EPILOGUE: THE PART OF RELIGION AND POLITICS IN OUR CONSTITUTIONAL DEMOCRACY •.•...•.....••......• 817 INTRODUCTION In political and legal academic communities, as well as many religious communities, there is a movement towards a greater inter­ mingling of politics and religion. This Article analyzes the move­ ment's call for greater engagement of religion in politics and raises the profound consequences of this trend. 1 The departure from the prevailing separation model of church and state toward an accept­ ance of substantial religious representation in public life will ulti­ mately threaten religious equality and pluralism. This Article suggests that, despite the varying strands of the new trend towards greater religious participation in public life, there is a convergence upon a unitary framework. This Article de- I See infra parts I, II. 1993] RELIGION AS POLITICS 749 scribes and critiques the nature and the framework of this develop­ ment toward increased religious representation. Scholars have discussed the trends in political philosophy, the­ ology, and law as independent phenomena.2 There has not been concurrent consideration of these three seemingly discrete bodies of scholarship, as well as the related First Amendment Religion Clause jurisprudence. This Article analyzes the three leading argu­ ments from political theory, theology, and law for the treatment of religion as politics in the public domain. 3 It considers the underly­ ing momentum for the religion and politics debate and explores the implications of these arguments. This Article then examines the prevailing model for religious public participation. A greater role for religion in public life is erro­ neously premised on a vision of the public domain as a forum for conversation. This is a reductive conception both of religious ex­ pression and of public life, and it elides the actual impact of reli­ gious engagement in public life. The model is further analyzed by examining public participation, which demonstrates the limited ap­ plicability of the discourse model. This Article also offers an alternative view of the contemporary religion and politics debate. Engagement in public life may be bet­ ter understood as a forum for representation or recognition in na­ tional culture. Viewed this way, controversies ostensibly over the invocation of religious norms in public discourse are revealed to be struggles over the representation of religion in our public institu­ tions and culture. Properly understood as a dispute over represen­ tation, the question of greater engagement in the public realm requires asking by what principle should religious values be por­ trayed in the public domain? Part 1 of this Article identifies the political momentum towards a rethinking of the role of religious engagement. Part II describes the parallel momentum from a number of faith communities. From contemporary political theory, the justification for change derives from the recent acknowledgement of the breakdown in the possibility of rational or value-neutral polit­ ical deliberations, and an attendant rethinking of the role religion might play in public processes. From religion, the argument derives from the contemporary breakdown in the theological understanding of separate private and public arenas of action. From law, the jurisprudence demonstrates a development toward limiting and simplifying the doc­ trine of religious liberty that reflects special treatment of religious claims. 750 CORNELL LAW REVIEW [Vol. 78:747 politics debate. This Part shows how developments in First Amend­ ment Religion Clause jurisprudence support the recent turu to en­ gagement. Part IV proposes that the engagement model is patterned on theories of political participation and conceived as dia­ logical. The central elements of this model are delineated and criti­ qued. The engagement model raises serious equality issues by preferring religions committed to public participation. In Parts V, VI, and VII, the discourse model is critiqued by analyzing instances of actual public participation. Rather than functioning as a place for discourse, the public sphere signifies a place for cultural representa­ tion. Properly understood as a struggle for representation, the de­ bate over religious engagement holds profound implications for the protection of our religious equality and pluralism. I THE CALL FROM POLITICS A. Epistemology and Lawmaking The recent debate on the role of religion in public life has led to a demand for reconsidering the separation model as a vehicle for individual and societal decisionmaking. The separation model is grounded in a principle of separation of religious convictions from political decisionmaking.4 Under this model, an individual's reli­ gious convictions are expected to remain private and divorced from his or her political decisionmaking, which are publicly grounded in reason. 5 This conception of separation at the individual level paral- 4 It is primarily a liberal political principle.     Five Times Daily: The Dynamics of Prayer Worship Among Muslim Immigrants in St. John's, NL By Scott Royle A thesis submitted to the Department of Religious Studies at Memorial University of Newfoundland in partial fulfillment for the degree of Masters of Arts in Religious Studies March 2016 Abstract This thesis explores the ritual of prayer among Muslim immigrants in the city of St. John's, NL. Immigration across national, cultural, religious, and ethnic borders is a moment in an individual's life marked by significant change. My premise is that in such contexts the relatively conservative nature of religious ritual can supply much-needed continuity, comfort, and consolation for individuals living- through the immigrant experience. As well, ritual forms are often put under stress when transferred to a considerably different place and cultural context, where “facts on the ground” may be obstacles to traditional and familiar ritual forms. Changes to the understanding or practice of ritual are common in new cultural and geographic situations, and ritual itself often becomes not merely a means of social identification and cohesion, but a practical tool in processing change - in the context of immigration, in learning to live in a new community. St. John's is a lively and historic city and while Muslim immigrants may be a small group within it they nevertheless contribute to the city's energy and atmosphere. This thesis endeavours to better understand the life stories of ten of these newcomers to St. John's, focusing on their religious backgrounds and lives. In particular, this thesis seeks to better understand the place of prayer in the immigrant experience.

