The Anglo-Saxon Period of English Law
THE ANGLO-SAXON PERIOD OF ENGLISH LAW We find the proper starting point for the history of English law in what are known as Anglo-Saxon times. Not only does there seem to be no proof, or evidence of the existence of any Celtic element in any appreciable measure in our law, but also, notwithstanding the fact that the Roman occupation of Britain had lasted some four hundred years when it terminated in A. D. 410, the last word of scholarship does not bring to light any trace of the law of Imperial Rome, as distinct from the precepts and traditions of the Roman Church, in the earliest Anglo- Saxon documents. That the written dooms of our kings are the purest specimen of pure Germanic law, has been the verdict of one scholar after another. Professor Maitland tells us that: "The Anglo-Saxon laws that have come down to us (and we have no reason to fear the loss of much beyond some dooms of the Mercian Offa) are best studied as members of a large Teutonic family. Those that proceed from the Kent and Wessex of the seventh century are closely related to the Continental folk-laws. Their next of kin seem to be the Lex Saxonum and the laws of the Lom- bards."1 Whatever is Roman in them is ecclesiastical, the system which in course of time was organized as the Canon law. Nor are there in England any traces of any Romani who are being suffered to live under their own law by their Teutonic rulers. -

Chapter 16 Wessex and the Reign of Edmund ii Ironside David McDermott Edmund Ironside, the eldest surviving son of Æthelred ii (‘the Unready’), is an often overlooked political figure. This results primarily from the brevity of his reign, which lasted approximately seven months, from 23 April to 30 November 1016. It could also be said that Edmund’s legacy compares unfavourably with those of his forebears. Unlike other Anglo-Saxon Kings of England whose lon- ger reigns and periods of uninterrupted peace gave them opportunities to leg- islate, renovate the currency or reform the Church, Edmund’s brief rule was dominated by the need to quell initial domestic opposition to his rule, and prevent a determined foreign adversary seizing the throne. Edmund conduct- ed his kingship under demanding circumstances and for his resolute, indefati- gable and mostly successful resistance to Cnut, his career deserves to be dis- cussed and his successes acknowledged. Before discussing the importance of Wessex for Edmund Ironside, it is con- structive, at this stage, to clarify what is meant by ‘Wessex’. It is also fitting to use the definition of the region provided by Barbara Yorke. The core shires of Wessex may be reliably regarded as Devon, Somerset, Dorset, Wiltshire, Berk- shire and Hampshire (including the Isle of Wight).1 Following the victory of the West Saxon King Ecgbert at the battle of Ellendun (Wroughton, Wilts.) in 835, the borders of Wessex expanded, with the counties of Kent, Sussex, Surrey and Essex passing from Mercian to West Saxon control.2 Wessex was not the only region with which Edmund was associated, and nor was he the only king from the royal House of Wessex with connections to other regions. -

History 184R: Views of the Qin Instructor: Anthony Barbieri-Low Tuesdays, 9:00am-11:50 am Office: HSSB 4225 Location: HSSB 2252 Office hours: Mon. 12:00-2:00 pm [email protected] Course Description: The Qin Dynasty (221-207 BC) was the first imperial house to rule the bulk of the territory we now think of as China. The Qin established the pattern for the imperial bureaucratic state that would rule China for the next two thousand years, and its unification of the various written scripts and metal currencies of feudal China ensured the cultural and economic unification of the land as well. But the Qin Dynasty has also been disparaged by later writers for its harsh laws, its excessive labor mobilizations, the autocratic rule of its emperors, and of course, the famous “burning of the books,” one of the most notorious literary inquisitions in history. In this course, students will look at the Qin Dynasty from a wide variety of perspectives. They will come to learn how this brief period in Chinese history has been viewed by later authors and through the lens of contemporary culture. The types of material that students will read or view in this course include primary historical documents, legal codes and casebooks, legends and literature, historical essays, archaeological materials, historical fiction, movies, comic books, and video games. Course Goals: The primary purpose of this course is to train you in the research and writing of a polished historical paper. Dynamics of Disintegration: The Later Han Empire (25-220CE) & Its Northwestern Frontier Abstract As a frontier region of the Qin-Han (221BCE-220CE) empire, the northwest was a new territory to the Chinese realm. Until the Later Han (25-220CE) times, some portions of the northwestern region had only been part of imperial soil for one hundred years. Its coalescence into the Chinese empire was a product of long-term expansion and conquest, which arguably defined the egionr 's military nature. Furthermore, in the harsh natural environment of the region, only tough people could survive, and unsurprisingly, the region fostered vigorous warriors. Mixed culture and multi-ethnicity featured prominently in this highly militarized frontier society, which contrasted sharply with the imperial center that promoted unified cultural values and stood in the way of a greater degree of transregional integration. As this project shows, it was the northwesterners who went through a process of political peripheralization during the Later Han times played a harbinger role of the disintegration of the empire and eventually led to the breakdown of the early imperial system in Chinese history. -

Peasants did a set amount of work for the local lord as well as work- ing the land to support themselves and their family. If they did not work for the lord the lord could take away their land. ‘Ceorls’ peasants were free to go work for another lord if they wanted to. Slaves 10% of Anglo-Saxons were slaves. Slaves could be bought and sold, and treated more like property than people. The Normans thought that owning slaves was barbaric, but it was a normal part of Anglo-Saxon life. Thegns Thegns were local lords, there were between 4,000 and 5000 Thegns. Thegns was an important man in the local community and lived in a manor house with a separate church. Task Colour in the pie chart to represent the so- cial structure of Anglo-Saxon England. Earls Earls were the most important men after the king. The relation- ship between the king and his earls was based on loyalty. The king trusted the earl more he would give him greater re- wards. However, sometimes the earls challenged the king to get more power. The Power of the English Monarchy The king’s role was to protect his people from attack and give them laws to maintain safety and security at home. In return, the people of England owed him service. Every boy swore an oath when he reached the age of 12 to be faithful to the king. -

The King's Power Dominating Society—A Re-examination of Ancient Chinese Society Liu Zehua Abstract In terms of social formation, the most important characteristic of traditional Chinese society was how the king’s power dominated the society. Ever since the emergence of written records, we see that ancient China has had a most prominent interest group, that of the nobility and high officials, centered around the king (and later the emperor). Of all the kinds of power exerted on Chinese society, the king’s was the ultimate power. In the formation process of kingly power, a corresponding social structure was also formed. Not only did this central group include the king or emperor, the nobles, and the bureaucratic landlords, but the “feudal landlord ecosystem” which was formed within that group also shaped the whole society in a fundamental way. As a special form of economic redistribution, corruption among officials provided the soil for the growth of bureaucratic landlords. At the foundation of this entire bureaucratic web was always the king and his authority. In short, ancient Chinese society is a power-dependent structure centered on the king’s power. The major social conflict was therefore the conflict between the dictatorial king’s power and the rest of society.
