Executive Summary

This semi annual report presents the status of land acquisition and other project impacts during the period from January 2016 to June 2016 in 9 subprojects under “Sustainable Rural Infrastructure Improvement Project (SRIIP) Design and Supervision Consultancy” executed by the Local Government Engineering Department (LGED) and being implemented by a team led by Euro-consult Mott MacDonald. The project is financed by the GoB, KfW and the ADB.

Aim of the SRIIP implementation is to reduce poverty and raise incomes in three divisions and 21 districts of north-west and south-west Bangladesh by economic capacity development.

The SRIIP aimed at upgrading 678 km of roads, 173 km union roads, cross drainage structures, such as bridges and culverts with a total length of 4500 meters, 88 growth centers/ markets improvement and construction of 36 bridges. The project will further implement 3-Pilot Performance based road maintenance and management system contracts, 3- Pilot Renewable Energy System in 3-markets and 3- Pilot Rural Water Supply System in 3-Markets in 3-Project Divisions.

The subprojects under implementation went through the process of meeting the selection criteria (general and technical), and also considered environmental and social safeguard screening of the proposed infrastructures

The scope of land acquisition and resettlement is identified based on subproject selection and field visits to each subproject. Detail designs of the proposed infrastructures considered reduced land acquisition and resettlement impacts. However as per detail design, until now a total of 8.2432 acres private land acquisition iwere required for the construction/improvement of bridge and road in nine districts of the project location .The districts are , Narail, Naogaon, Rajshahi, Chapai Nawabganj, Dinajpur, Bogra, Chuadanga and Gaibandha .

A resettlement framework prepared for the project and preparation of Resettlement plans for each sub- project affected, has been completed and submitted to PMO intermittently during the period from August 2015 to June 2016. . For preparation the RPs, detailed survey and Census have been conducted in the affected locations.

The Market Survey for determining the loss of property and livelihood has been done. .A Property Valuation Assistance Committee has been formed s to conduct assessment of market price of the assets once the office-order from the MoLGRD&C is received

Grievance Redress Committees (GRCs) have been e formed to provide support to the affected people and community at the Upazila level, District Level and Project Management Office (PMO) after receiving office- order from the MoLGRD&C. After that the budget for RP implementation will be assessed to pay the compensation.

1. Introduction

This semi annual report presents status of land acquisition and other project impacts during the SRIIP implementation period (from January 2016 - June 2016) on social and resettlement issues of the “Sustainable Rural Infrastructure Improvement Project (SRIIP) Design and Supervision Consultancy” executed by the Local Government Engineering Department (LGED) and being implemented by a team led by Euro-consult Mott MacDonald. The project is financed by the GoB, KfW and the ADB.

1.1 Project Background

With an aim to reducing rural poverty and raise incomes through economic capacity development in 21 districts of three divisions and located in the northwest and southwest Bangladesh SRIIP has been initiated by LGED. The project goal is to enhance rural people’s access to social services, such as health and education, and to economic opportunities. By augmenting people’s access to market facilities and livelihood activities, it is expected that consequently SRIIP on implementation will, generate better earning opportunities for the rural poor in general and women community in particular.

Project Components After the approval of 2nd DPP

The SRIIP includes the following components:

i) Improved Rural Roads

The SRIIP has undertaken upgrading 678 km of Upazila roads, 173 km union roads to bitumen surfaced standard so as to provide round the year connectivity between agricultural production areas and Growth Centre Markets (GCMs) with other areas of the country. Also under SRIIP, cross drainage structures such as bridges and culverts with a total length of 4500 meters have been taken up along with rehabilitation and construction of 36 Bridges. The project also will improve existing earthen; Herring bone Bond roads and the bituminous section which needs to be reconstructed.

ii) Improved Rural Market Infrastructure

A total of 88 growth centres / markets shall be improved under the project period of the SRIIP . The project will further implement 3- Pilot Renewable Energy System in 3-markets and 3-Pilot Rural Water Supply System in 3-Markets in 3-Project Divisions under SRIIP.

iii) Improved Rural Infrastructure Management

a. LGED Capacity Building

The project is also providing training to LGED staffs in contract management, financial management, participatory methods, construction supervision of climate resilient infrastructure, quality control,

b. Local Governance

In order to enhance the local governance of the Local Government Institutions (LGIs), the project has been providing various trainings and awareness programs for officials of LGIs. in 141 of 21 selected districts in three divisions viz. Rajshahi, Rangpur and . The program includes training of the LGI officials including selected UP chairmen, members, Upazila officials, district LGED officials on their role and responsibilities, gender, financial and resource management, people’s participation and open budgeting system etc.

c. Incentive based Infrastructure

US$ 1 million has been allocated to infrastructure investments in 20 unions that satisfy a set of performance standards related to women’s participation in governance, including governance of infrastructure.

d. Climate Change Resilient Rural Infrastructure Management

Under SRIIP program 851 km of rural roads have been undertaken for improvement to pavement roads, training on road asset management, and capacity development and road safety measures. The climate change adaptation activities integrated in the project shall strengthen overall objectives of the project by providing protective measures for the infrastructure and by streamlining adaptation measures for future investment.

e. Sustainable Roads Maintenance System

As a part of Sustainable Roads Maintenance System, the SRIIP has undertaken 3-Pilot Road Maintenance and Management System Contracts in 3-Project Divisions of SRIIP..

iv) Support for Project Management

A combination of International and national consultants in 2-teams namely i) Design and Supervision Consultancy team led by Euroconsult, Mott MacDonald of the Netherlands and ii) Institutional Support and Monitoring Consultancy Team led by Hifab International AB of Sweden is assisting the Project Management Office of SRIIP for successful implementation of the Project.

The SRIIP subprojects now under implementation had gone through the process of meeting the selection criteria (general and technical). Environmental and social safeguard screening of the proposed infrastructures considered: (i) locating components on government-owned land and/or within existing right-of-way (ROW) to reduce acquisition of land, (ii) prioritizing rehabilitation over new construction; (iii) taking all possible measures in design and selection of sites to avoid resettlement impacts; (iv) avoiding where possible locations that will result in destruction/disturbance to historical and cultural places/values; (v) avoiding felling of trees where possible; and (vi) ensuring all planning and design interventions and decisions are made in consultation with local communities and reflecting inputs from public consultation and disclosure for site selection.

