Government monopoly Methods: A narrative review considering lessons from alcohol for monopolization of all or part of legal markets Market control in cannabis as a strategy for public health and welfare. Control system Results: A monopoly can constrain levels of use and harm from use through such mechanisms as price, limits on times and places of availability, and effective implementation of restrictions on who can purchase, andless directly by replacing private interests who would promote sales and press for greater availability, and as a potential test-bed for new policies. But such monopolies can also push in the opposite direction, particularly if revenue becomes the prime consideration. Drawing on the alcohol experience in recent decades, the paper discusses issues relevant to cannabis legalization in monopolization of different market levels and segments – production, wholesale, import, retail for off-site and for on-site use – and choices about the structuring and governance of monopolies and their organizational location in government, from the perspective of maximizing public health and welfare interests. -

THE PRIVATE ENFORCEMENT OF ANTI-MONOPOLY LAW IN A TRANSITIONAL CHINA: AN ANALYSIS FROM ECONOMIC AND COMPARATIVE PERSPECTIVES BY YING XUE DISSERTATION Submitted in partial fulfillment of the requirements for the degree of Doctor of the Science of Law in Law in the Graduate College of the University of Illinois at Urbana-Champaign, 2012 Urbana, Illinois Doctoral Committee: Professor Nuno Garoupa, Chair Professor Amitai Aviram Professor Dhammika Dharmapala Professor Xin He ABSTRACT From economic and comparative perspectives, this dissertation discusses the problems relating to the enforcement of Chinese AML in general and private enforcement in particular; and argues that an effective antitrust enforcement is an inherent requirement of China’s sustainable economic development, but China should identify the proper role of private antitrust enforcement by looking at 1) the relationship between law enforcement and other policy tools such as advocacy and education, and 2) the relationship between public and private enforcement, given China’s developmental stage. Regulatory Reform in Finland MARKETISATION OF GOVERNMENT SERVICES – STATE-OWNED ENTERPRISES ORGANISATION FOR ECONOMIC CO-OPERATION AND DEVELOPMENT Pursuant to Article 1 of the Convention signed in Paris on 14th December 1960, and which came into force on 30th September 1961, the Organisation for Economic Co-operation and Development (OECD) shall promote policies designed: − to achieve the highest sustainable economic growth and employment and a rising standard of living in Member countries, while maintaining financial stability, and thus to contribute to the development of the world economy; − to contribute to sound economic expansion in Member as well as non-member countries in the process of economic development; and − to contribute to the expansion of world trade on a multilateral, non-discriminatory basis in accordance with international obligations. The original Member countries of the OECD are Austria, Belgium, Canada, Denmark, France, Germany, Greece, Iceland, Ireland, Italy, Luxembourg, the Netherlands, Norway, Portugal, Spain, Sweden, Switzerland, Turkey, the United Kingdom and the United States. The following countries became Members subsequently through accession at the dates indicated hereafter: Japan (28th April 1964), Finland (28th January 1969), Australia (7th June 1971), New Zealand (29th May 1973), Mexico (18th May 1994), the Czech Republic (21st December 1995), Hungary (7th May 1996), Poland (22nd November 1996), Korea (12th December 1996) and the Slovak Republic (14th December 2000). State Owned Enterprises and the Principle of Competitive Neutrality 2009 The OECD Competition Committee debated the application of competition rules to state owned enterprises and the principle of competitive neutrality in October 2009. This document includes an executive summary, a background note and an issues paper by Mr. Antonio Capobianco for the OECD and country contributions from Brazil, Canada, Chile, China, Czech Republic, European Commission, Finland, France, Germany, Greece, India, Indonesia, Korea, Lithuania, Netherlands, Norway, Poland, Romania, Russia, Spain, Sweden, Switzerland, Chinese Taipei, Turkey, United Kingdom, United States and BIAC, as well as two aides memoires for the discussions. Due to their privileged position SOEs may negatively affect competition and it is therefore important to ensure that, to the greatest extent possible consistent with their public service responsibilities, they are subject to similar competition disciplines as private enterprises. Although enforcing competition rules against SOEs presents enforcers with particular challenges, competition rules should, and generally do, apply to both private and state-owned enterprises, subject to very limited exceptions. Competition law alone is not sufficient in ensuring a level playing field for SOEs and private enterprises, which is why policies aimed at achieving competitive neutrality between the two play an essential role. Competitive neutrality can be understood as a regulatory framework (i) within which public and private enterprises face the same set of rules and (ii) where no contact with the state brings competitive advantage to any market participant. Presence of competitive neutrality policies is of particular importance in recently liberalised sectors, where they play a crucial role in leveling the playing field between former state monopoly incumbents and private entrants. -
