23 BACKGROUND

Overview:

The mandatory evacuation order issued by the Town of High Level on May 19, 2019, due to the Chuckegg Creek wildfire resulted in most of the town’s citizens being displaced from their homes and places of employment until the order was lifted on June 3, 2019.

In recognition of the economic and emotional hardship resulting from this evacuation, Council may wish to consider extending the property tax payment deadline to July 12, 2019, or some other date that it feels is most appropriate.

(The 2019 property tax levies will not become due until June 28, 2019, and therefore tax rolls were not penalized in June.)

In accordance with Schedule ‘K’ Revised Fees Bylaw 889-09, a late penalty of 5% of the total past due balance for Town utilities accounts and 2% for Town Accounts Receivable accounts is typically levied on the first business day of each month.

The Municipal Government Act states that a late penalty cannot be applied sooner than 30 days after the tax notice is sent out (MGA s. 344(1)) and that Council is free to defer the collection of property tax (MGA s. 347(1)(c).

Legislation and Policy: Municipal Government Act (MGA) Section 344(1)

Section 344(1) A council may by bylaw impose penalties in the year in which a tax is imposed if the tax remains unpaid after the date shown on the tax notice. (2) A penalty under this section is imposed at the rate set out in the bylaw. (3) The penalty must not be imposed sooner than 30 days after the tax notice is sent out.

Section 347(1)(c) If a council considers it equitable to do so, it may, generally or with respect to a particular taxable property or business or a class of taxable property or business, do one or more of the following, with or without conditions: (a) cancel or reduce tax arrears; (b) cancel or refund all or part of a tax; (c) defer the collection of a tax.

There are no direct financial implications.

Comments:

There is no official policy governing property tax due dates, but the Town typically sets the tax due date as the last business day in June, as is the common practice in many other Albertan Municipalities and is recommended by the Alberta Urban Municipalities Association (AUMA).

There is recent precedent of High Level Town Council extending the property tax payment due date. In 2015, there was a delay in sending out the property tax notices, so the due date was extended by Town Council to July 31, 2015.

Alternatives:

1. Council approves extending the property tax payment due date to July 12, 2019.

2. Council approves extending the property tax payment due date to some other date that it determines to be fair and equitable.

3. Council maintains the original property tax payment due date of June 28, 2019.

Comments:

The financial impact of the evacuation appears to be have affected Town utilities accounts much more significantly than other accounts receivable accounts. Conversely, the operations and ability to pay of most A/R customers does not seem to have been significantly hampered by the mandatory evacuation. Therefore, Administration recommends to waive penalties for the Utilities accounts only.

Alternatives:

1. Council approves the waiving of the late payment penalties that would ordinarily be applied on June 3, 2019, to Town of High Level Utilities accounts, the amount being $1,666.51.

2. Council approves the waiving of the late payment penalties that would ordinarily be applied on June 3, 2019, to both Town of High Level Utilities and Accounts Receivable accounts.

3. Council waives none of the penalties that would ordinarily be applied on June 3, 2019.