Based on the current assessment of subproject design and location, all the projects of the SRIIP under implementation have been assessed as ‘B’ category.

1.2 Land Acquisition and Other impacts.

1. The scope of land acquisition and resettlement is identified based on subproject selection and field visits to each subproject .Detail designs of the proposed infrastructures considered the following to reduce land acquisition and resettlement impacts: (i) locating components on government-owned land and/or within existing right of way (ROW), (ii) prioritizing rehabilitation over new construction, (iii) avoiding where possible locations that will result in destruction/disturbance to historical and cultural places/values, (iv) avoiding tree-cutting where possible; and (v) ensuring all planning and design interventions and decisions are made in consultation with local communities and reflecting inputs from public consultation and disclosure for site selection.

2. As per detailed design, a total area of 8.7332 acres of private lands has been estimated to be acquired for the construction/improvement of bridge/roads at the project locations in 9 districts. The districts are Chapainawabganj, Rajshahi, Jessore, Naogaon, Narail, Dijanpur, Bogra, Chuadanga and Gaibandha. Lands to be acquired for the implementation of different projects in the above 9 districts have already been identified and at 4 project sites located at Chapainawabganj, Jessore, Naoigaion, and Narail lands have already been acquisitioned and compensation payment to the PAPs is comopleted. In implementing road development project at Bagmara, Rajshahi, no compensation had to be paid to the PAPs because they donated the land in favour of a local primary school to save the school playground through which the original plan of the road was designed. In other three subprojects viz, at Dinajpur, Bogra and Chuadanadga, land to be acquired have been identified and acquired. Payment of compernsation money to PAPs is in the process. In Gaibandha, land required for the project implementation have been identified by the lGED, and proposal for the acquisition has been sent to the PMO office.. A Joint Verification Team has been formed to verfy the land and its value . Brief description of the 9 sub-project areas is presented below:

1. Road Improvement under Contract No: LGED/SRIIP/NWB/W-182: A total of 2.99 acres of private lands were acquired for the development of road from Daldali Union to Baragachi GC via Krishnapur UP office at Bholahat Upazila, Chapainawabganj District.

2. Improvement of Road under Contract No: LGED/SRIIP/RJS/W-263: A total of 0.49 acre of private land acquisitioned for the development of road from Hatgangapara to Keshorhat (Up to Khalgram) at Bagmara Upazila of . (No compensation is required. Settled locally. Ownesrs donated the land to the school for saving the play ground by diverting the alignment of proposed LGED road through school playground)

3. Bridge construction under Contract No: LGED/SRIIP/JSR/WS-134 & 135 : A total of 1.6017 acres private land were acquired to construct 90m Long Pre-Stressed Girder Bridge over on RHD at Datta Rasta - Narikelbari GC via Chaibaria & Agra Uttarpara and construction of 42 m Long RCC Girder bridge over Dhalgram Boro Khal on RHD at Datta Rasta under Bagharpara Upazila, .

4. Bridge construction under Contract No LGED/SRIIP/NRL/WS-176 :At total of 0.7725 acre private land was acquired to construct 90.00m Long RCC (Pre-Stressed) Girder Bridge over Kajila Khal River on the road Gabtala R&H to Maizpara GC road in , .

5. Bridge construction under Contract No LGED/SRIIP/NAO/WS-173: A total of 0.48 acre private land was acquisitioned for the construction of 150.00m RCC(Pre-Stressed) Girder Bridge over Kumarpur R&H Parshombari Hat-Nandahar-Kola GC Road in Badalgachi Upazila, Noagaon district.

6. Development fo Approach road under Contarct No : LGED/SRIIP/DNJU/WS-179: A total of 1.01 acres of private land has to be acquired for the development of approach road on both sides of the 90 meter long Pre-Stressed Girder Bridge on Punarvaba River under Birol Upazial of Dinajpur District

7. Bridge construction under Contract No: LGED/SRIIP/BGR/WS-201: A total of 0.48 acre of private land is to be acquired for the construction of 75 meter RCC Girder Bridge over Ichamati River(Mara Bnagali River) on Goshaibari GC-Sonahat GCF Road under Dhunat Upazila of Bogra District.

8. Development of Approach road under Contract No: LGED/SRIIP/CHU/WS-195: A total of 0.1190 acre of private land is to be acquired for the development of approach road for 90 meter long under construction Girder Bridge over Mathabhanga River at Munshiganj GC, Poshurhat pouin under Alamdanga Upaqzila of Chuadanga District.

9. Development of Approach road under Contract No: LGED/SRIP/GBD/W-. A total of o.790 acre of land has to be acquired for the development of approach road for 75 meter Girder Bridge over Feskatair khal on Saghata CC- Mahimaganj GC Road.

1.3 Resettlement Plan and implementation

Resettlement plans for each sub-project has already been submitted to PMO. Detailed census survey of the affected households have been conducted in the aforesaid subproject areas (Annexure 1 shows Census Survey Results) prior to preparing the resettlement plans.

The Market Survey for determining the loss of property and livelihood is completed in all the aforesaid projects. A Property Valuation Assistance Team has assessed the market price of the assets (Annexure 3 shows the Questionnaire)

GRC committees have been formed for each of the subprojects and are providing supports to the affected people and community at the Upazila level. 1.4 Information Disclosure, Consultation, and Participation

Stakeholders’ consultations: As a part of the study, detail consultations had been carried out with key stakeholders, including persons interested or affected by project activities in line ADB requirements. For gathering information, dissemination and feedback, information were gathered from the local residents, service user groups, and the people who were likely to be affected by intervention of sub-projects. The issues discussed with the PAPs and other stakeholders were on the extent of involuntary resettlement, objectives and scope of the project, compensation, income restoration, employment generation and others that concern them.

The methods used for consultations were, open meetings, interviews and focus group discussions. The study participants were informed that the SRIIP will offer, compensation for land and other relevant cost , employment opportunities during construction phase , create scope for women and IPs in growth centres, manage common facilities During the period of project implementation, any disruption or damages caused by the contractor to compound walls, existing connections etc. would be repaired.

Information Disclosure

For ensuring maximum transparency in planning and further active involvement of displaced persons and other stakeholders, project information has been disseminated through distribution of the translated versions of the resettlement planning documents in Bangla as well as in English. The information was also made available at public places including the offices of LGED, PMO, and District level and Upazila/ ward level offices.

