PE8 5RG Land/Buildings at: The Wheatsheaf Inn, Main Street, Upper Benefield, Northamptonshire. PE8 5AN THIS NOTICE is issued by the Council because it appears to it that there has been a breach of planning control, under Section 171A (1) (a) of the above Act, at the land described below. It considers that it is expedient to issue this notice, having regard to the provisions of the development plan and to other material planning considerations. The Annex at the end of the Notice and the enclosures to which it refers contain important additional information. 1. LAND TO WHICH THIS NOTICE RELATES The land (including any buildings thereon) known as The Wheatsheaf Inn, Main Street, Upper Benefield, Northamptonshire. PE8 5AN and shown edged red on the attached plan. 2. THE MATTERS WHICH APPEAR TO CONSTITUTE THE BREACH OF PLANNING CONTROL (1) A large marquee has been erected on the land on a permanent basis without planning permission. THE REASONS FOR ISSUING THIS NOTICE It appears to the Council that the above breach of planning control has occurred within the last 4 years. (1) A building operation has occurred on the land without planning permission. A planning application, reference EN/12/00604/FUL, to grant retention of the marquee was refused by the Committee of the Local Planning Authority on 17th. September 2012. The retention of the marquee on a permanent basis would result in a detrimental visual impact on the character and appearance of the conservation area. The marquee, due to the close relationship of the site to surrounding dwellings, by reason of noise, would give rise to a significant loss of amenity for neighbouring dwellings. The unauthorised building operation on the land is contrary to the following policies: (i) Policy 13(h) of the North Northamptonshire Core Spatial Strategy. (ii) Policy 13(I) of the North Northamptonshire Core Spatial Strategy Policy 13 of the North Northamptonshire Core Spatial: General Sustainable Principles – in that development should be of a high standard of design, architecture and landscaping, respect and enhance the character of its surroundings. 4. WHAT YOU ARE REQUIRED TO DO (1) Dismantle and remove the marquee from the grounds of the site. 5. TIME FOR COMPLIANCE (1) 28 days from the date this notice takes effect. 6. WHEN THIS NOTICE TAKES EFFECT This notice takes effect on 1st December 2012, unless an appeal is made against it beforehand. You can appeal on-line or by post using forms available from The Planning Inspectorate. The enclosed booklet "Making your Appeal” sets out your rights. Read it carefully. Failure to comply with an enforcement notice which has taken effect can result in prosecution and/or remedial action by the Council.