Religiously-inspired laws remain in force in nearly every nation on Earth to a greater or lesser degree. Some are totalitarian in nature – Iran, for instance, has the Ayatollah Ali Khamenei as its Supreme Leader, and all laws must pass through an Islamic “Guardian Council” – whilst others are either relics or traditions – the Monarch of the UK is also head of the Church of England, and in Ireland the law guarantees a “special position” for the Catholic Church, and the constitution says of God: “The state…shall hold his name in reverence and respect and honour religion.” Obviously, these examples operate at different ends of a spectrum.

Was it about installing a new Shia-Islamic theocracy, or was Shia-Islam, its ritual practices, ideology and institutions rather the fulcrum which allowed the historically marginalised Shiite population to assert itself politically within the Iraqi polity?     THE INTERACTION BETWEEN RELIGION AND POLITICS IN THE CONTEMPORARY WORLD Wednesday 16 March 2011 The River Room, House of Lords At a seminar chaired by the Lord Speaker, Baroness Hayman, in the House of Lords, Members of the House and senior journalists discussed the impact of religion on contemporary global and domestic politics, the interaction of faith with political structures and institutions, and the place of religion in public life. Short introductory speeches were delivered by three Members before the debate was opened up to the floor. In the first of the opening speeches, Lord Sacks, the Chief Rabbi, reflected on the separation between state and religion. It was initially believed that the growing secularism created by the enlightenment marked an end of the influence of religion. In fact, in the United States, which was identified by contemporary observers as a society where the state was non- religious, more people attended places of worship on a weekly basis than in countries which were theocracies such as Iran. Lord Sacks argued that religion still has a role and influence in society. Robert Putnam argued in ‘American Grace: How Religion Divides and Unites us’ that religion was a source for social capital. Whilst Niall Ferguson argued in ‘Civilization: The West and the Rest’ that religion had a key role in making Western civilization successful. Whoever does not understand religion will not understand the 21st century. In the modern world, most functions which were previously carried out by religion now have an alternative provider and advances in science and technology appear to have made religion redundant.

    Religion in Israel by Zvi YARON THE CONTROVERSY R.ELIGIO, N in the State of Israel has become noted for its poten- tial to generate strife. The frequent controversies over its role in society, an issue affecting the most sensitive areas of Israeli life, are acrimonious and harsh in tone. Many of them are accompanied by demonstrations and spiteful incidents instigated by extremists of all shades and opinions, rang- ing from the zealous Neture Karta to the frenetic League for the Prevention of Religious Coercion. No doubt, they reflect the acerbated feelings of many moderate Israelis. Religious disputes have arisen over education, the legal definition of "who is a Jew," the authority of the rabbinate, autopsies, marriage and divorce, the legal status of the common-law wife, the status of women, army service for girls and yeshivah students, Sabbath observ- ance, kashrut, the prohibition of pig-raising, and the closing of cinemas and theaters on religious holidays.
