The murder of a reformist premier stalled reforms and put an end to the cooperation with The Hague Tribunal. And, moreover, it opened the door to Serbia’s radicalization. The DOS coalition's incapability and unwillingness to make a break with Milosevic’s policy, particularly the warring one, gave scope to restoration of the ancien regime that triumphed in the early parliamentary election. -

PERSPECTIVAS 9/2014 The Changing Face of Colombian Organized Crime Jeremy McDermott ■ Colombian organized crime, that once ran, unchallenged, the world’s co- caine trade, today appears to be little more than a supplier to the Mexican cartels. Yet in the last ten years Colombian organized crime has undergone a profound metamorphosis. There are profound differences between the Medellin and Cali cartels and today’s BACRIM. ■ The diminishing returns in moving cocaine to the US and the Mexican domi- nation of this market have led to a rapid adaptation by Colombian groups that have diversified their criminal portfolios to make up the shortfall in cocaine earnings, and are exploiting new markets and diversifying routes to non-US destinations. The development of domestic consumption of co- caine and its derivatives in some Latin American countries has prompted Colombian organized crime to establish permanent presence and structures abroad. ■ This changes in the dynamics of organized crime in Colombia also changed the structure of the groups involved in it. Today the fundamental unit of the criminal networks that form the BACRIM is the “oficina de cobro”, usually a financially self-sufficient node, part of a network that functions like a franchise. In this new scenario, cooperation and negotiation are preferred to violence, which is bad for business. ■ Colombian organized crime has proven itself not only resilient but extremely quick to adapt to changing conditions. THE INTERNATIONAL CRIMINAL TRIBUNAL FOR THE FORMER YUGOSLAVIA CASE NO. IT-01-42-PT THE PROSECUTOR OF THE TRIBUNAL AGAINST PAVLE STRUGAR THIRD AMENDED INDICTMENT The Prosecutor of the International Criminal Tribunal for the Former Yugoslavia, pursuant to her authority under Article 18 of the Statute of the International Criminal Tribunal for the Former Yugoslavia ("the Statute of the Tribunal") charges: PAVLE STRUGAR With VIOLATIONS OF THE LAWS OR CUSTOMS OF WAR as set forth below: THE ACCUSED: 1. Pavle STRUGAR was born on 13 July 1933 in Pec, in present-day Kosovo. He graduated from the Military Academy for Ground Forces in 1952 and was thereafter assigned to various Yugoslav Peoples’ Army (the "JNA") posts in the Socialist Republic of Slovenia and the Socialist Republic of Serbia. He subsequently was promoted to Major General and was named Commander of the Military Academy for Ground Forces. In 1989, he was made the Commander of the Territorial Defence forces in the Socialist Republic of Montenegro. In December 1989, he was promoted to Lieutenant General. In October 1991, he was named as the Commander of the Second Operational Group, which was formed by the JNA to conduct the military campaign against the Dubrovnik region of the Republic of Croatia ("Croatia"). In 1993 he was retired from the Yugoslav Army (the "VJ"). Among the formations subordinated to him was the Ninth VPS commanded by Miodrag JOKIC. INDIVIDUAL CRIMINAL RESPONSIBILITY 2. As commander of the JNA Second Operational Group set up to conduct the Dubrovnik campaign, General Pavle STRUGAR exercised both de jure and de facto power over the forces under his command. -

PREFACE The influence of organised crime in the Balkan area, as is well known, has reached levels that have required a considerable acceleration in efforts to combat this phenomenon. Albania is involved in many initiatives set up by the international community, which are matched by efforts at national level. In 2005, the Democratic Party achieved a decisive victory in the political elections with the support of its allies, making a commitment to reduce crime and corruption in the country. This victory, and more importantly the ordered transition of power which followed it, has been regarded at international level as an important step forward towards the confirmation of democracy. Despite the active presence of organised criminal groups over the territorial area and the influence exercised by them in the country's already critical social and economic situation, Albania, recognising the need to bring its legislation up to date and to strengthen the institutions responsible for fighting crime, has moved with determination in the direction of reform. With regard to bringing the legislation into line with international standards, we should remember that in 2002 Albania ratified the United Nations Convention against Trans National Organised Crime (UNTOC) and the relative additional protocols preventing the smuggling of migrants and trafficking of human beings. In February 2008 it also ratified the third and final protocol on arms trafficking. Since 1995, Albania has been a member country of the Council of Europe; in 2001 it became a member of the Group of States Against Corruption (GRECO) and in 2006 it also ratified the United Nations Convention Against Corruption (UNCAC). -

Weiner* † Abstract: This Article examines the Strugar decision and its role in estab- lishing the standards for a defendant’s ªtness to stand trial before an in- ternational tribunal. While ªtness to stand trial was an issue in three cases at Nuremberg, those cases failed to establish any standards for the interna- tional criminal justice community. In contrast, the Strugar standards have been followed in other Trial Chambers at the International Criminal Tri- bunal for the Former Yugoslavia, and at The Special Panels for Serious Crimes at the United Nations Tribunal at East Timor. -

Yugoslavia, Federal Republic of Page 1 of 44 Yugoslavia, Federal Republic of Country Reports on Human Rights Practices - 2001 Released by the Bureau of Democracy, Human Rights, and Labor March 4, 2002 (The report on the Federal Republic of Yugoslavia is discussed in three separate sections on Serbia, Kosovo, and Montenegro and addresses human rights situations in each of these entities. Since federal authority was exercised effectively only over the Republic of Serbia throughout the year, the human rights situations in Kosovo and Montenegro are dealt with in separate sections following this report.) The Federal Republic of Yugoslavia (Yugoslavia), a constitutional republic consisting of the Republic of Serbia and the Republic of Montenegro, has a president and a parliamentary system of government based on multiparty elections. Vojislav Kostunica was elected President of the Federation in elections held on September 24, 2000 that were closely contested; President Slobodan Milosevic ultimately was unable to manipulate the elections. Massive public protests forced Milosevic to recognize his defeat and cede power on October 6, 2000. Under the constitutional framework, the Federation encompasses the Republics of Serbia and Montenegro; however, the Montenegrin Government has refused to participate in many of the functions of the Federal Government and has acted unilaterally in several areas. The Federal Government presides over a weakened structure, with responsibilities essentially limited to the Foreign Ministry, the Yugoslav Army (VJ), the Customs Administration, civil aviation control, and foreign economic and commercial relations. Although President Kostunica enjoyed wide popular support, significant power was concentrated at the republic level where, in Serbia, Prime Minister Djindjic exercises significant executive authority.
