En effet, Monsieur Dubled, l'un de vos prédécesseurs à Carpentras, d'une vieille famille de Gajan, village ou était né mon grand-père paternel, était devenu l'un des nôtres. Monsieur, à partir de maintenant vous siégez au fauteuil que Monsieur Louis Leprince Ringuet né à Alès, membre de l'Institut, avait occupé immédiatement avant Monsieur René Rémond, lui aussi de l'Institut, qui ne put venir à Nîmes qu'une seule fois. C’était à l'occasion d'une séance publique. Vous êtes conservateur en chef de la prestigieuse bibliothèque Inguimbertine et des Musées de Carpentras et c'est un honneur pour nous de vous recevoir et de vous compter parmi nos membres. Vous êtes né à Nîmes en 1964, dans une famille nîmoise. Je salue respectueusement Monsieur et Madame Delmas, vos parents, dont vous avez souhaité la présence au moment ou vous devenez immortel mais peut-être votre appartenance à l'Académie de Vaucluse vous a t-elle déjà conféré l'immortalité ? Trials by Peers: The Ebb and Flow of the Criminal Jury in France and Belgium Claire M. Germain1 Abstract The participation of lay jurors in criminal courts has known much ebb and flow both in France and in Belgium. These two countries belong to the civil law tradition, where juries are the exception rather than the rule in criminal trials, and they only exist in criminal cases, not civil cases. In spite of some similarities, there are substantial differences between the two countries, and their systems will be examined in turn. In France, the Cour d’assises itself was inherited from the French Revolution. -

THE MOST DANGEROUS GAME: U.S. OPPOSITION TO THE CULTURAL EXCEPTION INTRODUCTION n the 2004 documentary film Mondovino, filmmaker Jonathan Las- I siter explored a raging conflict in the increasingly globalized wine industry.1 At the heart of the conflict is the concept of terroir, which re- fers to the distinct tastes and aromas that result from the particular soil, climate, and growing methods of the different regions in which wine is made.2 These particularized attributes are critical in maintaining the di- versity of wines that occur throughout the world.3 In their absence, wines from Napa will become indistinguishable from those of Bordeaux.4 The local growers and wine aficionados interviewed in the film see two major threats to the continued existence of their cherished terroir.5 First, as multinational wine companies have accumulated -

CULTURAL GOVERNANCE IN CONTEMPORARY CHINA: POPULAR CULTURE, DIGITAL TECHNOLOGY, AND THE STATE BY LUZHOU LI DISSERTATION Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in Communications and Media in the Graduate College of the University of Illinois at Urbana-Champaign, 2015 Urbana, Illinois Doctoral Committee: Professor Emeritus John Nerone, Chair Assistant Professor Amanda Ciafone Professor Emeritus Dan Schiller Professor Kent Ono, University of Utah ii ABSTRACT This dissertation is a study of the historical formation and transformation of the Chinese online audiovisual industry under forces of strategic political calculations, expanding market relations, and growing social participation, and the cultural ramifications of this process, especially the kind of transformations digital technologies have wrought on the state-TV-station-centered mode of cultural production/distribution and regulatory apparatuses. Through this case, the project aims to theorize the changing mode of cultural governance of post-socialist regimes in the context of digital capitalism. Using mixed methods of documentary research, interviews with industry practitioners, participant observations of trade fairs/festivals, and critical discourse analyses of popular cultural texts, the study finds that the traditional broadcasting and the online video sectors are structured along two different political economic mechanisms. While the former is dominated by domestic capital and heavily regulated by state agencies, the latter is supported by transnational capital and less regulated. Digital technologies coupled with transnational capital thus generate new cultural flows, processes, and practices, which produces a heterogeneous and contested cultural sphere in the digital environment that substantially differs from the one created by traditional television. -

The essays in Cultural History in France: Local Debates, Global Perspectives provide thought- provoking snapshots of the key questions and debates with which practitioners of cultural history in France have wrestled over the past two decades. Among other virtues, the collection reminds us that historians in France probed a different set of questions about cultural history and faced different stakes than their American counterparts because of each country’s distinctive intellectual and institutional culture. English-speaking historians will recognize some familiar territory such as the tension between social history and cultural history, and will also encounter some distinctly French debates produced within the context of French intellectual and scholarly traditions. Whether returning to these debates over the meaning and practice of cultural history or encountering them the first time, many historians in France, the UK, Europe and around the globe will find this collection intellectually, methodologically, and perhaps even politically stimulating. Preface Before I begin, I would like to clarify my approach to the subject of French cultural policy. I am not French, nor do I work in cultural administration in any form. I am neither political scientist nor sociologist. What I am is an academic working in the area of French studies, the main object of which is of course France itself. As such, I generally adopt a cultural-historical perspective in my research field, which I define as the contemporary history of French cultural policies, practices and institutions. What my perspective brings to the study of cultural policy, therefore, is a concern not just with administrative and distributive structures but with the importance the arts have been accorded in France for several hundred years. In his paper for this Tribunal, Kevin Mulcahy evokes the French state’s ‘strong sense of cultural mission’ (Tribunal Reader, 1999, 255), while a French writer on the subject, Jean-Michel Djian, starts from the fearlessly unequivocal view that ‘cultural policy is a French invention’ (Djian, 1996, 11). -

INTRODUCTION In recent years, many countries have become increasingly concerned with the potential impact of economic globalization on cultural diversity. They fear that increased trade liberalization in cultural industries will lead to a uniform, commercial monoculture and a loss of social cohesion and national identity.1 Previous efforts to preserve or promote cultural diversity focused on excluding culture from international trade negotiations and agreements.
