John Adams, Alexander Hamilton, and the Quasi-War with France David Loudon General University Honors Professor Robert Griffith, Faculty Advisor American University, Spring 2010 1 John Adams, Alexander Hamilton, and the Quasi-War with France Abstract This paper examines the split of the Federalist Party and subsequent election defeat in 1800 through the views of John Adams and Alexander Hamilton on the Quasi-War with France. More specifically, I will be focusing on what caused their split on the French issue. I argue that the main source of conflict between the two men was ideological differences on parties in contemporary American politics. While Adams believed that there were two parties in America and his job was to remain independent of both, Hamilton saw only one party (the Republicans), and believed that it was the goal of all “real” Americans to do whatever was needed to defeat that faction. This ideological difference between the two men resulted in their personal disdain for one another and eventually their split on the French issue. Introduction National politics in the early American republic was a very uncertain venture. The founding fathers had no historical precedents to rely upon. The kind of government created in the American constitution had never been attempted in the Western World; it was a piecemeal system designed in many ways more to gain individual state approval than for practical implementation. Furthermore, while the fathers knew they wanted opposition within their political system, they rejected political parties as evil and dangerous to the public good. This tension between the belief in opposition and the rejection of party sentiment led to confusion and high tensions during the early American republic. -

PART I: THE AmERICAN EXPERIENCE WITH DIPLOMACY AND MILITARY RESTRAINT i. Orphaned Diplomats: The American Struggle to Match Diplomacy with Power Jeremi Suri E. Gordon Fox Professor of History and Director, European Union Center of Excellence, University of Wisconsin, Madison Benjamin Franklin spent the American Revolution in Paris. He had helped to draft the Declaration of Independence in the summer of 1776, one of the most radical documents of the eighteenth century—sparking rebellion on both sides of the Atlantic Ocean. Serving as a representative for the Continental Congress in France during the next decade, Franklin became a celebrity. He was the enlightened idealist from the frontier, the man of principled action who enthralled onlookers in the rigid European class societies of the 1770s and ’80s. Franklin embodied the American critique of Old World society, economy, and diplomacy. He was one of many American revolutionaries to take aim at the degenerate world of powdered wigs, fancy uniforms, and silver-service dinners where the great men of Europe decided the fate of distant societies. Franklin was a representative of the enduring American urge to replace the diplomacy of aristocrats with the openness and freedom of democrats.1 Despite his radical criticisms of aristocracy, Franklin was also a prominent participant in Parisian salons. To the consternation of John Adams and John Jay, he dined most evenings with the most conservative elements of French high society. Unlike Adams, he did not refuse to dress the part. For all his frontiers- man claims, Franklin relished high-society silver-service meals, especially if generous portions of wine were available for the guests. -

THE PACIFIC GUANO ISLANDS: THE STIRRING OF AMERICAN EMPIRE IN THE PACIFIC OCEAN Dan O’Donnell Stafford Heights, Queensland, Australia The Pacific guano trade, a “curious episode” among United States over- seas ventures in the nineteenth century,1 saw exclusive American rights proclaimed over three scores of scattered Pacific islands, with the claims legitimized by a formal act of Congress. The United States Guano Act of 18 August 1856 guaranteed to enterprising American guano traders the full weight and authority of the United States government, while every other power was denied access to the deposits of rich fertilizer.2 While the act specifically declared that the United States was not obliged to “retain possession of the islands” once they were stripped of guano, some with strategic and commercial potential apart from the riches of centuries of bird droppings have been retained to this day. Of critical importance in the Guano Act, from the viewpoint of exclusive or sovereign rights, was the clause empowering the president to “employ the land and naval forces of the United States” to protect American rights. Another clause declared that the “introduction of guano from such islands, rocks or keys shall be regulated as in the coastal trade between different parts of the United States, and the same laws shall govern the vessels concerned therein.” The real significance of this clause lay in the monopoly afforded American vessels in the carry- ing trade. “Foreign vessels must, of course, be excluded and the privi- lege confined to the duly documented vessels of the United States,” the act stated. -

Our school pro- grams actively engage students in their own exciting and enriching learning process. We hope that stu- dents participating in this program will come to realize that communication, cooperation, sacrifice, and determination are necessary components in seeking justice and liberty. The American Revolution was one of the most daring popular movements in modern history. The Colonists were challenging one of the most powerful nations in the world. The Colonists had to decide whether to join other Patriots in the movement for independence or remain loyal to the King. It became a necessity for those that supported independence to find ways to help America win its war with Great Britain. To make the experiment of representative government work it was up to each citi- zen to determine the guiding principles for the new nation and communicate these beliefs to those chosen to speak for them at the Continental Congress. Those chosen to serve in the fledgling govern- ment had to use great statesmanship to follow the directions of those they represented while still find- ing common ground to unify the disparate colonies in a time of crisis. This symbiotic relationship between the people and those who represented them was perhaps best described by John Adams in a letter that he wrote from the Continental Congress to Abigail in 1774. -

DANIEL J. HESSEL Founding-Era Jus Ad Bellum and the Domestic Law of Treaty Withdrawal ABSTRACT. The Constitution provides no textual guidance for how, as a matter of domestic law, the United States can withdraw from an Article II treaty. The Supreme Court has not clarified matters. In the face of this uncertainty, government officials and scholars alike have long debated whether the President may unilaterally withdraw from a treaty or whether Congress has a role to play. This Note contributes to the debate by examining the relationship between treaty withdrawal and war powers through an originalist lens. Through close assessment of the contemporaneous jus ad bellum, the Note concludes that, at the Founding, treaty withdrawal presented a clear justification for war. Treaty withdrawal therefore implicates the War Powers Clause, which assigns primary responsibility for initiating war to Congress. Because the Founders and their contemporaries likely saw treaty withdrawal as a matter of war and peace, and because the Constitution entrusts Congress with the power to commence war, this Note concludes that the original understanding of the Constitution supports a role for Congress in treaty withdrawal. Federalists and Republicans 1789–1816 Why It Matters In the first government under the Constitution, important new institutions included the cabinet, a system of federal courts, and a national bank. Political parties gradually developed from the different views of citizens in the Northeast, West, and South. The new government faced special challenges in foreign affairs, including the War of 1812 with Great Britain. The Impact Today During this period, fundamental policies of American government came into being. • Politicians set important precedents for the national government and for relations between the federal and state governments. For example, the idea of a presidential cabinet originated with George Washington and has been followed by every president since that time • President Washington’s caution against foreign involvement powerfully influenced American foreign policy. Finances of the new nation were precarious 1. Public debt was enormous; revenue had significantly declined 2. Worthless paper money, both state & national, was in heavy circulation. C. Foreign challenges by Britain and Spain threatened the unity of the U.S. II. President Washington's Administration A. Washington unanimously elected president by the Electoral College in 1789 – only Presidential nominee ever to be honored unanimously. 1. Many believe Congress was willing to give the presidency power due to Washington's immense respectability 2.
