2. TRANSFER OF DEFENCE LAND COMING IN THE ALIGNMENT OF FOUR LANE RAILWAY OVER BRIDGE SITUATED ON RAIL SAMPAR NO. 359 & 359 A NEAR LAL PHATAK, BADAUN MARG, DISTRICT BAREILLY.

Reference CBR Circular Agenda No. CBB/Circular/ROB/LP/Eng/17-18 dated 17.01.2018, CBR No. 03 dated 30.01.2018 and CBR No. 14 dated 25.01.2019. And Reference Dte. DE CC letter No. 57554/RoB/Badaun Road/Bareilly dated 27.10.2020, Cantt Board Office letter No. CBB/ROB/Eng/xx dated 27.10.2020, Director General Defence Estates Cantt letter No. 735/541/L/DE/CC/2017 dated 26/29 Oct., 2020 and Director General Defence Estates Delhi Cantt letter No. 751/41/L/DE/2012 dated 28.10.2020.

1 The subject matter pertain to proposal for transfer of Defence Land coming in alignment of 04 lane ROB situated near Lal Phatak Badaun Marg. The brief of the case are as under :- Proposal was initiated vide above referred CBRs for obtaining IPA for transfer of Defence Land measuring 6520.99 sq.mtrs. for construction of Rail Over Bridge situated on Rail Sampar No. 359 & 359A at Badaun Road Lal Phatak Bareilly which consisted Defence Land 1010.38 sq.mtrs. Class A-1 and 5510.61 sq.mtrs. Class 'C' as per earlier correspondence on the subject matter. Subsequently U.P. Bridge Corporation vide their letter No. 3030/BR-1/RoB/-359/2019-20 dated 06.03.2020 had submitted revised requirement intimating that land operationally required for the project is 2955.13 sq.meter in place of the previously 6520.99 sq.mtr. Accordingly Station Cell HQ UB Area Bareilly Cantt vide Convening Order No. 411/1/Q(L)/ROB dated 24.07.2020 had convened Board of Officers for the subject purpose and to give suitable recommendations in this regard. The BOO proceedings constituted vide Station HQ Cell Bareilly Cantt has not been received in Cantt Board Office through LMA/Presiding Officer of the BOO. The said proceedings along with enclosures on the subject matter have been received in Cantt Board Office vide Dte. DE CC letter of dated 27.10.2020. The Dte. DE CC vide letter No. 57554/RoB/Badaun Road/Bareilly dated 28.10.2020 has conveyed that the revised proposal for grant of "In Principle" approval for construction of Rail Over Bridge at Lat Phatak Railway Crossing on Bareilly Badaun Road Bareilly includes Class 'C' land measuring 2955.13 sq. mtrs. under the management of Cantt Board Bareilly. The Dte. DE has conveyed that since revised proposal includes Class 'C' land measuring 2955.13, the recommendation of Cantt Board is mandatory either confirming or modifying their earlier resolutions vide CBR Circular Agenda No. CBB/Circular/ROB/LP/Eng/17-18 dated 17.01.2018 and CBR No. 14 dated 25.01.2019 in consideration of the earlier proposal of State Govt. Recently the Dte. Gen. DE vide letter No. 751/41/L/DE/2012 dated 28.10.2020 has conveyed that in continuation to DGDE letter No. 751/41/L/DE/2012 dated 26.02.2016 vide which comprehensive policy letter No. 11015/2/D(Lands) dated 02.02.2016 on "transfer of Defence Land for public utilities and public infrastructure projects" was issued, MoD vide letter No. 11015/2/2012/D(Lands) (pt) dated 21.10.2020 has issued amendments in para 3(e) & para 5(a) of ibid Policy of year 2016 along with additional guidelines to deal with the infrastructure cases. As per MoD Govt. of letter No. 11015/2/2012/D (Lands) (Pt) dated 21.10.2020 vide para-3(e) of the policy it is now provided that "Transfer of Defence land is normally on the basis of exchange of Equal Value Land to be provided by the Indenting Authority or creation of Equal Value Infrastructure (EVI) for the land owning units of Defence by the Indenting Authority. If, however, IA is neither a land owning authority or does not have an arrangement with state Government for providing land for the project, transfer is considered on payment of current market value of land or creation of EVI against the current market value of the land for the land owning units of the Defence." The recommendations of BOO is elaborated in para-18 of the proceedings and the requirement of Class 'C' land measuring 2955.13 sq.mtrs. to be transferred to U.P. State Bridge Corporation Bareilly through PWD Bareilly is mentioned and the cost of the Class 'C' land has been also worked out to Rs. 31773558.00•and other aspects/ issues have been also covered in the BOO recommendations. 2 In this regard DEO Bareilly letter No. DEO/BLY/Lal Phatak/Railway Bareilly dated 03.11.2020 is also referred. The above referred correspondence, documents, CBRs and the BOO Proceedings, MoD Policy of Feb 2016 and MoD Policy of Oct. 2020 are placed on the table for consideration and appropriate resolution on the matter.

