SOALAN: 67 PEMBERITAHUAN PERTANYAAN BAGI JAWAB LISAN DEWAN RAKYAT PERTANYAAN : LISAN DARIPADA TUAN RAMKARPAL SINGH A/L KARPAL SINGH [ BUKIT GELUGOR ] TARIKH 16JUN 2015 RUJUKAN 7972 SOALAN: Tuan Ramkarpal Singh a/l Karpai Singh [ Bukit Geiugor ] mintaMENTERI DALAM NEGERI menyatakan usaha-usaha yang diambil untuk mengecualikan penglihatan Ketua Polis Negara dalam siasatan terhadap insiden bantahan gereja di Taman Medan baru-baru ini memandangkan salah seorang dari peserta bantahan tersebut adalah abang kepada Ketua Polis Negara tersebut. JAWAPAN: Tuan Yang di-Pertua, Kerajaan memandang serius tentang kejadian-kejadian jenayah yang berlaku. Siasatan akan dijalankan tidak mengira sama ada ianya dilakukan oleh pihak individu berpengaruh atau sebaliknya. Berhubung dengan isu perhimpunan bantahan mengenai kewujudan gereja di kawasan Taman Medan di Metro Square Taman Medan, Petaling Jaya, pihak polis telah menjalankan siasatan berkait Petaling Jaya Repot 5415/2015 di bawah Seksyen 448/511 Kanun Keseksaan kerana melakukan kesalahan cuba melakukan pencerobohan bangunan pada 20 April 2015. Dalam kejadian tersebut terdapat lebih kurang 40 orang telah hadir dan berkumpul di kawasan tersebut. Dalam insiden bantahan gereja di Taman Medan baru-baru ini, memandangkan salah seorang dari peserta bantahan tersebut adalah abang kepada Ketua Polis Negara, pengurusan PDRM telah memutuskan bahawa sebarang urusan berkaitan kes ini akan dikendalikan oleh Timbalan Ketua Polis Negara bagi mengelak ketidakadilan dalam penyiasatan. Namun demikian, segala keputusan akhir adalah terletak di bawah bidang kuasa Peguam Negara. 2.

KEDUDUKAN PARTI 3. DAP lawan ROS Sejak kejayaan DAP dalam pilihanraya umum 2008, Barisan Nasional yang dikuasai oleh UMNO telah menyerang Parti kita siang dan malam. Sebabnya mudah sahaja: Jika rakyat Malaysia, terutamanya orang Melayu, boleh menerima DAP atau politik bukan-kaum, ia akan menghancurkan politik perkauman di negara ini. Tindakan-tindakan hasad dengki UMNO-BN yang tak henti-henti itu telah menjangkau pula kepada tindakan Pendaftar Pertubuhan (ROS) yang mahu mengharamkan DAP menjelang PRU ke-13 tahun lalu. Kita tidak berundur dan dengan itu, kita menang pusingan pertama. Kemudian ROS datang menyerang kita lagi. Dan sekali lagi, kita bertempur di medan perundangan dan kita menang dalam perjuangan politik kita. ROS terpaksa tunduk di mahkamah selepas disaman oleh DAP, iaitu ROS perlu menerima hakikat bahawa arahan ROS yang menyatakan jawatankuasa tertinggi pusat Parti yang sah yang dipilih pada 29 September 2013 tidak boleh membuat keputusan untuk DAP kerana ia tidak diiktiraf, adalah tidak terikat dengan undang-undang. Walaupun DAP terpaksa bersetuju dengan tuntutan awal ROS supaya Parti kita mengadakan pemilihan semula - jika tidak, Parti menghadapi risiko diharamkan, dan kita tetap mengadakan pemilihan semula itu walapun dengan bantahan, kita tetap berjuang dengan semangat solidariti dan telah membuktikan bahawa kita tidak akan dapat dikalahkan.

