  • Attitudes Towards Whistleblowers in the European Institutions (1957–2002)
Politics and Governance (ISSN: 2183–2463) 2021, Volume 9, Issue 1, Pages 281–291 DOI: 10.17645/pag.v9i1.3944 Article From Neglect to Protection: Attitudes towards Whistleblowers in the European Institutions (1957–2002) Joris Gijsenbergh Faculty of Law, Radboud University, 6525 HR Nijmegen, The Netherlands; E-mail: [email protected] Submitted: 17 December 2020 | Accepted: 4 March 2021 | Published: 31 March 2021 Abstract This article analyses how transparency became a buzzword in the European Union (EU) and its predecessors. In order to do so, it examines how the European Parliament (EP), the European Commission, the Court of Justice, and earlier European institutions responded to whistleblowing, between 1957 and 2002. In 2019, the EP agreed to encourage and pro- tect whistleblowers. However, whistleblowing is far from a recent phenomenon. Historical examples include Louis Worms (1957), Stanley Adams (1973), and Paul van Buitenen (1998). Based on policy documents and parliamentary debates, this article studies the attitudes and reactions within European institutions towards whistleblowing. Their responses to unau- thorized disclosures show how their views on openness developed from the beginning of European integration. Such cases sparked debate on whether whistleblowers deserved praise for revealing misconduct, or criticism for breaching corporate and political secrecy. In addition, whistleblowing cases urged politicians and officials to discuss how valuable transparency was, and whether the public deserved to be informed. This article adds a historical perspective to the multidisciplinary literature on whistleblowing. Both its focus on the European Coal and Steel Community, European Economic Community, and EU and its focus on changing attitudes towards transparency provide an important contribution to this multidisci- plinary field.

  • Corruption Text
Corruption A: Is the EU corrupt? Have you heard of any corruption cases in the EU? What happens to people who are corrupt? The NGO Transparency International (TI) (http://www.transparency.org) regularly announces a Corruption Perception Index (CPI) of countries. In 2002 Peter Eigen, Chairman of Transparency International said that: 'Politicians increasingly pay lip-service to the fight against corruption but they fail to act on the clear message of TI’s CPI: that they must clamp down on corruption to break the vicious circle of poverty and graft. Seven out of ten countries score less than 5 out of a clean score of 10 in the CPI 2002, which reflects perceived levels of corruption among politicians and public officials.' There were some surprises in the figures when for example some ex-communist countries were ranked as less corrupt that some EU countries like Italy and Greece. The fight against corruption has been a big issue during EU Accession negotiations with the EU concerned about corruption penetrating the EU. The TI survey suggests that the EU should also concern itself more with existing corruption in existing member countries. But where is the EU itself in the figures? In 1999 complaints about corruption, cronyism and abuse of power led to the resignation of the entire commission and investigations by the European parliament. In fact the cause of the resignation was not the corruption allegations themselves but the fact that the whistleblower, Paul van Buitenen, was suspended from his job on half pay while the accused commissioners were suspended on full pay.

  • Abuse of Power by Supermarkets
6.8.2009 EN Official Journal of the European Union C 184 E/23 Tuesday 19 February 2008 Abuse of power by supermarkets P6_TA(2008)0054 Declaration of the European Parliament on investigating and remedying abuse of power by large supermarkets operating in the European Union (2009/C 184 E/04) The European Parliament, — having regard to Rule 116 of its Rules of Procedure, A. whereas, throughout the EU, retailing is increasingly dominated by a small number of supermarket chains, B. whereas these retailers are fast becoming ‘gatekeepers’, controlling farmers' and other suppliers' only real access to EU consumers, C. whereas evidence from across the EU suggests large supermarkets are abusing their buying power to force down prices paid to suppliers (based both within and outside the EU) to unsustainable levels and impose unfair conditions upon them, D. whereas such squeezes on suppliers have negative knock-on effects on both quality of employment and environmental protection, E. whereas consumers potentially face a loss in diversity of products, cultural heritage and retail outlets, F. whereas some Member States have introduced legislation attempting to limit such abuse, yet large supermarkets increasingly operate across national borders, making EU legislation desirable, 1. Calls upon DG Competition to investigate the impact that the concentration of the EU supermarket sector is having on small businesses, suppliers, workers and consumers and, in particular, to assess any abuses of buying power which may follow from such concentration; 2. Requests the Commission to propose appropriate measures, including regulation, to protect consumers, workers and producers from any abuse of a dominant position or other negative impact identified in the course of this investigation; 3.