Resolution: The Board has considered previous CBRs and subsequent correspondence and documents and letters of PDDE CC and DGDE as shown in the Agenda have been duly considered by the Board. The Board has considered DGDE letter No. 751/41/L/DE/2012 dated 26.02.2016, Policy letter No. 11015/2/D(Lands) dated 02.02.2016, Dte. Gen. DE vide letter No. 751/41/L/DE/2012 dated 28.10.2020 MoD letter No. 11015/2/2012/D(Lands) (pt) dated 21.10.2020 on "transfer of Defence Land for public utilities and public infrastructure projects". The Board has considered that piece of Class 'C' land on Survey No. 328 measuring 2955.13 sq.mtrs. is required for permanent transfer to U.P. State Bridge Corporation for construction of ROB. The Board has considered status of Class 'C' land and during lengthy discussion the Board noted that piece of land proposed to 'be transferred is described as Cantonment Fund Roads under management of Cantt Board, Landlord is Cantonment Board and HoR is Cantonment Board and nature of Holder Rights is vested as per the details and description given in the GLR Extract issued by the office of Defence Estates Officer Bareilly Circle. The Board after lengthy deliberation on the matter has resolved that the proposal may be initiated to obtain sanction of Competent Authority for transfer of Class 'C' land measuring 2955.13 sq.mtrs. to U.P. State Bridge Corporation to expedite construction of ROB on payment of value of land as per current STR worked out for sum of Rs. 3,17,73,558.00 The Board has further resolved that the full amount of Rs. 3,17,73,558.00 should be credited in Cantt Funds by U.P. State/UP PWD/Bridge Corporation prior to transfer of land on sanction of Comptent Authorties.

The Board has resolved to recommend transfer of Class 'C' land to U.P. State on payment of current market value of land and payment of said amount of Rs. 3,17,73,558.00 to Cantt Board Bareilly since piece of land is Class 'C' land vested in Cantt Board. The Board has also resolved that other issues pertaining to Cantt Board including removal of standing trees on Class 'C' land will be dealt as per existing policy and instructions in this regard.

The Board has further resolved that payment to be made by State Govt. should be credited in Cantts Fund but in case this recommendation does not worked out creation of EVI against the aforesaid value of the land may be explored as per instructions of Higher Authorities.

3 3. REGARDING ISSUE OF MATERIALS. There are 110 nos. C.F. Qtrs. for Cantt Board (Group-D) employees category comprising Safaiwalas, Malis and Chowkidars. The Board is informed that Repairs, Maintenance and White Washing/Colour Washing and Painting of C.F. Qtrs. are overdue and could not be carried during last couple of years primarily due to non availability of funds with Cantt Board. It is further reported that on some occasions/past period required materials/quantity were provided/issued by this office to the concerned Group D employees/occupants who were willingly carrying the painting work at their own before festival of Deepawali. The Group-D employees have demanded issue of material and request letter dated 02.11.2020 from a group of Group-D employees and letter dated 03.11.2020 from 131-4t4 Rti p4-ca qMt .65 -1-41 and letter dated 03.11.2020 from -651-4t. co4ra ti t4 .0A1 have been received in this regard. The matter has been discussed with the representatives of employees group, sanitation supervisors and technical staff of Cantt Board Office and it is accordingly proposed to procure the material so that it can be issued to Group-D C.F. employees expeditiously. The Engineering Section has assessed requirement of material quantity for each C.F. Qtr (Group-D) which is placed on the table.

Resolution: The Board has considered Note dated 04.11.2020 submitted by the Engineering Section and Store Section regarding requirement of material quantity for each C.F. Quarter Group-D as per the details given in the Agenda. The Board has considered relevant documents and request letters given by group of employees and unions and considering office note approved total expenditure to the tune of Rs. 1,65,000/- for procurement of required material to be issued to concerned employees/occupiers/allottees.

The Board further resolved that CEO is authorized to take necessary action for procurement of required material and to incur expenditure thereupon in consonance with the Budgetary provisions under relevant Head of BE F.Y. 2020-21.

4. REGARDING PERIODIC WHITE WASHING/PAINTING OF BUILDINGS AND OTHERS ASSETS/PROPERTIES, CONVENIENCES FOR F.Y. 2020-21. Reference CBR No. 33 dated 22.10.2020. It is submitted that L-1 tender rates @ 37.00% Less on MES SSR 2010 for periodic white washing/painting of buildings and others assets/properties, conveniences for F.Y. 2020-21 has been approved vide CBR No. 33 dated 22.10.2019 and contractual formalities including execution of contract agreement with the approved agency M/s Ishan Traders Bareilly is in progress as per terms of E-Tender Action.

4 Initially this office is proposing to undertake white washing/colour washing, painting work in under mentioned locations/sites expeditiously through approved agency :-

(i) Cantt Board Office Building and Campus (ii) Bungalow No. 54/CEO Residence

In this regard estimated cost is being assessed to the tune of Rs. 5.50 lacs by the Engineering Section of this office. Budgetary provisions exists to meet expenditure for the white washing/painting works during F.Y. 2020-21.

The relevant correspondence are put up.