Grievance Redress Mechanism

Grievance Redress Committees (GRC) in all the subprojects excepting in Dinajpur, Bogra and Chuadanga, where the formation of GRC is under process. have already been formed at districts level offices to ensure easy accessible by the affected persons and other stakeholders. The GRC committees will work on resolution of AP’s concerns, complaints, and grievances (if any) about the social and environmental performance at the implementation level of the project. Affected persons (APs) will have the flexibility of conveying grievances/suggestions by dropping grievance redress/suggestion forms in complaints/suggestion boxes that have already been installed by project or through telephone hotlines at accessible locations, by e-mail, by post, or by writing in a complaints register in district level offices. The safeguards officers from project management unit (PMO) will have the overall responsibility for timely grievance redresses on environmental and social safeguards issues and for registration of grievances, related disclosure, and communication with the aggrieved party. Records will be kept by PMO of all grievances received, including contact details of complainant, date the complaint was received, nature of grievance, agreed corrective actions and the date of the incident and final outcome. The number of grievances recorded and resolved and the outcomes will be displayed/disclosed in the PMO office, District / Upazila office, and on the web, as well as reported in the safeguards monitoring reports submitted to ADB on a semi-annual basis.

Property Valuation Advisory Committee It is necessary to form Property Valuation Advisory committee to provide guidance for valuation of land and structures, trees, business, income and employment. The reason is- to mitigate gaps in the given compensation levels which are always inadequate in reflecting the actual resettlement cost. Recommendations; Joint verification committee has been formed to provide guideline and RP implementation has closely been monitored to provide the PMO, SRIIP with an effective basis for assessing resettlement progress and identifying potential difficulties and problems. Monitoring has been undertaken by the D&SC and PMO. Administrative monitoring involves regular supervision to ensure that implementation is on schedule and problems are dealt with on a timely basis. For socio- economic monitoring during and after project implementation for ascertaining resettlement impacts by utilizing baseline information had been established through detailed measurement survey of APs undertaken during project preparatory stage. Semi-Annual monitoring and progress reports were prepared and submitted by D&SC at a regular interval to the concerned authority for reporting status of RP implementation. All safeguard monitoring reports are to be sent to ADB for review. ADB will post the report on website.

Conclusions:

Resettlement Plans for 5 subproject locations in two divisions namely; Rajshahi and Khulna, 3 subprojects in Rajshahi division and 1 subproject in were submitted respectively in the month of August 2015 and May 2016. The proposed sub-projects are mainly construction of bridges, and a new roads. To complete RPs, a number of activities had to complete in the different sub- project locations with impact of LAR. These are: general assessment to identify size of affected private land and plot numbers, census of the affected persons (APs); consultation with the affected people and community. Details of Public Consultations, impacts, information of affected people including their identity and relevant issues are shown in Annexure -1

In addition, market survey of the affected property and losses have also been conducted. To ensure appropriate compensation to the PAPs for their incurred losses of land and other assists, current market rate and land purchase rate of the DC office will be collected. Based on the initial assessment during Resettlement Survey an indicate detail budget for compensation of losses and other cost is presented with each of the RP.(Questionnaires are shown in Annex-3)

In most of the subprojects formation of a project-specific grievance redress mechanism (GRM) was completed. Only in three specific projects viz; Dinajpur, Bogra and d Chuadanaga it is under process. While GRC receives, evaluates, and facilitates the resolution of AP’s concerns, complaints, and grievances about the social and environmental performance at the level of the project, the GRM aims to provide a time-bound and transparent mechanism to voice and resolve social and environmental concerns linked to the project.

A monitoring mechanism to follow up the process of compensation payment to affected people has been presented in RPs. The project will ensure that the properties (structure and non-structure assets) to be displaced for the project will be compensated at their full replacement cost, determined by legally constituted bodies like the Property Valuation Advisory Committee (PVAC).

Land acquisition of 2.99acres , 1.6017 acres, 0.7725 acre have already been completed and the PAPs were duly compensated by the LGED in the year 2013 & 2014 and 2015 respectively at Contract no: LGED/SRIIP/NWB/W-182, LGED/SRIIP/JSR/WS-135/, and LGED/SRIIP/NAO/WS-173 located at Upazila: Bholarhat, District: Chapai Nawabgonj,. Upazila Bagharpara Districts, Jessore and Narail Sadar, District Narail. The lands were acquired during the period from 2013 to 2015 as found in record of PMO of SRIIP. Earlier whole resettlement process could not be monitored by the D&SC due to prevailed political situation of the country at that time. However the D&SC has now collected the names of affected people with quantity of land acquired and compensation payments to APs.. The list is appended in the Annexure. In this report the land acquisition issue of the Contract no: LGED/SRIIP/NWB/W-182 has been reviewed through public consultations with the APs by the Social Safeguard Consultant of the D&SC held and result of public consultations with affected people regarding their opinion and grievances due to Land Acquisitions are reflected in Annexure 2.

Preparation of 4- RPs for 4-subprojects in the districts of Bogra, Chuadanga Dinajpur and Gaibandha has already been completed and submitted to teh PMO. Introduction:

The 90 meter bridge under construction is going to connect two districts Jessore. Land required for approach roads on two sides has been taken by LGED. Because of complications land acquisition involving different administrative units, land acquisition process especially in part is being delayed. People are agreed to allow their land for the approach roads.

Affected people of this area did not receive any notice from DC office. However, some people reported that office staff from DC office came to measure the affected land. The approach roads are almost completed. But the affected people have not yet been informed when compensation money will be handed over to them.

As reported by the community, at least three families have already moved away from the place during the road construction. The local people are not having much support from the local government. The chairman and members of Sotokhali Union are completely indifferent to their needs. They are fast losing their hopes. But during discussion they shared all their problems with the resettlement study team who went there to discuss with them on compensation issues.

When the bridge construction started, a small section of unaffected local people opposed while encouraging affected people to file legal suit against LGED it had taken their land without serving any proper notice. But the affected people could not be persuaded to follow this course for their position was like this, “We do not want to stop the bridge constriction by court order. This bridge is important for all of us.”

Motivation work conducted by the Executive Engineer of Jessore, project staff and local leaders provided moral support for bridge construction.

