THE YALE JOURNAL OF INTERNATIONAL LAW [Vol. 32: 331 I. INTRODUCTION: AFTER THE END OF HISTORY Theories of international law and politics are a product of their times. They focus on the issues of the day (or of the immediate past) and their assumptions are often the assumptions of the society in which they were born. Perhaps that it is why so many international relations scholars were surprised by the end of the Cold War: Their theories were so informed by bipolarity that they were unable to see the actual changes that would transform the state system. As international relations scholars are re-assessing their theories in a post-Cold War world, lawyers may do the same concerning international legal jurisprudence. Throughout the Cold War, the New Haven School of policy- oriented jurisprudence attempted to describe how law was actually used in the policymaking process and to suggest how it should be used towards the goals of securing human dignity and the spread of free societies.' But with the titanic struggle between competing world orders being replaced by parochial fights and feuds, whither the New Haven School? What insights does it have for today's world? Does the New Haven School's theory need to catch up to the practice of international law? This Article considers the strengths and weaknesses of the New Haven School in light of the competition among multiple conceptions of "world public order" that exist today. As a test case, I will look at the competition on the "grand chessboard" of Eurasia. At one time called the "world island" by geo-strategists, Eurasia today is home to seventy-five percent of the world's population, sixty percent of the global GNP, and contains about seventy-five percent of known energy sources. 2 It is also a geographic space where multiple conceptions of public order, including those of the United States, the European Union, Russia, and Islamic fundamentalists, overlap, interact, and at times compete. This is especially so in the unstable arc of states bordering Russia: from Belarus, Moldova, and Ukraine in the West; down to the Caucasian countries of Georgia, Armenia, and Azerbaijan in the Russian southwest; and ultimately the Central Asian republics of Kazakhstan, Uzbekistan, Turkmenistan, Tajikistan, and Kyrgyzstan to the Russian south. In Part II, I will introduce the idea of "diverse systems of public order" described in policy-oriented jurisprudence. Part III will examine the different public orders in today's multipolar, multinormative world. In Part IV, I will propose the concepts of systemic borderlands-statesthat are the geopolitical crossroads between two or more normative realms-and of normativefriction, the process in which competing conceptions of public order interact in these borderland states, as a means of describing the normative interactions in a multipolar world. Part V will consider examples of systemic borderlands and normative friction in Eurasia. In Part VI, I will propose ways in which the New Haven School can build on some of its own original insights on the existence of diverse systems of public order in light of changes in international politics. As this short Article can only scratch the surface3 of so many issues, I will also set out questions for further investigation. II. Few would question that he was the most original and productive political scientist of his time. While still in his twenties and early thirties, he planned and carried out a re- search program demonstrating the importance of personal- ity, social structure, and culture in the explanation of political phenomena. In the course of that work he employed an array of methodologies that included clinical and other kinds of interviewing, content analysis, para-experimental tech- niques, and statistical measurement. It is noteworthy that two decades were to elapse before this kind of research program and methodology became the common property of a disci- pline that until then had been dominated by historical, legal, and philosophical methods. Lasswell was born in 1902 in Donnellson, Illinois (popu- lation ca. 300). His father was a Presbyterian clergyman, his mother, a teacher; an older brother died in childhood. His early family life was spent in small towns in Illinois and In- diana as his father moved from one pulpit to another, and it stressed intellectual and religious values.

