BE IT ENACTED by the General Assembly of New Zealand 6 in Parliament assembled, and by the authority of the same, as follows :- 1. This Act may be cited as the Hauraki Plains Act, 1926, and Short Title and commencement. shall come into force on the first day of April, nineteen hundred and twenty-seven. 10 2. In this Act, unless a contrary intention appears,- Interpretation, " Board" means the Land Board of the land district in which any land is situate : " Commissioner " means the Commissioner of Crown Landsfor the land district in which any land is situate : 15 " Minister " means the Minister of Lands. 3. The land described in the First Schedule hereto is hereby declared to be subject to this Act, and shall be dealt with as hereinafter mentioned. To be made fit for (2.) The provisions of sections one hundred and thirty-six to one irroaj-nuM=land hundred and forty-one of the Land Act, 1924, and the provisions of timber royalties,&0., section three hundred and fifty-seven of that Act shall have no 10 not to apply. application to land subject to this Act or to any revenues received therefrorn: Provided that the dovernor-General may at any time, by Order in Council, declare that this section shall, as from a date to be specified in the Order, cease to apply to any land described therein, and there- 16 upon the said provisions of the Land Act, 1924, shall apply to the land to which the Order relates and to revenues thereafter received therefrom. Sale or lease to be with consent of 6. (1.) Save under the authority of an Order in Council made by Minister. the Governor-General under this Act, it shall not be lawful for the Commissioner or the Board to exercise in respect of land subject to this 90 Act any power of sale, lease, or other disposition without the previous consent in writing of the Minister. (2.) The Governor-General may from time to time, by Order in Council, exempt any part or parts of the said land from the provisions of this section. 98 Governor-General 7. (1.) The Governor-General may from time to time take under DICS,5jacent the Public Works Act, 1908, as for a public work, or purchase, any lands, area or areas of Native land or other land adjacent to the land subject to this Act the acquisition of which is, in the opinion of the Governor- General, necessary for the more effective carrying-out of the drainage 80 or other works authorized by this Act or for the better disposal of any land. (2.) All land so taken or purchased shall be deemed to be set apart for the purposes of and shall be subject to the provisions of this Act in the same manner as if included in the First Schedule hereto. 88 Hauraki Plains Settlement Account 8. There is hereby established in the Public Account a separate established. account to be known as the Hauraki Plains Settlement Account, which shall for all purposes be deemed to be the same account as that esta- blished by the same name under the Hauraki Plains Act, 1908. Moneys payable to 9. The Iiauraki Plains Settlement Account shall be credited 40 Hauraki Plains with-- Settlement Account. (a.) All moneys standing to the credit of that account at the com- mencement of this Act: (b.) The proceeds of the sale of any land subject to the provisions of this Act, and the sale or lease of any property pursuant O to section jifteen of this Act: (c.) All moneys received by the Crown as rents, royalties, and other payments accruing in respect of land subject to the pro- visions of this Act: (d.) The proceeds of all rates made and levied pursuant to sections 50 Avelve and thirteen hereof : 5 1+ 5 Hauraki Plains. (e.) All other moneys hereafter payable to the credit of that account under the authority of this or any other Act, whether now in force or that may hereafter be passed. 10. (1.) There may from time to time as the Minister d irects, Moneys payable out p of Hauraki Plains 6 and without further appropriation than this Act, be paid out oi Settlement Account moneys standing to the credit of the Hauraki Plains Settlement Account-- (a.) By way of refund to the Public Works Fund an amount sufficient to recoup that Fund in respect of moneys expended 10 thereout for the purpose of rendering fit for settlement land subject to this Act together with interest on such moneys at the rate of four per centum per annum from the first day of April, nineteen hundred and eight : (6.) Interest at the rate of four per centum per annum on all 16 moneys issued and applied under the provisions of subsection one of section four of the Hauraki Plains Act, 1908, for the purposes of that Act: (c.) The cost of constructing and carrying on works authorized by this Act: 20 (d.) All compensation or purchase money payable in respect of the acquisition of land for the purposes of this Act, and all charges, fees, and other expenses incurred in connection with such acquisition, and all compensation payable pur- suant to section sixteen hereof : 26 (e.) The cost of maintenance of works constructed under the authority of this Act: (,f.) The expenses of the general administration of this Act. (2.) There shall without further appropriation than this section be transferred from the Hauraki Plains Settlement Account to the Con- 30 solidated Fund all moneys received after the commencement of this Act as proceeds of rates made and levied pursuant to section three of the Hauraki Plains Amendment Act, 1911, in respect of periods ending not later than the thirty-first day of March, nineteenundred and twenty-one. 36 11.(1.) For the purposes of this Act the Minister of Finance, Minister of Finance on being authorized so to do by the Governor-General in Council, may *j°*ito rise from time to time raise, on the security of and charged upon the public purposes of this Act revenues of New Zealand, such sums of money as he thinks fit, not exceeding iii the whole the sum of nine hundred thousand pounds. 40 (2.) The sums so raised shall, as and when raised, be paid into the Public Account to the credit of the Hauraki Plains Settlement Account, and shall bear interest at such rate as the Minister of Finance prescribes : Provided that any moneys raised for the redemption of outstanding 45 securities may be paid into the Loans Redemption Account. (3.) This Act shall be deemed to be an authorizing Act within the meaning of tbe New Zealand Loans Act, 1908, and the moneys hereby authorized to be raised shall be raised under and subject to the provisions of that Act accordingly. 50 (4.) In computing the amount that may be borrowed under this section there shall be taken into account all moneys heretofore borrowed by the Minister of Finance for the purposes of the Hauraki Plains Act, 4 Hauraki Plains. 1908, and all moneys issued and applied under subsection one of section four of that Act for the purposes thereof. (5.) All such moneys heretofore borrowed shall be deemed to have been borrowed or issued under this Act, and any securities issued after the commencement of this Act in redemption, renewal, conversion, 5 or replacement of the securities issued in respect of such moneys shall be issued under this Act as the authorizing Act. Minister may levy 12. In order to provide funds for the maintenance of works maintenance and administration rate. constructed under the authority of this Act, and for the expenses of the general administration of this Act, so far as the same relate to the 10 maintenance of such works, the Minister may from time to time make and levy a rate sufficient for those purposes.
