Jest to pojê- cie umowne, okrela siê nim organy wykonuj¹ce w pañstwie funkcjê kontroln¹, któ- ra idzie w parze z ochron¹ praworz¹dnoci. Przybli¿enie koncepcji organów kontro- li i ochrony prawa wymaga odwo³ania siê do teorii podzia³u w³adzy w pañstwie. Ju¿ w staro¿ytnoci wyodrêbniano niezale¿ne od siebie rodzaje organów, niemniej idea trójpodzia³u w³adzy kojarzona jest wspó³czenie z Karolem Monteskiuszem, który wskaza³ na istnienie w pañstwie trzech niezale¿nych od siebie, ale powi¹zanych ze sob¹ i wzajemnie siê równowa¿¹cych w³adz. Potocznie okrela siê je jako w³adzê ustawodawcz¹, wykonawcz¹ i s¹downicz¹. O ile wyodrêbnienie legislatywy i egze- kutywy (ich sk³ad i funkcje) nie budzi w¹tpliwoci, o tyle koncepcja trzeciej w³adzy sk³ania do refleksji. Odkryto j¹ dopiero na pocz¹tku XVIII stulecia1. Powierzenie jej praw do wymierzania sprawiedliwoci i s¹dzenia mia³o stanowiæ przeciwwagê dla dwóch pozosta³ych w³adz. Historia teorii podzia³u w³adz pokazuje jednak ró¿ne spo- soby ujmowania i interpretacji trzeciej w³adzy, a tak¿e próby rozszerzenia zasadni- czego trójpodzia³u i wyodrêbnienia w³adzy kontroluj¹cej2. Z pogl¹dami tymi koresponduje koncepcja R.M. Ma³ajnego. Zgodnie z ni¹, ra- cjonalny ustawodawca, konstruuj¹c system organów pañstwowych powinien naj- pierw wyodrêbniæ funkcje pañstwa, którymi s¹: stanowienie prawa, administrowa- nie i nadzór nad przestrzeganiem prawa. Tê ostatni¹ funkcjê mo¿na podzieliæ na wymiar sprawiedliwoci i kontrolê. W konsekwencji autor wyró¿nia nastêpuj¹ce organy pañstwowe: prawodawcze, administracyjne, prokuratorskie, s¹dowe, kon- 1 A. Wies³aw Skrzyd³o podkrela, ¿e przyjêcie tej klasyfikacji funkcji pañstwa, wywodz¹cej siê z zasady trójpodzia³u w³adz, jest wy- soce przydatne, pozwala bowiem w ca³oci i bez reszty dokonaæ podzia³u organów pañstwowych sk³adaj¹cych siê na ca³oæ aparatu pañstwowego4. Jej dodatkowym atu- tem jest to, ¿e odzwierciedla ona ogó³ funkcji wspó³czesnego pañstwa. Konkluduj¹c nale¿y podkreliæ, ¿e potrzebê wyodrêbnienia funkcji kontrolnej dostrzegano ju¿ przy konstruowaniu fundamentalnych za³o¿eñ trójpodzia³u w³adzy, pojawia³y siê jednak trudnoci dotycz¹ce zaklasyfikowania do jednej z w³adz orga- nów kontroli. St¹d obecnie modyfikuje siê za³o¿enia Monteskiusza5 lub uznaje siê wystêpowanie organów, których nie mo¿na bezspornie zaliczyæ do ¿adnej z trzech zasadniczych w³adz, czego przyk³adem mog¹ byæ niektóre organy kontroli. We wspó³czesnym pañstwie organy wykonuj¹ce funkcjê kontroln¹ stanowi¹ z³o- ¿on¹ i stale rozbudowuj¹c¹ siê kategoriê, w Polsce nazywan¹ kontrol¹ i ochron¹ pra- wa. W najszerszym ujêciu zalicza siê do niej organy kontroli nale¿¹ce do egzekuty- wy, s¹downictwa oraz podmioty, które nie mieszcz¹ siê w tradycyjnym trójpodziale w³adzy. Rozwój tej kategorii organów zwi¹zany by³ z przemianami ustrojowymi, których efektem by³o m. in. utworzenie takich instytucji kontroli, jak: Rzecznik Praw Obywatelskich, Naczelny S¹d Administracyjny, Trybuna³ Konstytucyjny, Trybuna³ Stanu, Krajowa Rada Radiofonii i Telewizji. Koncepcja kontroli i ochrony prawa ci¹gle jest doskonalona, o czym mog¹ wiadczyæ reformy wymiaru sprawiedliwoci w Polsce, w tym likwidacja kolegiów do spraw wykroczeñ i utworzenie dwuinstan- cyjnego s¹downictwa administracyjnego. Szerokie ujêcie podmiotów kontroli i ochrony prawa w doktrynie bywa zawê¿a- ne i ograniczane. W cis³ym znaczeniu, do omawianej kategorii nale¿¹: Najwy¿sza Izba Kontroli oraz Rzecznik Praw Obywatelskich, zaliczane w Konstytucji6 do or- ganów kontroli pañstwowej i ochrony prawa. Organy te charakteryzuj¹ nastêpuj¹ce cechy: oddzielenie od w³adzy wykonawczej, s¹downiczej i ustawodawczej, przy zapewnieniu okrelonych powi¹zañ z Sejmem; konstytucyjna i ustawowa regulacja pozycji ustrojowej; niezale¿noæ i apolitycznoæ; skoncentrowanie dzia³alnoci na wykonywaniu funkcji kontrolnej; brak uprawnieñ do stosowania rodków przymu- su; ochrona praworz¹dnoci, ochrona interesu publicznego i interesu jednostki; re- alizacja funkcji informacyjno-sygnalizacyjnej. Trzeba zaznaczyæ, ¿e analizowana kategoria organów bywa modyfikowana, mo¿na tu powo³aæ siê na koncepcjê, która 3 R. M. Pozycja ustrojowa Na wstêpie nale¿y przyj¹æ pewne za³o¿enia terminologiczne. Otó¿ ustawa o pro- kuraturze8 nie rozstrzyga jednoznacznie, czy organem pañstwa jest prokurator, czy prokuratura. Przypisuje ona cechy organu obu instytucjom. Prokuratura jest jednost- k¹ wyodrêbnion¹ organizacyjnie, natomiast okrelone w ustawie zadania i upraw- nienia wykonuje prokurator. W doktrynie przewa¿a pogl¹d, ¿e to w³anie jego nale- ¿y uznaæ za organ i ta koncepcja zostanie przyjêta na potrzeby dalszych rozwa¿añ. Najwa¿niejszym ród³em prawa reguluj¹cym podstawy funkcjonowania organu pañstwa jest konstytucja. Polska ustawa zasadnicza w rozdziale IX wymienia trzy organy zajmuj¹ce siê kontrol¹ i ochron¹ prawa: Najwy¿sz¹ Izbê Kontroli, Rzeczni- ka Praw Obywatelskich i Krajow¹ Radê Radiofonii i Telewizji. The first part of the article presents the theoretical approach to the financing of transport infrastruc- ture. The essence of investments in both road and rail infrastructure is presented. In addition, selected sources of fundraising for infrastructure investments were discussed on the basis of a literature review. The second part presents and compiles secondary data on financial flows in the National Road Fund and the Railway Fund. The receipts and expenditures of both Funds were analyzed and their importance in infrastructure financing was determined. KEYWORDS transport infrastructure, transport financing, infrastructure investments INTRODUCTION Transport infrastructure is a fundamental physical and social resource, the presence of which is necessary for proper social and economic functioning and development. It is one of the links in the national economy, whose comprehensive development affects the overall efficiency of the econ- omy. Consequently, economic progress can be reduced through neglects and inaccuracies in the development of transport infrastructure (Grzywacz, 1982). Furthermore, it is noted that there are strong two-way links between the development of transport infrastructure and the improvement of competitiveness and economic and spatial cohesion of the regions.

LECHTENBERG THESIS Submitted in partial fulfillment of the requirements for the degree of Master of Arts in Russian, East European, and Eurasian Studies in the Graduate College of the University of Illinois at Urbana-Champaign, 2010 Urbana, Illinois Adviser: Professor Julie Cidell ABSTRACT The Autostrada A1 is a highway currently under construction in Poland. The Autostrada A1 will connect two major Polish ports on the Baltic Sea with industrial areas in the south of the country. Together with the construction of other major highways such as the A2, A3, and A4, it will form a network the significance of which for Poland is paralleled by the Interstate Highway system in the United States and the Autobahn network in Germany. I would suggest that almost every effect that the Autostrada A1 or its realization has had or will have on its environment carries spatial implications. Economic and demographic patterns will likely be significantly affected by the presence of a new north-south highway in Poland. The Autostrada A1 itself, the process to build it, and the transformed government and legal regimes to administer it are all Polish spaces which are merging with the greater space of the European Union while still having ties to the East. Implicit in this process is the further enablement of Poland and other Central European countries which will benefit from the Autostrada A1 to realize their full economic, political and social potential within the contemporary order in Europe and the world.

Accessibility is an important element for tourism development. The Polish-Slovak borderland is currently suffering from inadequate routes to the region and cross-border connections because of the mountains. The borderland are characterised by the poor accessibility and bad condition of the roads. Unfortunately, tourism development analyses and studies carried out over recent decades in Poland and Slovakia have not addressed the problems. The aims of the article was to analyse the Polish-Slovak borderland road accessibility and the key transport solutions required for successful road development.