Some people strongly felt that it was not a right step to take control of land before giving compensation. At least, 4 to 5 families have lost their land; a few of them have already moved to another place as their houses and other structures had been broken down. 5. Land price The land price of the area rose to a higher level the construction got started. However, the price varies with location of any land. The land close to the market is much higher priced than the homestead and agriculture land. Price of fallow land continues to remain 5 to 10 thousand taka per decimal while adjacent market this same land will be sold for much higher price once construction is completed.

6 Profile of the area The majority of local people are poor. Women are mostly engaged in household work. Children go to school. All people use boat to get across the river. They hope this bridge will bring in much improvement in their communication, business and other sectors.

Introduction: The 90 meter bridge will start from Narikel Baria and end on the other part of the river in Sotokhali union. However, a number of people already provided their land for the approach roads of the bridge. People of this area are better off. They own enough land and run various businesses. A Shaha family has lost 2.75 acres of land and other families account for the rest of the land taken for the roads.

The Project Director, Executive Engineer (Jessore) and office staff, the local MP and local government representatives and DC office staff came to discuss on the bridge issues and people’s participation. However, people from DC office came to asses land and property of affected families. These families have received notices of section- 3 and section-6 from DC office on 15th January and the 6th May 2015 respectively. The affected people claimed that many trees were cut down at the time of road construction. The Upazila engineering team informed them of recording all the trees thus cut down. The team also claimed that some video recordings were done of these trees while being cut. But the affected people are not yet confirmed whether they would be properly compensated for this loss of assets. While talking on the issue the XEN (Jessore ) told that such trees were not high in number and most of them were small in size.

Introduction: The 90 meter bridge will cross the river Poradanga from North to South. The alignment of its two approach roads will impact on local people’s land, structures and trees. A number of families will lose homestead land and they have become aggrieved by the bridge. Being very poor these families are demanding proper compensation. They are not happy losing their land, for they do not have much land to depend on.

“Many people will be benefited; especially land owners as land price is increasing fast. Since we have very small amount of land this increase in land price will make any difference for us. Some boat men will lose their livelihood. Now they are helping local people to cross the river with goods. One woman, wife of a boat man said, ``At least four boat men with 25 family members depend on earning through boat. They will lose their income once the bridge will start. Some might leave the place to look for new work.’’ 3. Updated status of The community people know that land will be acquired for bridge. Introduction: The south part of the Poradanga bridge approach road is a very remote area. The proposed approach road will slightly turn where few private land and property exist. Project direction (SRIIP) and XEN (Narail) came and discussed on bridge approach road and the loss of property. The PD (SRIIP) ensured that people who would lose their land and other properties would get compensation. However, the affected people received section -1 notice from the DC office.

Key issues Major Findings 1. Now the new bridge students are crossing river by boat to attend school and college. Some people use bicycles to go school and other place by using boat. A special case on managing private land by the community

Most of the road is being constructed in the existing ROW but at one location the existing road alignment goes through the middle of a school compound. The school committee did not agree to allow construction of any road that will bifurcate the school compound creating hazardous situation for the children. Local people also sided with the school committee and they proposed that the road would go through some private land at one side of the school. The private land belongs to two brothers named Saiful and Salam. Some trees are also in their land. But two brothers were not willing to give up their land without proper compensation. Though local leaders, school committee members and other public figures tried to motivate the brothers to allow the construction but failed.

The community feels the importance of the road as the area is highly dense in population. To make the road possible they decided to mobilize a fund through local people’s participation. Once this decision was made, members of the community gave whatever one affords to give. The school committee contributed a big amount from its own fund. At a program witnessed by the local people two brothers were given Tk.80, 000. Salam got TK. 60,000 and Saiful received 20,000 taka. A signed document was made on the payment. All important people of the locality such as chairman, members, school teachers and social leaders were present in the meeting. Two brothers freed the land for construction of road. The affected people made free their land for the construction.

On the other hand land acquisition process is going on. The owners are from poor income group and they are planning to buy land in other areas and also planning to do business with the money.

Land price is now 20,000 to 50,000 taka per decimal now. According to DC office the rate is TK 20,000 taka.

Discussion with affected people in Naogoan

Sub project : Contract Package ID: LGED/SRIIP/NAO/WS-173 Choto Jamuna. Date:7.6.2015

Construction of The 90 metre bridge is on going over the river of Choto Jamuna . A total of 0.48 acre private land needs to be acquired to construct an approach road. At least six people who claimed that their land will be affected participated in the discussion meeting. They are going to lose their farm land on the side of the river. For the last nine months the bridge has been under construction. We have heard the government would acquire land for construction of bridge approach road.

However, all affected people are demanding current market price as the compensation for the loss of their land and crop. They also want to purchase another land as they are losing land. One person named Firoz who is losing majority part of the affected land mentioned “How can I survive if I lose my agriculture land? We are depending on agriculture income.” 5. Land price The affected people and some other people who live in this area claimed that land value is very high. This high price is due to the fact that the area is commercially important as, lots of shops are doing a thriving business in the market developed on the road side. The price will be increased after construction of bridge and they said per acre would be sold for 15 lac taka which will not be very realistic from the land valuation from other districts and locations.

Report on Status of Land Acquisition and compensation Process of the Sub-project” Improvement of Daldalia Union Parishad Office – Borgachi GC via Krishno pur GPS (Ch. 4+180 to 7+160m) Road under Bholahat UZ, Chapai-Nawabgonj istrict.

Road Subproject and land Acquisition

This report on the road projects under SRIIP in Chapai Nawabganj, presents the updated status on land acquisition and compensation process. The construction for road alignment on private land alignment started from Daldalia UP office. - Borgachi GC via Krishnapur GPS at Ch.(4+180-7+610) (Length 3.43 Km) and constructing on the private land .

The affected property comprises mainly of privately owned agricultural land(2.99 acre), mango trees and standing crops. Owners are from the surrounding locations. A total of 21 affected persons have been identified and many of them received compensation and few are under process.

The land acquisition process has been started in the year of 2013, acquisition all required land been completed .DC office assessed impacts on land and standing crops and mango trees of the affected area. .

Resettlement consultant and the study team from SRIIP project visited Chapai-Nawabganj, district in the month of June 2015. The team, accompanied by SRIIP’s Quality control Engineer and field engineer, and constructor, visited the project location. The team observed road construction steps and discussed with the affected people and community leaders surrounding the project area.

