposed borrow pit is for commercial purposes on land used for agriculture on or after 01 April 1998.

1.4 Although an agricultural impact assessment will not be undertaken, the potential impacts associated with the loss of agricultural land must be provided. Comment from the Department of Agriculture must be obtained and included in the Final BAR.

1.5 The relevant planning policies applicable to the area have not been considered and reported on. The applicant is required to report on the need and desirability of the proposed development in relation to the relevant planning policies (e.g. relevant Integrated Development Plan/s, Spatial Development Framework/s, etc.) applicable to the area.

1.6 Although the co-ordinates of the property were provided, the co-ordinates of the boundaries of the proposed borrow pit/ mining area must also be provided.

1.7 Proof of the public participation process undertaken for the EIA application must be included in the Final BAR to be submitted to the competent authority. Please note that the proof must include, inter alia, the following: 1.7.1 A copy of the newspaper advertisement (“newspaper clipping”) that was placed, indicating the name of the newspaper and date of publication; 1.7.2 Proof of the written notices that were provided to potential and registered I&APs; and 1.7.3 Photographs showing the notice displayed on sites and a copy of the text displayed on the notice.

1.8 The Environmental Management Programme (“EMPr”) must be amended to address/include the following requirements: 1.8.1 A rehabilitation plan for the rehabilitation of the borrow pit area and associated access road must be provided; 1.8.2 The fines and penalties associated with potential non-compliance with the EA and EMPr must be included; 1.8.3 The auditing requirements in terms of regulation 34 of the 2014 EIA Regulations (as amended) must be provided; 1.8.4 The roles and responsibilities of, inter alia, the holder of the EA, contractor, mine manager and Environmental Control Officer must be defined and included in the EMPr; 1.8.5 A dust management plan to manage potential dust impacts must be compiled and included; and 1.8.6 The EMPr must be amended to include the requirements of section 30 and section 30A of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (“NEMA”), should incidents and/or emergency situations arise during any stage of the proposed development. (In this regard, also refer to paragraph 3.2 below.)

2.3 The EMPr must include the following mitigation measures to ensure effective solid waste management during the lifecycle of the proposed development: 2.3.1 Excavated spoils must be stockpiled and used, where possible, in profiling and rehabilitation of the borrow pit; 2.3.2 Provide enough receptacles with lids and with adequate capacity to accommodate the generation of waste. Receptacles must be strategically placed, preferably close to the waste generation area, and for easy access for further recycling or disposal; 2.3.3 Receptacles must be managed and emptied at a frequency to ensure that waste does not overflow; 2.3.4 The EMPr must clearly indicate how the waste management hierarchy, with focus on waste minimisation, will be implemented; 2.3.5 Staff must be encouraged to minimise waste through waste recovery. Receptacles for recycling must be clearly marked for the separation of recyclables like cans, plastics, glass, etc.; 2.3.6 The applicant or his representative must ensure that all personnel are trained on waste minimisation and how to correctly dispose of their general waste. Such training must be included in the environmental awareness plan; 2.3.7 No waste material may be burnt or buried on the site; 2.3.8 All solid waste must be managed in a designated area and any non-recyclable waste must be safely disposed of at a licensed waste disposal facility; 2.3.9 Any litter generated outside of the temporary waste storage area must be dealt with immediately; 2.3.10 The management of potentially hazardous wastes such as waste oils and lubricants generated during the maintenance of excavating and other heavy-duty equipment must be addressed; and 2.3.11 The management of the site afterhours must be clearly described in the EMPr.

3. Directorate: Pollution and Chemicals Management – Ms Shehaam Brinkhuis ([email protected]; Tel: (021) 483 8309):

3.1 Ideally, no re-fuelling, handling of hydrocarbon products or maintenance of heavy earth-moving vehicles should occur within the mining area and only minor repairs and maintenance of vehicles and equipment should be allowed within the proposed site. Alternatively, re-fuelling and other activities may only be undertaken within a single designated on-site area that makes use of un-plasticised polyvinyl chloride lining and drip trays.

3.2 Any event resulting in spillage or leakage of hazardous substances onto land or into water resources must immediately be reported to the relevant authorities, including this Directorate, in accordance with section 30 of the NEMA, 1998. Information related to the incident must include the reporting, containment and clean-up procedures of such an incident/s, and the immediate remediation of the affected area. All necessary documentation must be completed and submitted to the relevant authorities within the prescribed timeframes.

4. Directorate: Air Quality Management – Mr Peter Harmse ([email protected]; Tel: (021) 483 8343):

4.1 Section 5 of the Draft BAR must be updated to include the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004) and the National Dust Control Regulations (GN No. R. 827 of 1 November 2013) promulgated in terms of said Act. Dust generated during the various phases of the proposed development must comply with the National Dust Control Regulations. These regulations prohibit a person from conducting any activity in such a way as to give rise to dust in such quantities and concentrations that the dust, or dust fall, may have a detrimental effect on the environment, including health.

4.2 The Draft BAR and EMPr indicate that fugitive dust emissions are likely to occur during the construction (development of the proposed access road and site clearance), operation (mining, stockpiling, loading and hauling), and rehabilitation and closure phases of the proposed development. All recommendations and mitigation measures related to dust management must be implemented. Furthermore, it is recommended that dust suppression measures be implemented through a dust monitoring programme or fugitive dust control plan.

4.3 Noise generated during all phases of the proposed development must comply with the Western Cape Noise Control Regulations (Provincial Notice 200/2013) of 20 June 2013. This requirement must be included in the EMPr.

4.4 Best practice measures must be employed to minimise any noise or dust impacts that may occur during the various phases of the proposed development.

5. The applicant is reminded of its “general duty of care towards the environment” as prescribed in section 28 of the NEMA, 1998 which states that “Every person who causes, has caused or may cause significant pollution or degradation of the environment must take reasonable measures to prevent such pollution or degradation from occurring, continuing or recurring, or, in so far as such harm to the environment is authorised by law or cannot reasonably be avoided or stopped, to minimise and rectify such pollution or degradation of the environment.”