    1 FIRST THREE MONTHS OF TOMMY THOMAS AS ATTORNEY GENERAL By Tun Abdul Hamid Mohamad Tommy Thomas assumed office as Attorney General (AG) on June 4, 2018 amidst cheers that he is a “constitutional law expert and civil litigator”; “an excellent choice for his expertise in the law and understanding of human issues” - Herald (Malaysian Catholic Church newspaper); “he holds an enormous amount of experience, making him a (way) more-than qualified candidate for the job” – Esquire; “committed, charismatic and vocal” – Esquire; the first member of the Bar: first non-Malay (Indian) and non-Muslim (Christian) and a lot more, to be so appointed since Merdeka. The inference is that, at last, after more than half a century, a person of real calibre has been appointed and only after the fall of the UMNO (Malay) dominated federal government. The other inference is that all former AGs who were Malays, Muslims and from the Judicial and Legal Service, to put it mildly, were less qualified. Three weeks later (June 25, 2018) I wrote the article “Is the new AG choosing his briefs like a private lawyer?” This article was written after he made the statement that his stand was the same as that of the Bar Council that the post of AG and Public Prosecutor (PP) should be separate and that his priority was as the legal advisor to the government. The 'Ah Ee' (auntie) who runs the place has agreed to let us continue the practice if we win again," Ramkarpal told reporters at Ju Huat this morning during his visit to Air Itam for the by-election campaign. He said it was like a homecoming affair for him visiting Air Itam and the coffee shop because his father loved the place. Lead prosecutor Tan Sri Muhammad Shafee Abdullah on Monday informed a five-man bench chaired by Chief Justice Tun Arifin Zakaria that he would take about one-and-a-half or two hours to wrap up his submission. The defence is expected to reply after that. Meanwhile, Anwar's counsel Ramkarpal Singh told reporters that he, lead counsel Datuk Seri Gopal Sri Ram and Sangeet Kaur Deo would reply to the prosecution's submission. He said if the defence could not finish their reply today, the hearing is expected to continue tomorrow. The Court of Appeal had found Anwar, 67, guilty of having sodomised his former aide, Mohd Saiful Bukhari Azlan, 27, at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara, between 3.10 pm and 4.30 pm on June 26, 2008. Anwar was charged under Section 377B of the Penal Code, which carries a jail sentence of up to 20 years, and whipping, upon conviction. The appeal hearing, which was initially set for two days from Oct 28, has been extended for six days as both sides had submitted lengthy submissions. The defence is seeking to free the opposition leader from a sodomy conviction while the prosecution wants the court to dismiss Anwar's appeal to overturn his conviction and jail term.

    Anwar Loses Sodomy II Appeal Bernama Feb 10, 2015 PUTRAJAYA, Feb 10 (Bernama) -- Datuk Seri Anwar Ibrahim, Tuesday lost his final appeal at the Federal Court against his conviction for sodomising a former aide. The judgement was delivered by Chief Justice Tun Arifin Zakaria who led a five-member panel. The other judges were Court of Appeal president Tan Sri Md Raus Sharif and Federal Court judges Tan Sri Abdull Hamid Embong, Tan Sri Suriyadi Halim Omar and Datuk Ramly Ali. With this ruling, Anwar, 67, stands to be disqualified as the member of parliament for Permatang Pauh as per Article 48(1)(e) of the Federal Constitution, which states that an MP would be disqualified if he or she is sentenced to a jail term of more than a year, or fined more than RM2,000. Anwar was represented by a team of 15 lawyers led by Datuk Seri Gopal Sri Ram, a former Federal Court judge himself. The other 14 lawyers were Ramkarpal Singh Deo, Gobind Singh Deo, Sangeet Kaur Deo, N. Surendran, R. Sivarasa, J. Leela, Latheefa Koya, Lim Choon Khim, Eric Paulsen, Michelle Yesudas, Shahid Adli Kamaruddin, Zaleha Al-Hayat, Jeremy Vinesh Anthony and Mohamed Aliff Bolkin. Senior lawyer Tan Sri Muhammad Shafee Abdullah led the prosecution team in the appeal. He was assisted by deputy public prosecutor Datuk Mohamad Hanafiah Zakaria. On Nov 7, last year, Justice Arifin reserved the decision after hearing submissions from both sides. The hearing of Anwar's appeal, which was initially set for two days from Oct 28, 2014, dragged on for eight days as the defence and prosecution presented lengthy submissions and cited many legal cases.
