Summaries of the contributions ................... 61 § 4 A 2009 perspective on the aims of 1959 Antoine COMPAGNON How can I inaugurate this fiftieth anniversary without recalling the words used by André Malraux at the inaugura- tion of his Cultural Affairs mission when his Ministry was first created in 1959? ‘The mission of the cultural affairs minister is to render the major works of humanity accessible, and first and foremost in France, to the greatest pos- sible number of French people; to ensure the widest possible audience for our cultural heritage and to promote the creation of works of art and the spirit that enriched them’. Three objectives were thus specified, and in an order that is not without significance. Firstly, there is the sharing of culture among the whole French nation, the popularisation of great French creations and subordinately those of foreign creation; secondly, the spreading throughout France and beyond France of a ‘cultural heritage’, a new concept, comparing to historic monuments everything that has been judged worthy of preservation from the past (at the time, there was still no talk of ‘memory’); thirdly, there was assis- tance with contemporary creation. When the Maison de la Culture was inaugurated in Amiens in March, 1966, André Malraux repeated that the aim of these establishments, which were devoted principally to the theatre, coincided with the initial ambition of his min- istry, namely, ‘to do what needs to be done in order to ensure that every child has access to works of the heritage of humanity’. It is in the context of these three achievements that the actions of the Ministry of Cultural Affairs, subsequently known as Culture, can be appreciated today, half a century later. He tz Minister of counterculture Gilberto Gil wears a sober suit and tie these days, and his dreadlocks are greying at the temples. But you soon remember that, as well as the serving culture minister of Brazil, you are in the presenceof one of the biggest l,atin American musicians of the 60s and 70s when you ask him about his intellectual influences and he cites Timothy l,eary. "Oh, yeah!" Gil says happily, rocking back in his chair at the Royal SocietyoftheArts in London. "Forexam- ple, all those guys at Silicon Valley - they're all coming basically from the psychedelic culture, you know? The brain-expanding processesof the crystal had a lot to do with the internet." Much as it may be currently de rigueur for journalists to ask politicians whether or not they have smoked marijuana, the question does not seem worth the effort. Gil's constant references to the hippy counterculture are not simplythe nostalgia of a 63-year-old with more than 4O albums to his name. For several years now, largely under the rest of the world's radar, the Braeilian government has been building a counterculture ofits own. The battlefield has been intellectual property - the ownership ofideas - and the revolution has touched everything, from internet file- sharing to GM crops to HIV medication. Phar- maceutical companies selling patented Aids drugs, for example, were informed that Brazil would simply ignore their claims to ownership and copy their products more cheaply if they didn't offer deep discounts.

Germain1 Abstract The participation of lay jurors in criminal courts has known much ebb and flow both in France and in Belgium. These two countries belong to the civil law tradition, where juries are the exception rather than the rule in criminal trials, and they only exist in criminal cases, not civil cases. In spite of some similarities, there are substantial differences between the two countries, and their systems will be examined in turn. In France, the Cour d’assises itself was inherited from the French Revolution.

THE MOST DANGEROUS GAME: U.S. OPPOSITION TO THE CULTURAL EXCEPTION INTRODUCTION n the 2004 documentary film Mondovino, filmmaker Jonathan Las- I siter explored a raging conflict in the increasingly globalized wine industry.1 At the heart of the conflict is the concept of terroir, which re- fers to the distinct tastes and aromas that result from the particular soil, climate, and growing methods of the different regions in which wine is made.2 These particularized attributes are critical in maintaining the di- versity of wines that occur throughout the world.3 In their absence, wines from Napa will become indistinguishable from those of Bordeaux.4 The local growers and wine aficionados interviewed in the film see two major threats to the continued existence of their cherished terroir.5 First, as multinational wine companies have accumulated

The exhibition’s origins In 2007, the exhibition “Europe is our history! 50 years of European construction”, designed and produced by Tempora SA at the request of the Museum of Europe, was presented in Brussels on the occasion of the anniversary of the Treaties of Rome. The exhibition was quite naturally addressed at all Europeans, but in particular, with it being presented in Brussels, was aimed at an audience drawn from the founding Member States of the European Union. In 2009, at the request of the Municipality of Wroclaw, the exhibition was presented in Poland in a version adapted for a Polish audience. The Cardinal Kominek (1903-1974) was part of this adaptation which enabled us to discover his initiatives for reconciliation in Europe. This gave rise to the itinerant exhibition which, after Italy (The Vatican), Germany (Berlin) and Poland (Wroclaw), is today presented in Brussels: it allows us to discover the initiatives, of which most Belgians are largely unaware, of this Polish prelate in favor of reconciliation that was long thought impossible, between Germans and Poles. And therefore, more extensively between Europeans. 2. The historical context “The Poles”, explains the Professor Krzysztof Pomian, exhibition curator, “were still suffering from the scars of the war of servitude and extermination carried out by Nazi Germany against their people, their country and their culture.

A society that demonstrates an interest in nurturing cultural and spiritual needs in conditions of liberty has a greater chance of developing a sense in the context of cultural rights in Europe of social responsibility among its members. Annamari Laaksonen This study is a general overview of existing legal and policy frameworks in Europe, covering access to and participation in cultural life, cultural provision and cultural rights. It aims at facilitating an environment that enables the development of access and participation in this area. The study also pays due tribute to local civil society organisations and cultural associations, in recognition of the important role they play in making access to culture possible. www.coe.int The Council of Europe has 47 member states, covering virtually the entire continent of Europe. It seeks to develop common democratic and legal principles based on the European Convention on Human Rights and other reference texts on the protection of individuals. Ever since it was founded in 1949, in the aftermath of the Second World War, the Council of Europe has symbolised reconciliation. CULTURAL GOVERNANCE IN CONTEMPORARY CHINA: POPULAR CULTURE, DIGITAL TECHNOLOGY, AND THE STATE BY LUZHOU LI DISSERTATION Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in Communications and Media in the Graduate College of the University of Illinois at Urbana-Champaign, 2015 Urbana, Illinois Doctoral Committee: Professor Emeritus John Nerone, Chair Assistant Professor Amanda Ciafone Professor Emeritus Dan Schiller Professor Kent Ono, University of Utah ii ABSTRACT This dissertation is a study of the historical formation and transformation of the Chinese online audiovisual industry under forces of strategic political calculations, expanding market relations, and growing social participation, and the cultural ramifications of this process, especially the kind of transformations digital technologies have wrought on the state-TV-station-centered mode of cultural production/distribution and regulatory apparatuses. Through this case, the project aims to theorize the changing mode of cultural governance of post-socialist regimes in the context of digital capitalism. Using mixed methods of documentary research, interviews with industry practitioners, participant observations of trade fairs/festivals, and critical discourse analyses of popular cultural texts, the study finds that the traditional broadcasting and the online video sectors are structured along two different political economic mechanisms. While the former is dominated by domestic capital and heavily regulated by state agencies, the latter is supported by transnational capital and less regulated. Digital technologies coupled with transnational capital thus generate new cultural flows, processes, and practices, which produces a heterogeneous and contested cultural sphere in the digital environment that substantially differs from the one created by traditional television.
