    Manjur Ali FORGOTTEN AT THE MARGIN : MUSLIM MANUAL SCAVENGERS Manual scavenging has been thrust upon a community who is then persuaded to be happy with its own marginality. In the Indian context, where division of labour of an individual is decided by his caste, this lack of economic alternative should be construed as a major principle of casteism. It is not just a ‘division of labour’, but also the “division of labourer”. It justifies manual scavenging in the name of ‘job’. Despite all the laws against caste practices, it’s most inhuman manifestation i.e. manual scavenging is still practiced in India. To deal with such a “dehumanizing practice” and “social stigma” the Union government passed a law known as Prohibition of Employment as Manual Scavengers and their Rehabilitation Bill, 2013. This Bill will override the previous one as it had “not proved adequate in eliminating the twin evils of insanitary latrines and manual scavenging from the country.” It is in this context, that this paper would like to deal with Muslim manual scavengers, a little known entity in social science. The first question this paper would like to discuss is about the caste among Indian Muslims despite no sanction from the religion. Secondly, this paper shall deal with Muslim manual scavengers, an Arzal biradari, including their social history. This section will try to bring forth the socio-economic context of Muslim manual scavengers who live an ‘undignified’ life. Third section will deal with the subject of inaccessibility of scheme benefit meant for all manual scavengers? What has been the role of State in providing a dignified life to its citizens? A critical analysis of the movement against manual scavenging shall also be covered.

Chen (Toulouse School of Economics, World Bank)ǁ Shareen Joshi (Georgetown University)ǂ Peter Neis (Toulouse School of Economics)± November 29, 2020 Abstract Bihar is widely regarded as one of India’s poorest and most divided states. It has also been the site of many social movements that have left indelible marks on the state’s politics and identity. Little is currently known about how structural inequalities have affected the functioning of formal systems of justice in the state. We use a novel dataset of more than 1 million cases filed at the Patna high court between 2009—2019 together with a variety of supplementary data to analyze the role of religion, caste and gender in the high court of Bihar. We find that the courts are not representative of the Bihari population. Muslims, women and scheduled castes are consistently under-represented. The practice of using “caste neutral” names is on the rise. Though there is little evidence of “matching” between either judges and petitioners or between judges and filing advocates on the basis of names, we do find evidence that petitioners and their advocates match on the basis of identity such as the use of “caste neutral” names. These results suggest that the social movements which disrupted existing social structures in the past may have inadvertently created new social categories that reinforce networks and inequalities in the formal justice system. *We are grateful to Shilpa Rao and Lechuan Qiu for excellent research assistance.

    266 Chapter-6 Cultural Changes Culture is a very much big spectrum to study. Culture is generally defined as the way of life, especially the general customs and beliefs of a particular group of people at a particular time. So in study of demography the aspect of culture must come in the way of discussion and the demographic changes also leading to the cultural changes drove us to examine and indicate those changes so that any crisis or question emerged from that changes may be conciliated indicating the basics of those changes. In this context the study of cultural change from historical perspective is of a great significance. As we have seen a voluminous and characterized changes in demography happened throughout a long period of 120 years from 1871 to 1991 census year, there might be changes happened in the cultural ingredients of the people of North Bengal. Religion, Caste, language and literature are regarded the basic ingredients of culture. S.N.Ghosh, Director of Census Operations, West Bengal wrote that ‘Religion is an important and perhaps the basic cultural characteristics of the population.’1 On the other it has been opined by Sri A. Mitra that ‘The caste system provides the individual member of a caste with rules which must be by him observed in the matters of food, marriage, divorce, birth, initiation, and death.2 This exemplifies the role of Caste in cultural practices in human life. In this chapter I shall examine the changes in religious and caste composition of demography of North Bengal for the whole period of my discussion and highlight over the changes in numerical growth of persons speaking different languages and then I shall try to indicate to the changes in cultural habits and practices of emerging North Bengal people.

The figures have been presented in three taDles:- (i) Scheduled Castes, Hindus only (i1) Scheduled Tribes -(iii) Other Castes, Hindus and Muslims separately. 3. No castewise figures are available for 1841 Census. The tables of 1£41 Census giye figures for. only a rew/castes and these also fo~ a few seleeted districts. 4. Extracts frGm previous censuses Reports of undivided Punjab, explaining the causes for variation in the figures of individual caste have been given in an Appendix, TABLE I - SCHEDULED CASTES The figures given in this table relate to the territory of Punjab as in 1951. 2. The table presents the figures of 34 castes as specified in the Presidentts Order of 1950. The population of each caste given in this table refers only to the popula­ tion of Hindus. 3. Column 5 of the table gives the estimated popUlation in ISSI. This has been determined by applying the percentage increase of the general pop~lation of the state to the latest available census figures of each caste.