Based on assessment, LGED provided 48 lac taka to the DC office as compensation for the affected people. Of this amount 36 lac taka has already been disbursed so far and the rest 12 lac taka still awaits disbursement.

Summary of Findings

The study team conducted field visit on the 4th of June 2015 to perceive impacts on land crops and livelihood and also compensation process and status. .

During the field visits, extensive discussions were conducted with the affected people, and also observed the subproject location, to understand Impact of the project on the community people’s property. The SRIIP and LGED representatives were also participated in the meeting field findings also shared with the LGED XEN of, Chapai-Nawabganj district and DTL of the SRIIP project.

A large number of people including affected persons were gathered in the meeting places and shared their opinions regarding the project and compensation methods, grievance on some specific issues. A detailed discussion conducted with a number of affected people of the project location (Annex-1)

Demand for road and public support: The construction of this road started in the year of 2014; the local people consider this road project in their area as the result of their long demand and therefore they have extended their complete support and cooperation to it. People expressed their views saying this, “We demanded this road for such a long time. Now it is here fulfilling our dream; we are giving our full support for the road. Even those people losing their land, also are equally enthusiastic about it.”

At the preliminary design stage, project director of SRIIP visited the area to have a discussion with the local people. He intended to have an understanding of how they related themselves with the project; moreover he also wanted to gain their confidence in relation to land acquisition that would be needed before the project got underway. People unanimously talked about their serious hardship for want of a road and they promised their full cooperation with the project. People enthusiastically came forward to let the project people acquire their land. For them road is much more important than some patches of land.

Land Acquisition and progress: The land acquisition process got underway in the year 2013. People received notices from the DC office. Most of the people whose land needed to be acquired offered their whole support to the acquisition process. A total of 21 people are identified as affected persons. Among them 4 to 6 persons who lost their inherited land have not yet received the compensation money; List of the affected people is in Annex.

Price of the affected land: The DC office offered the compensation payment rate which was more than the market rate. People of the area admitted that affected farm lands are remotely located and their market price is much lower than the price the affected people received. So these people are satisfied with the compensation money the DC office gave them.

However, the land price scenario is fast changing. The lands on both sides of the road are much costlier than interior land. Overall land price is getting higher because of the road. Now, per decimal land is selling 3 to 4 lac taka as a result of the road not yet fully constructed

Compensation money and use pattern: A discussion has been held with a number of people on what they did with the compensation money. Most of the people used their money to purchase land in some area where land price is more cheep. Some people also invested money for business and purchasing assets. Most of the people who received compensation money were happy with the land rate offered by Dc office as because the market rate is more or less same as the rate DC office compensate to the affected people.

However at least, 4 to 6 persons have not received any compensation money yet. Reasons identified for the delay are: Lack of appropriate land documents and problems with inheritance ownership and in some cases members are not willing to share the compensation among them. Grievances: Some people claimed that their mango trees near the road side have been damaged due to construction. As these trees provide these people’s living, any damage to these trees actually lowers their incomes. When this damage has been brought to the project people’s notices, some remedial steps have been taken to minimize this damage. The Resettlement Consultant discussed with contractor who promised that he would fill up the holes of the trees immediately.

Discussion with local chairman: Discussion was also held with the Chairmen Majaharul Hoque and Joglul Hoque from Daldalia and Jambaria union respectively .They contributed in many ways to the constriction of the road; motivate those unwilling people and gave their best efforts to resolve conflicts that arose at the time of land acquisition. Besides, they also helped people in overcoming the problems get compensation from DC offices. They lobbied with both DC and UNO visiting their offices with the affected people Sharing information with XEN: Few issues have been shared with the XEN Chapai Nawabgonj regarding compensation status of the project and some unsettled grievances. At least, 6 people (individuals and as a group) claimed that they did not receive compensation. The grievance of mango tree owners originated from damages caused by contractor's people dumping earth or chunks of mud at the feet of mango trees. The XEN said that the main reason for people not having compensation was the conflict over ownership of land and this needed to be resolved by them. Besides, some people have no paper to show as an evidence for their ownership papers. However, XEN will undertake an urgent imitative to disburse rest of the compensation to the affected people. Also he will discuss with the DC office and the local people.

About damaging the mango tree roots, he said he would immediately talk to the contractor to fill up holes made to these trees for their protection.

1. Road is the most demanding This road has been a popular demand for a long time in the area. project Many a time in the past they placed their demand with the Member of Parliament (MP) elected from this constituency and also with other government officers. Getting to nearby unions people have to go through a long distance through paddy fields and other agricultural land and they walk as long as 26 to 30 km. This walking through farm land causes damage to crops. Farmers find it a daunting task to take their produces to the nearby markets. Rainy months are the hardest time, sometimes people’s movement comes to a total stop. Now, as the construction goes on, long suffering people heave a sigh of relief anticipating the busy coming days when this road will see people carrying their goods to markets day in day out. The road will connect Daldalia and Jambaria unions; they could see that about 500 people will use this road every day.

The project director happened to meet an old farmer on his way home carrying a bundle of paddy. The farmer told him how difficult it had been for an old man like him to carry paddy or mangoes from field to home. The project director

Now, per decimal land is selling 3 to 4 lac taka a result of the road not yet fully constructed Minimizing impacts Following some people’s strong opposition to the road going through their land and saving some mango groves, the road takes a number of turns; otherwise it would have been straighter. When such protests arose, local UP chairman and members and LGED people came forward to engage with the protesting people and helped the project people to find out a solution.

The initial alignment has been changed in order to keep the impacts minimum. This way many house structures could be saved. Mango groves could also be saved as these are the only source of living for their owners. In this effort to save valuable assets LGED and SRIIP people worked hand in hand with the local people.

2. Discussion held with a number of people on what they did with the compensation money.

Tofazzal: His 8,25 dec land has been acquired and he received 1 lac taka as compensation. He said the price he received was more than the amount he would receive at the local rate. In addition, he also received money for the loss of mango trees and standing crops. He is happy with the amount of money he got; a part of the compensation has been spent to buy two cows and another part spent to meet household expenses. He is happier that he could contribute for the new road.

Ikram: His 4.95 dec lands have been acquired that gave him 86 thousand taka. With that money he purchased 6.6 dec land in other area at a lower price.

