From Indifference to Entrapment deals with the question of how the Netherlands faced up to this challenge during the years 1990-1995. It was during this period that the crisis erupted into armed conflict and the single worst war crime in Europe since the end of World War II took place in the ‘safe area’ of Srebrenica. The role of the Netherlands is particularly interesting, as the country held the EC/EU Presidency during the recognition debate in 1991 and supplied the peacekeeping presence in Srebrenica. The questions addressed in this book include: Did early warning work? What role did the Dutch Presidency (July-December 1991) play in the recognition debate? What motiv- ated the Dutch opposition to the Vance-Owen Peace Plan? Why did the Netherlands become From Indifference entrapped, as symbolised through its isolated peacekeeping commitment to Srebrenica? Finally, what can this story tell us about the ability of small and medium powers to in- fluence international affairs? This study is based on interviews with key players, including former Cabinet Minis- ters, and on documents from the Netherlands Ministry to Entrapment of Foreign Affairs, made available under the Dutch ‘freedom of information act’. Davor MARIJAN* The topic of this work is the post-war controversy centred on the view that the Croatian political leadership made an error in January 1992 when, with mediation by the United Nations, it agreed to and signed a ceasefire with representatives of the Yugoslav People’s Army in Sarajevo. Those who hold this view are retired Croatian Army generals, who maintain that the war should have been continued during 1992, which would have achieved a military victory and the liberation of Croatia’s occupied and rebellious territories. Since these speculations are systematically promoted by influential media outlets, the author has attempted to respond to the extent allowed by historical scholarship. Key words: Republic of Croatia, Yugoslav People’s Army, war, strategy, Sarajevo Ceasefire A ceasefire between the Republic of Croatia and the Yugoslav People’s Army (JNA) was signed between Croatian Defence Minister Gojko Šušak and JNA General Andrija Rašeta in Sarajevo on 2 January 1992, mediated by Cyrus Vance, the personal envoy of the United Nations Secretary General. The cease- fire went into effect at 6:00 p.m. on 3 January 1992.1 This ended the first phase of the war in Croatia, which nobody with any credibility disputes today. Our own investigations of these reports, conducted during a series of fact-finding missions to Yugoslavia over several years, indicate that many of these reports are well founded. We call upon you to investigate the abuses enumerated in this letter and to punish those responsible for them. We call upon you to take immediate measures to ensure that such violations of human rights do not occur again. The abuses described in this letter include violations of the laws of war in the Croatian conflict, including the summary execution of civilians; the indiscriminate and disproportionate use of force against civilian targets; the torture and mistreatment of detainees; disappearances and the taking of hostages; the forced displacement and resettlement of civilian populations; and the killing of journalists covering the war. In addition to violations connected with the armed conflict in Croatia, Helsinki Watch has also documented restrictions on the press and on free expression in Serbia and the harassment and repression of opposition political figures and people who have spoken out against the war. Finally, we object to the continuing persecution of the Albanian population of Kosovo. -

Serbia and Montenegro Page 1 of 39 June 1995 Vol. 7, No. 10 FORMER YUGOSLAVIA WAR CRIMES TRIALS IN THE FORMER YUGOSLAVIA INTRODUCTION By early 1995, the international tribunal established by the United Nations to adjudicate war crimes and crimes against humanity in the former Yugoslavia1 had indicted twenty-two individuals for serious violations of humanitarian law, including the crime of genocide.2 Yet despite these indictments, cooperation with international efforts to achieve justice in the former Yugoslavia have been obstructed, particularly by the Federal Republic of Yugoslavia (i.e., Serbia and Montenegro). Serbian, Yugoslav, Croatian and Bosnian authorities all claim that they will try members of their own forces for human rights violations, but few such trials have taken place. Those trials that have taken place are rarely prosecuted properly. For example, in a recent trial in Serbia proper against Du_an Vukovi, a Serbian paramilitary responsible for gross human rights violations in Bosnia-Hercegovina, the prosecution's line of questioning did more to assist the defense than its own side. Domestic trials of alleged war criminals are politicized and due process rights are not always respected. This report demonstrates the limitations of local war crimes prosecutions in Croatia, Bosnia-Hercegovina and the Federal Republic of Yugoslavia, thereby illustrating why the work of the international war crimes tribunal is so necessary, particularly for the indictment and prosecution of high-ranking political and military officials bearing command responsibility for the commission of genocide, crimes against humanity and war crimes by local authorities and soldiers. However, in order for justice to be served, the international community must retain some leverage with which to pressure governments or authorities to extradite those indicted by the tribunal, preferably through the imposition or retention of sanctions against governments that refuse to cooperate with international efforts to ensure accountability for egregious crimes. -

CONCERNS IN EUROPE July - December 2000 FOREWORD This bulletin contains information about Amnesty International’s main concerns in Europe between July and December 2000. Not every country in Europe is reported on: only those where there were significant developments in the period covered by the bulletin. The five Central Asian republics of Kazakstan, Kyrgyzstan, Tajikistan, Turkmenistan and Uzbekistan are included in the Europe Region because of their membership of the Commonwealth of Independent States (CIS) and the Organisation for Security and Co-operation in Europe (OSCE). This bulletin contains an index on pages 99 and 100 about cases and incidents investigated by Amnesty International affecting women and children. They are not an exhaustive summary of the organization’s concerns, but a reflection of the range of violations suffered by women, children and juveniles in Europe. A number of individual country reports have been issued on the concerns featured in this bulletin. References to these are made under the relevant country entry. In addition, more detailed information about particular incidents or concerns may be found in Urgent Actions and News Service Items issued by Amnesty International. This bulletin is published by Amnesty International every six months. Since 2014 he is working as Legal Associate Professional and outspoken advocate of human rights in Bosnia and Herzegovina with particular interest on the topic of Transitional Justice and International Law. ABSTRACT This study aims to examine Serbia’s capacities to face the past and prosecute war criminals as a necessary step toward achieving transitional justice and reconciliation. This is relevant because more than twenty years have passed since the conflicts in the former Yugoslavia ended, yet the region remains deeply unstable because of the gravity of crimes committed and lack of punishment for the perpetrators. For a long time, mechanisms to achieve justice, such as laws on war crimes, investigations, tribunals and commissions were underdeveloped and had no real political support. It was almost impossible to conduct fair trials because of the enormous public pressure and lack of training for court professionals. The justice mechanisms of the ICTY have played a major role in the prosecution of war criminals and have influenced the establishment of the War Crimes Chamber in Serbia. Nonetheless, aside from criminal court proceedings, there are other transitional justice approaches which are only being discussed and are not implemented in Serbia.
