Dated this 24 January 2019 Director of Law & Assurance County Hall Chichester TRO/HON9015/RC WEST SUSSEX COUNTY COUNCIL (BROADBRIDGE HEATH: BROADBRIDGE WAY & BILLINGSHURST ROAD) (PROHIBITION OF DRIVING) & (20 MPH, 30MPH AND 40MPH SPEED LIMIT) ORDER 201* Statement Of Reasons For Proposing To Make The Order The County Council in exercise of their powers under the Road Traffic Regulation Act 1984, propose to make a permanent Order the effect of which will be to:- (i) introduce a 20 mph speed limit on the length of Billingshurst Road and new connector road south of Pinewood Close; and (ii) introduce a 30mph speed limit on a length of Broadbridge Way (former A264); and (iii) introduce a 40mph speed limit on lengths of Broadbridge Way, the A281 and Five Oaks Road; and (iv) prohibit vehicles from driving onto Billingshurst Road from the Newbridge roundabout junction As part of the development of land south of Broadbridge Heath a number of highway infrastructure improvements were approved through planning. Alterations to the Newbridge roundabout junction will include removal of the Billingshurst Road arm. This will be achieved by kerb realignment and creation of new highway verge that vehicles will be prohibited from driving over. A new connector road is being constructed that will link Billingshurst Road to Broadbridge Way via a new junction east of the roundabout. It is proposed that the section of Billingshurst Road south of Pinewood Close and the connector road will be subject to a 20mph speed limit. This speed limit is in line with the rest of Broadbridge Heath village Broadbridge Way (former A264) has been downgraded following construction of the new A264 east-west link dual carriageway and Highwood Hill grade separated junction on the A24. The road is currently de-restricted but new residential accesses and access to the Countryside Property Neighbourhood Centre and provision of a new cycleway on Wickhurst Lane requires a reduction of the speed limits. It is proposed the section of Broadbridge Way from Newbridge roundabout junction eastwards for a distance of 215 metres be subject to a 40mph speed limit. From this point to Old Wickhurst Lane will be subject to a 30mph speed limit. Then the section of Broadbridge Way from Old Wickhust Lane to Farthing Hill roundabout junction will be subject to a 40mph speed limit. A 40mph speed limit will also be introduced on Newbridge roundabout and the sections of Five Oaks Road and the A281 north and south of the roundabout junction. This Order is proposed for facilitating the safe passage of any class of traffic (including pedestrians) and to preserve or improve the amenity of the area through which the road runs. Drawings HON8030 Proposed prohibition of motor vehicles (13.12.2018) & Proposed Speed Limits (03.01.2019) show the lengths of roads which are the subject of the proposed order. Director of Law & Assurance TRO/HON8030 County Hall Chichester TRO/HON8030 WEST SUSSEX COUNTY COUNCIL (BROADBRIDGE HEATH: BROADBRIDGE WAY & BILLINGSHURST ROAD) (PROHIBITION OF DRIVING) & (RESTRICTED ROAD, 20 MPH AND 40MPH SPEED LIMIT) ORDER 201* West Sussex County Council in exercise of their powers under Sections 82 and 84 (1) (a) of the Road Traffic Regulation Act 1984 ("the Act"), and Part IV of Schedule 9 of the Act and of all other enabling powers, and after consultation with the chief officer of police in accordance with Part III and Part IV of Schedule 9 to the Act hereby make the following Order:- PART I GENERAL Commencement & Citation 1. This Order shall come into operation on the x day of x 2019 and may be cited as "West Sussex County Council (Broadbridge Heath: Broadbridge Way & Billingshurst Road) (Prohibition of Driving) & (Restricted Road, 20mph and 40mph Speed Limit) Order 201*." Interpretation 2. (1) In this Order – “pedal cycle” means a bicycle, tricycle or cycle having four or more wheels not being in any case a motor cycle; “public service vehicle” has the same meaning as in section 1 of the Public Passenger Vehicles Act 1981; “vehicle” has the same meaning as that assigned to “motor vehicle” in Section 136(1) of the Act. (2) Except where otherwise stated any reference in this Order to a numbered Article or Schedule is a reference to the Article or Schedule bearing that number in this Order. PART I SPEED LIMIT PROVISIONS 2. The parts of the Order specified in the First Schedule to this Order are hereby revoked 3. The lengths of restricted roads in the Second Schedule to this Order shall cease to be restricted roads for the purpose of Section 82 of the Act. 4. No person shall drive any vehicle at a speed exceeding 20 miles per hour in the length of road specified in the Second Schedule to this Order 5. The length of road in the Third Schedule to this Order shall be a restricted road for the purposes of Section 82 of the Act. 6. No person shall drive any vehicle at a speed exceeding 40 miles per hour in the length of road specified in the Fourth Schedule to this Order. 7. Nothing in Paragraphs 3, 4 5 & 6 shall apply to a vehicle being used by naval, military or air force purposes while being driven by a person for the timebeing subject to the orders of a member of the armed forces of the Crown on an occasion when – TRO/HON8030/RC (a) the person driving the vehicle is a member of the special forces as defined by the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011; and (b) the vehicle is being driven- (i) in response, or for practice in responding, to a national security emergency by a person who has been trained in driving vehicles at high speeds; or (ii) for the purpose of training a person in driving vehicles at high speeds. PART II PROHIBITION OF DRIVING PROVISIONS 8. Save as provided in Article 9 of this Order no person shall cause or permit any motor vehicle to proceed along the length of road specified in the Fifth Schedule to this Order at any time. 9. Nothing in Article 8 shall apply in respect of a motor vehicle being used:- (a) for ambulance, fire brigade or police purposes in the event of an emergency; or (b) (with the prior permission of the highway authority) in connection with the laying, erection, inspection, maintenance, alteration, repair, renewal or removal on or near the said road of any sewer main pipe conduit wire cable or other apparatus for the supply of gas water electricity or of any telecommunications apparatus as defined in Schedule 2 of the Telecommunications Act 1984 resulting from works or an emergency; or (c) with the permission or upon the direction of a police constable in uniform or traffic warden; or (d) in the service of a local authority in pursuance of its statutory powers or duties 10. The prohibitions imposed by this Order shall be in addition to and not in derogation from any restriction imposed by any regulations made or having effect as if made under the Act or by or under an enactment.
