PROPOSAL: Crown reduce 1 Horse Chestnut tree by a third all round of Tree Preservation Order 15/2011.

APPLICANT: Mr Neil Lewis

REFUSED. Reason(s) for refusal:-

1 The crown reduction of the Horse Chestnut tree, safeguarded by Tree Preservation Order 15/2011, is not acceptable. The proposed crown reduction would place stress on the tree. This would increase the vulnerability of the tree to disease and pathogenic attacks and could lead to its premature death. No technical details have been submitted to justify the proposed work. At present the health and visual amenity of the tree remains high, this would be adversely affected by the proposed work. The proposal would therefore conflict with the objectives of policy EQ2 of the Harrogate District Core Strategy DPD (adopted 11th February 2009).

APPLICANT: Mr F Roberts

Part APPROVED and part REFUSED as set out below:

PART TO BE APPROVED: Reduction of T8 and T9 to provide 2m clearance as specified on Tree work application schedule BA5166

Subject to the following Conditions;

1 The works hereby permitted shall be completed within two years from the date of this decision.

2 All works shall be carried out by an appropriately experienced and qualified tree surgeon and so as to conform to British Standard 3998: 2010 Recommendations for Tree Works.

Reasons for Conditions:

1 In the interests of visual amenity.

2 In the interests of good arboricultural practice.

PART TO BE REFUSED:

Canopy remodelling of Tree T8 work set out in the application work schedule BA5166 Reasons for refusal:

1 The canopy remodelling of Tree (T8) Norway Maple of Tree Preservation Order 39/2006, is not acceptable as there is insufficient information to assess the outcome of such pruning which could lead to an unacceptable outcome on the health and longevity and appearance of the tree. The proposal is therefore contrary to saved policy HD13 of the Harrogate District Local Plan and policy EQ2 of the Core Strategy DPD (adopted 11th February 2009).

1 The justification provided in favour of deleting the condition does not outweigh the material planning considerations that led to its imposition, which were that without the accreditation the development would fail to minimise the impact upon the environment, which is central to the economic, social and environmental dimensions of sustainable development. It is considered that the removal of the condition would therefore be contrary to the National Planning Policy Framework which seeks to encourage sustainable development and Core Strategy Policy EQ1.

Before carrying out any excavation, trial holes must be dug to find the exact position of gas pipes, using recognised and agreed safe hand digging techniques. No works shall take place within 3 metres either side of the pipeline without the prior approval of the pipeline operator.

Prior to work commencing within the easement of a National High Pressure gas pipeline written permission must be obtained from National Grid. A minimum notice period of seven working days is required before commencement of work. The contact details for further information are 0800 688 588 / [email protected]

Reference should be made to the HSE Guidance Note HSG47 - 'Avoiding Danger from Underground Services' and the Linewatch manual ‘Special requirements for safe working in close proximity to high pressure pipelines’.

Due to the nature of the planning application and the presence of National Grid apparatus within the above mentioned site, the contractor should contact National Grid before any physical works are carried out to ensure our apparatus is not affected by any of your works. National Grid will also need to ensure that pipeline access is maintained during and after construction.

National Grid pipelines are normally buried to a depth of 1.1 metres or more below ground. Ground cover above the pipeline should not be reduced or increased.

If it is planned to use mechanical excavators and any other powered mechanical plant it shall not be sited or moved above the pipeline

If it is planned to carry out excavation to a depth greater than 0.3 metres, embankment or dredging works the actual position and depth of the pipeline must be established on site with a National Grid representative and a safe working method agreed prior to any work taking place in order to minimise the risk of damage and ensure the final depth of cover does not affect the integrity of the pipeline