Mosharaf, Md Afzal and Shahid Ali, these persons lost 29.7 dec of inherited land and received compensation for 21.45 dec and the payment for the rest of the land is delayed for its ownership is disputed. However, they also received compensation for 13 mango trees each priced 1000 taka. Till

Toharul Islam received 1 lac 16 thousand taka as compensation for his 7 decimals of land. He bought 49.5 dec lands and met some household expenses with the money. Abdus Sattar and one Chowkidar have received 6 lac taka for their 36 decimal land acquired; they also got another amount for some trees lost.

Abdur Sattar, Ashraf and Marlen: Their 36 decimal land has been acquired and they received TK. 6 lac as compensation. At least 4 to 6 persons have not received any compensation. Reasons they cited for this nonpayment are as follow: Lack of appropriate land documents and problems with inheritance ownership are some reasons for not getting compensation. Moreover, some claimed that paying bribes to DC office staff has also been a reason to get compensation money quickly.

Family members having problems over ownership of inherited land did not receive the compensation. Also members were not willing to share the compensation among them.

Ikram Hoque also did not receive due to the ownership problem.

Shadul Islam told that he and other three persons claimed ownership of a piece of land, 17 decimal in size. One of them claimed to have purchased the land but couldn’t show any documents of registration.

AP Saidur said, “We 5 people, own 17 decimal lands. Among us some could show the registration documents with their names and received the compensation but others still having documents with the names of previous owners have not yet received any compensation. They are waiting to get this problem sorted for about 6to 7 months.

3. Discussion with local Chairmen

Discussion was also held with the Chairmen Majaharul Hoque and Joglul Hoque from Daldalia and Jambaria union respectively. Both chairmen are education and have contributed in many ways to the constriction of the road; they kept in touch with those who were willing to let the project acquire their land and also tried to motivate those unwilling people. The UP chairmen of the areas gave their best efforts to resolve conflicts that arose at the time of land acquisition. Besides, they also helped people in overcoming the problems get compensation from DC offices. They lobbied with both DC and UNO visiting their offices with the affected people

However, people from Jambaria union were more supportive than those of Allodia union where there are more conflicts. More land from Daldalia union than Jambaria union has been acquired.

2. Scope Of Land Acquisition And Resettlement

Scope of Land Acquisition and Other impacts in SRIIP

Based on subproject components and field visit to each selected subproject, the scope of land acquisition and resettlement has been determined. .In preparing detail designs of the proposed infrastructures in each subproject, following issues have been taken into account to reduce land acquisition and resettlement impacts: (i) locating structures/installations /trees/other components on government owned (Khas) land and/or within existing Right of Way (ROW), (ii) prioritizing rehabilitation in new construction sites, (iii) avoiding where possible locations that will result in destruction/disturbance to historical and cultural places/values, (iv) avoiding felling of trees where possible; and (v) ensuring all planning and design interventions and decisions are made in consultation with local communities and reflecting inputs from public consultation and disclosure for site selection.

Proposed Land for Acquisition at Birol Dinajpur As per detailed design, a total of 1.01 acres privately owned crop land will be needed to acquire for the construction of Bridge/approach road at the project locations in Birol Upazial of Dinajpur district.. The land required for the project has been identified and land acquisition process is the process. A brief description of the sub-project area is presented below.

 Construction of Approach Road on both sides of the proposed 90 meter long pre- stressed Girder Bridge under Contract No: LGED/SRIIP/DNJ//WS-179: A total of 1.01 acres privately owned crop land will have to be acquired for the construction of approach road on both sides of the under construction 90 m Long Pre-Stressed Girder Bridge over Punarvaba River at 2110m Chainage on Kashidanga GC to Ramnagar Bazar via Ziatali Ghat road at Birol Upazila of Dinajpur district.

3. Objectives Of The Resettlement Plan

The objectives of this RAP is to: (i) Describe the scope and extent of land acquisition for the construction of approach road of 90 meter RCC Girder Bridge, under SRIIP at 2110mt chainage on Kashidanga GC to Ramnagar Bazar via Ziatali Ghat road in Birol Upazila .in Dinajpur District. (II) Involuntary resettlement impacts as a consequence of identified project components implementation, and (III) address them through appropriate recommendations and mitigation measures in the RAP and (IV) present an indicative budget for resettlement cost. Besides, this RAP also has highlighted about institutional arrangements and implementation responsibilities.

This RAP is prepared based on Acquisition and Requisition of Immovable Property Ordinance, 1982 (ARIPO), Government of Bangladesh’s and ADB SPS, 2009 requirements for IR in category B projects.

The plan is to be implemented prior to the subproject construction and LGED will ensure that compensation is distributed to the affected people according to the policy guideline..

4. Land Acquisition And Resettlement Impact

Updated status of Land Acquisition

All relevant process for land acquisition is underway. A series of meetings have been conducted with the representatives of DC and LGED office on land acquisition and compensation issues.

A Census of affected households and assets using the form in Appendix 4 was done to identify entitled and non-entitled persons, vulnerable APs, inventory and detailed measurement of all affected assets (land and non-land) and remaining fixed assets of APs.

Results of the census were analyzed to determine estimated cost of IR impacts and establish the resettlement database to be used during project implementation.

Resettlement Impacts

The potential IR impacts of the aforesaid subproject at Birol, Dinajpur is prepared on the basis of the detailed designs that were done prior to the sub project implementation. However, the project will only have impact on privately owned and permanently leased in khas crop lands from the Government producing three crops a year, in the subproject location.

Approach Road Construction: Construction of approach roads on both sides of the bridge will affect privately owned and leased in khas crop lands. As mentioned above the total land to be acquired for the approach road of the aforesaid bridge is 1.01 acres. Of the total impacted land 0.76 acre is presently owned by 4 extended families and 0.25 acre is Govt. Khas land that was permanently leased out by the Deputy Commissioner Dinajpur on behalf of the Government of the then prior to independence of Bangladesh to one of the PAPs. Process for land acquisition has already been initiated and affected people have received notice (section -6) from DC office. Location of IR impact is shown in Table-4. All notices from DC office are in Appendix-5

In the absence of both national and regional benchmark of below poverty level (BPL), this project uses the upper poverty line at Tk.1,870.60/capita/month to determine vulnerable households. This is calculated from 2010 upper poverty line determined by Bangladesh Bureau of Statistic with inflation rate added. **** The eligibility will follow the Department of Social Service of Ministry of Social Welfare that uses 65 years old for man and 62 years old for woman to define elderly people.