To be published 2009. 2 Political psychology: a field and its themes Political psychology, foreshadowed in the 1930s (Lasswell, 1930), emerged as a distinct subfield of political science in the mid-1970s in the United States, although its intellectual roots are commonly traced back centuries to early French crowd psychologists such as Tarde and LeBon (van Ginneken, 1992). Its emergence in modern form, with the application of formal psychological theory to politics, dates from the early twentieth century, with Sigmund Freud (1927, 1930), but also impelled by founders of the new discipline of political science, such as Graham Wallas (1908). Studies of individual political actors dominated political psychology from the early twentieth century until the 1950s. These were strongly influenced by psychoanalytic assumptions, deriving from Freud’s own biographical essays, but given impetus by Harold Lasswell’s (1930) psychologically informed interpretations of the motives behind political engagement, of political discourse as the key to attitudes (Lasswell et al, 1949) and of the uses of power (Lasswell, 1948). Lasswell seeded the fields of personality and politics (Greenstein, 1987), attitude formation and its relation to ideology (Lane 1962, 1969) and studies of power, including dispositions of power in international relations (Etheredge, 1978). From the mid twentieth century, there was a burgeoning of interest in a second domain—mass political behaviour—that all but eclipsed the focus on individuals as activists (Kuklinski 2002).

Chimpanzee Politics and Legitimate Violence: A Brief Introduction to Politics and States The American federal government is merely one government out of a vast number of governments at national, local, and intermediate levels, a single case study rather than a model of what government in general looks like. And governments in general are just case studies in politics, which is a more extensive concept than government, and encompasses behavior that is older than humanity. So to properly understand the American federal government (and the overall American political system) we need to start with some understanding of politics and government, along with some related political concepts. 1. POLITICS: WHO GETS WHAT, WHEN, AND HOW Political Scientists have given us numerous definitions of politics, which may indicate that we’re not exactly sure what it is we’re studying. These three are, I believe, the most well-known. 1. Politics is “the authoritative allocation of values for the society” (David Easton).1 2. “[T]he essence of politics lies in power. of relationships of superordination, or dominance and submission, of the governors and the governed“ (V.O. Key).2 3. “The study of politics is the study of influence and the influential. Politics [is] who gets what, when, and, how” (Harold Lasswell).”3 Although they use different words, these definitions all have a common focal point: politics is about who determines the outcomes: who allocates values; who governs; who dominates whom; who gets what, when, and how. For the purposes of this book, Lasswell’s definition – “politics is who gets what, when, and how” — will be the dominant theme.

Chapter Five Graduate Studies I began my graduate studies in February 1946 and finished my course work in August 1947, after I had passed my oral exam for the doctorate. In short, I took courses in five semesters, including two summer terms. In summer term courses, professors as well as students tend to take it rather easy because of the heat. I enrolled in the Slavic Department, taking third- year Russian, Russian history, and a seminar on problems in contemporary world politics. Russian history was taught very well, and the seminar on world politics allowed me to pursue a stimulating topic largely on my own. The instructor in the Russian language course was an interesting and eccentric man, but a poor teacher. The students in the seminar were a lively group with a wide range of political opinions, which generated much good discussion. I also took an independent reading course, but really had little idea what to read and where to start. The professor left me to my own devices, trusting that I would make good use of my time, but I did not. At the end of the first semester I realized that I was not interested in Slavic languages, literature or linguistics; I was interested in history and politics and without any difficulty transferred to a doctoral program in the Government Department. There, I took courses for another twelve months. It seems to me in retrospect that in these courses I learned little. What I did learn came not primarily from courses and seminars but from discussions with fellow students outside of class.

Part I discusses basic questions in political sociology mostly focusing on the holders of power and the way power is exercised in a society. In this seminar, sociological analysis is applied to the political field, and attention is paid to social determinants and sources of political power, state formation, theories of the state, political and economic elites. The relationship between political transformation and elite change will also be discussed, just as the structure vs agency debate. Part II acquaints studetns with the most important current topics and concepts of comparative political economy, as a distninct branch of political economy. Classes cover some most important theoretical approaches about the role of socio-political structures and institutions on economic development and about the linkages between political and economic institutions. Course objectives The main aim of the course is to help students understand the social and economic embeddedness of political processes and to familiarize them with some of the most fundamental approaches in the domain of political sociology and political economy. as well with its contemporary currents. It will allow students to understand the different theoretical approaches to the study of power, state, civil society, elites, and the role of economy in influencing policy making.