Though a part of the lands to be Acquisitioned for the project is owned by a female named Rahima Khatun but she is not the household head. As such no female headed households will be affected due to implementation of the aforesaid project. The total 1.01 acres of land that will be acquired for the approach road construction over Punarvab River at Birol, Dinajpur are recorded in 8 Khatiyans as mentioned in the table 3 and 4 above and covered in 10 SA Line(Dag) no The lands are recorded in the name of multiple people. But meanwhile, 2 landowners had already sold out their land to three persons. Details are presented in Table…below.

As part of the assignment, a Gender Action Plan (GAP) has also been prepared for SRIIP to ensure gender equality and social inclusion. The GAP is prepared particularly for SRIIP projects to ensure and encourage active participation of women in (i) project disclosure meeting and FGDs; (ii) decision making capacity in LGED, (iii) increasing women-friendly service delivery including the poor and the marginalized, and (iv) Designing and implementing women-friendly infrastructure especially for the proposed growth centers under SRIIP.

No indigenous people/, ethnic, cultural or economically marginalized groups/ communities are located in this specific sub-project location at Birol, Dinajpur District. This has been verified through a number of ways. The resettlement consultant of SRIIP had in-depth consultation with the community people. The engineering team of SRIIP and LGED closely monitored and observed the locality during the detailed design and construction phase to verify the information. The engineering team of SRIIP and LGED assessed the probable impacts and would continue monitoring during the construction phase.

Profile of Affected Persons

The impact inventory and survey were undertaken among the PAPs of the Birolt project in Dinajpur and it revealed the following facts:

 None of the affected families is a BPL  There is no female headed household. among the PAPS but out of 4 land owners whose lands will be acquisitioned for the aforesaid project , 1 is female and house makers..  No affected families have to be relocated.  No temporary income loss of any PAP from business temporary or Permanent.  Land acquisition will affect 1 year crop loss for the PAPs.

Introduction

The 90 meter bridge over the river Punarvaba at Birol Upazila in Dinajpur district has been under construction for the last one year. Construction of the proposed approach roads on both sides of the aforesaid bridge on Punarvaba river will go through privately owned crop lands and a portion of Government khas land permanently leases in by one of the PAP from the Deputy Commissioner of Dinajpur prior to `1971. The construction of part of approach road has been partially started but the land acquisition process is yet to be completed. In total 1.01 acres of privately owned crop land will be acquisitioned located on both sides of the proposed approach road to the bridge .Process of land acquisition for the project is underway and section-3 notice has been served to the land owner from the DC office.

Key issues Major Findings 1. Perception of the Owners of the lands that will be acquisitioned for the approach road of local people about under construction Bridge over Punarvaba River at Birol, Dinajpur did not the new bridge show any grievance during consultation meeting. They opined that since this project is being implemented aiming at improving communication for general mass, they will not raise any objection about theland acquisition. Project Affected persons showed their willingness to give away their portion of land with conditions that the compensation money should be paid to them as per current market price, and without any procedural hassle. One PAP has demanded compensation for 12 small sized mahogany trees that need to be chopped down for the construction of the approach road. In fact the civil contractor of the Bridge has already established site office on the land proposed to be acquired for the project. The only assurance that the PAPs wanted was the compensation money be paid to them as per current market price and the PAPs expect that they will get the compensation

People’s In the Public Consultation meeting, participants from all household perception about categories expressed their gratitude to LGED for taking up this project. new bridge. Undoubtedly, this bridge will bring economic changes in the project area. Marketing of agro and other products of the local population will be easier. Communication with District headquarter and Upazila headquarter will be less troublesome for the people. 5. Land Price Since the area is located in an isolated place, the price of land seemed moderate. As informed by the PAPs and Participants in the consultation meeting the present market price of land per decimal is Tk.30000, but they opined that the land price will shoot up on completion of the bridge construction. However, the PAPs indicated that they will be happy if they get the compensation as per current market price. 6. Profile of the area Land elevation is comparatively high and fertile. The area produces various crops like HYV/Boro. Local Boro. T.Aman, Potato, Pulses, Mustard and plenty of vegetables. Also the area is famous for Litchi that the farmers produce, and are being exported to other parts of the country. Construction of the Bridge will definitely help the local farmers a hassle free marketing for their products.

No meeting was possible to hold with the Executive Engineer or other officials of LGED because of their pre-occupation in training during the field visit of the Resettlement Specialist. The 75 meter bridge over the river Ichamati, in Dhnat, Bogra has been under construction for the last one year. The part of the bridge and the approach road on both sides of the river is partially located on the land to be acquisitioned and some part is on the ROW. The construction of other part of approach road has been partially started but the land acquisition process has is yet to be completed. In total 0.48 acre of privately owned crop land, will be acquisitioned located on both sides of the proposed approach road to the bridge .Acquisition of these plots has been underway and section-3 notice has been served to the land owner from the DC office.

Key issues Major Findings 1. Perception of the Owners of the lands that will be acquisitioned for the approach road of the local people about under construction Bridge over Ichamati River (Mara Bangali) did not show the new bridge any grievance during consultation meeting,, rather, they exspressed their willingness to give away their portion of land with conditions that the compensation money should be paid to them as per current market price,

Profile of the area As part of the Barind Tract, the area is comparatively higher in elevation. The land is fertile and produces various crops like HYV/Boro. Local Boro. T.Aman, Potato, Pulses, Banana, Mustard and plenty of vegetables. Potato, Banana, Mustard and some food crops that the farmers produce, are also being export to other parts of the country form this area. Construction of the Bridge will definitely help the farmers hassle free marketing of their products.

For building the approach road on southern side of the river 15.78 decimal privately owned crop lands producing Beatle leaf are to be acquisitioned and for northern approach road no land acquisition will be required since that part faqlls on the exiting ROW. The construction of approach road has been partially started but the land acquisition process has is yet to be completed. .Acquisition of the plots to be acquired on the southern side of the River has been underway and section-3 notice has been served to the land owner from the DC office.

Key issues Major Findings 1. Perception of the Owners of the lands that will be acquisitioned for the approach road of the local people about under construction Bridge over Mathabhanga i River did not show any the new bridge grievance during consultation meeting,, rather, they showed their willingness to give away their portion of land with no conditions. Even all the PAPs assured to give away more lands if needed for the construction of the Bridge.

PAPs sated that it is well and good if the government gives them compensation for their land to be acquisitioned for the approach road of the Bridge over River Mathabhanga, but at the same time they informed that it is more important to have the bridge for the locality and themselves. The affected people were informed about the bridge construction by the Government. People and local UP chairman and members who visited the location several times. DC office staff visited the location to measure land and structure. People have received the section -3 notice and the process of acquisition of land and properties is going on. 2. Introduction

The 90 meter bridge over the river Mathabhanga at Alamdanga, Chuadanga has been under construction for the last one year. For building the approach road on southern side of the river 15.78 decimal privately owned crop lands producing Beatle leaf are to be acquisitioned and for northern approach road no land acquisition will be required since that part faqlls on the exiting ROW. The construction of approach road has been partially started but the land acquisition process has is yet to be completed. .Acquisition of the plots to be acquired on the southern side of the River has been underway and section-3 notice has been served to the land owner from the DC office.

Key issues Major Findings 1. Perception of the Owners of the lands that will be acquisitioned for the approach road of the local people about under construction Bridge over Mathabhanga i River did not show any the new bridge grievance during consultation meeting,, rather, they showed their willingness to give away their portion of land with no conditions. Even all the PAPs assured to give away more lands if needed for the construction of the Bridge.

People of the locality in general are happy that LGED has taken up this project to ease communication for the project population. PAPs have no objection or grievance about land acquisition and narrated their willingness to handover the land to the project authority and in fact the PAPS already have cleared the portion of land that will be needed for the approach road and handed over the same to the contractor at site. Civil contractor of the Bridge has already established site office on the Northern bank of the River. PAPs sated that it is well and good if the government gives them compensation for their land to be acquisitioned for the approach road of the Bridge over River Mathabhanga, but at the same time they informed that it is more important to have the bridge for the locality and themselves. The affected people were informed about the bridge construction by the Government. People and local UP chairman and members who visited the location several times. DC office staff visited the location to measure land and structure. People have received the section -3 notice and the process of acquisition of land and properties is going on. 2. The loss of the A total of Four (4) families are to lose crop lands totaling 15.78 decimal affected families producing Beatle leaf only. . Of these 4 farm households 3 belonged to the large farm category and the rest one belonged to medium farm household. However, the land price as reported by the participants in the consultation meeting is Tk. 26000 per decimal. The PAPs expect that the Government will pay compensation at market price. 3. Meeting with Executive Engineer, Chuadanga, LGED. A meeting was held with the Executive Engineer Chuadanga to share information gathered from the public consultation meeting at project site and exchanged views on land acquisition. The meeting was attended by the Executive Engineer himself. Since, there is no problem with regard to land acquisition, he is hopeful about the completion of the project work in time without any hassle. The Executive Engineer of Chuadanga informed that land acquisition process is in the process, and will be finalized soon.

Public Consultation Meeting at Saghata, Gaibandah Conducted

During the field visit to the project area at Saghata, Gaibandha in the month of June 2016, one (1) consultation meeting was held. In all there were ten participants (21) in the meeting. Among the participants 14 were PAPs whoe land will be acquired for the project implementation and the rest 7 were locals. Discussions were held with the project affected persons, some local habitants and a few community leaders, representatives of local government and LGED officials. The LGED representatives worked closely with the resettlement consultants in identifying affected areas and APs. Details of the discussions are noted under the section on public consultation .List of the APs is given in Project components and its benefits, impacts and resettlement issues were discussed and opinions exchanged with the community and APs. All of the participants in the discussions along with the affected persons expressed that they should get the compensation as per current market rate for the loss of their crop lands and without any procedural hassle. No AP had any negative attitude about land acquisition and narrated their willingness to handover the land to the Government for the construction of the Bridge. The above information were later shared with the Executive Engineer of LGED Gaibandha and other officials. Introduction

The 75 meter RCC Girder Bridge over the Feskatair Khal at Saghata l Upazila of has been under construction for the last one year. Construction of the proposed approach roads on both sides of the aforesaid bridge on Feskatair Khal will go through privately owned crop lands and a portion of homestead land of the PAP with a housing structure of 800 sft. The construction of approach road will block part of the existing ROW on the north western part and as an alternative LGED has proposed for a parallel pass to keep the road communicable. In total 0.790 acre of privately owned crop and homestead land will be acquisitioned located on both sides of the proposed approach road to the bridge .LGED has sent proposal for Land acqyisition to the PMO office for necessary action. It is expected that soon the process of land acquisition will start. LGED has already sutrveyed the land that will be need and wuill send the official request to the DC f, Gaibandha for taking necessary measure for acquiring land for the project. On 22.3.3016 in a meeting all the committees related to land acquisition were formed by the LGED.

Key issues Major Findings 1. Perception of the Project Affected Persons whose lands will be acquired for the local people about implementation of a 75 meter RCC Girder Bridge over Feskatair Kahla in the new bridge Chandanpath Village of Balua Mouza in Saghat expressed their positive view about the Bridge construction. They agree to surrender their lands for the greater benefit of the locality and themselves. Non of the PAPs expressed any grievance against land acquisition during consultation meeting. They opined that since this project is being implemented aiming at improving communication for general mass, they will not raise any objection about the land acquisition. Project Affected persons showed their willingness to give away their portion of land with conditions that the compensation money should be paid to them as per current market price, and without any procedural hassle. In fact the construction of the bridge has already been started and nearly one quarter of the work is already completed. Civil contractor of the Bridge has established his office on the land proposed to be acquired for the project. The only assurance that the PAPs wanted was the compensation money be paid to them as per current market price and the PAPs expect that they will get the compensation money within shortest possible time with no procedural hassle. Construction of the Bridge will definitely help the local farmers a hassle free marketing for their products in different GCs including in the District headquarter.

Meeting with Executive Engineer, Gaibandha r, LGED. A meeting was held with the Executive Engineer and other officials of LGED during the field visit of the Resettlement Consultant. Executive Engineer informed that the completion of the project, will reduce the distance of Gobindaganj and Mohimaganj with Saghata to a great extent. Marketing of crops will be easier for the project area population to outside markets in adjacent Upazials.As well, in particular, Sugar cane produced in the area could be carried to the Mahimaganj Sugar Mill at a lesser expense.