Resolution: The Board has considered relevant documents and the contract file and approved the expenditure to the tune of Rs. 5.50 lacs for undertaking the subject work through the approved Agency M/s Ishan Traders, 159 Kandharpur Bareilly.

The Board has accordingly resolved to place the work order for commencement of the approved work and the expenditure will be incurred in consonance with the budgetary provisions BE FY 2020-21.

5. REGARDING E-TENDER ACTION FOR REPAIR, MAINTENANCE & OPERATION OF STREET LIGHTS, SECURITY LIGHTS & MINI HIGH MAST LIGHT IN BAREILLY CANTONMENT AREA. The tender notice for subject propose was invited through e-tender ID : 2020 DGDE_588410 1) on dated 28 Oct,2020 through Central Public Procurement Portal of Govt.of India i.e.eprocure.gov.in under two bids/cover system i.e. Technical Bid (cover-1 ) and Financial Bid (Cover-2) and also published in news papers Amar Ujala () & Times of India(English) and also Cantt. Board website www.cbbareilly.org for wide publicity. On due date as per the tender notice, the received bids were opened in the presence of the committee of official & elected members constituted for the purpose of scrutiny & evaluation of technical & financial bids. Total four bids were received in this e-tender as mentioned below:-

1. M/s Veena Electrical Enterprises 35-F/4 Rampur Garden Bareilly (U.P) 2. M/s Lovee Electrical, 264 Biharipur Civil Lines Distt. Bareilly (U.P). 3. M/s F M Electricals and Traders 47, Zakheera Street Bareilly (U.P). 4. M/s AVI Construction and Suppliers, Jagatpur,Old City Bareilly(U.P).

The documents of M/s AVI Construction and Suppliers, Jagatpur, Old City Bareilly, found to be unacceptable due to the expiry of the 'A Class License' of the electrical contractor and therefore the technical report of the others contractors except M/s AVI Construction and Suppliers is submitted herewith duly recommended for acceptance of the technical documents.

5 Accordingly, the financial bids were opened and checked for 03 out of 04 bidders. The rates are as below:-

As per the rates given by concerned agencies/tenders the rate quoted by Electricals and Traders 47, Zakheera Street Bareilly(U.P) M/s F M at Rs.649000=00 (Six Lacs Forty Nine Thousand Rupees Only) have been found lowest & reasonable by the committee and the committee has recommended that the contract may be awarded to Traders 47, Zakheera Street Bareilly(U.P) M/s F M Electricals and at at Rs.649000=00 (Six Lacs Forty Nine Thousand Rupees Only) per Annum as per terms & conditions of the tender.

All the relevant papers including tender documents, technical bids, financial bids recommendations of committee of official & elected members for scrutiny & evaluation of technical and financial bids, concerned file etc. are enclosed for appropriate decision on the matter.

Resolution: The Board perused all relevant documents, considered & discussed the matter at length and approved the tender action. The CEO/Member Secretary briefed the matter in detail. The Board resolved that contract for subject purpose be awarded to M/s F M Electricals and Traders 47, Zakheera Street Bareilly(U.P) (L-1) at Rs.649000-00 (Six Lacs Forty Nine Thousand Rupees Only) per annum as per terms & conditions of the tender for duration of one year w.e.f. date mentioned in the Contract Agreement. The following points were discussed with the permission of the Chair:-

GENERAL POINTS — The following points were discussed with the permission of the Chair :- The CEO/Member Secretary apprised the Board regarding the payment of adhoc bonus for the year 2019-20 to concerned CB Employees after obtaining undertaking. CEO is authorized to incur the expenditure. Shri Abdul Hameed, Elected Member raised the issue of permission of constructions and sanction of Building Plans. On this Member Secretary apprised the Board that related subject matter will be put up in ensuing Board Meetings. Shri Abdul Hameed, EM raised the points of Monkeys and Dogs nuisance in Cantt. area. The PCB/Member Secretary assured the Board to take action as per rules. Sh. Abdul Hameed, EM stated that possibility should be explored for not putting "experience" as a mandatory condition in tenders of having low estimated value, so that chance could be given to new small vendors also. Member Secretary agreed to look into it under permissible rules. (v) The CEO/Member Secretary noted the letter of contractor dated 03.11.2020 in which he mentioned that a staff nurse which was selected on selection process which was scheduled on 22.09.2020 has not joined the duty, therefore, the next waiting candidate should be selected for staff nurse duty on contract basis. Board also agreed to call other waiting list candidates (on merit basis), if someone leave. (vi) Shri Abdul Hameed and Shri Madan Singh Bisht, Elected Members requested the Board for repairing Hand Pumps in Cantt. and CEO/Member Secretary assured to work on it on priority basis. (vii) Member Secretary apprised the Board that a Mason (Mistri) and a labour will be detailed on contract basis for small repairing works in Cantt. Board agreed on it. (viii) Member Secretary raised the issue of Hospital timings as many verbal representation from residents came regarding it. Board discussed it at length and decided that the new timing will be from 9.00 a.m to 8.00 p.m. RMO & M.0 will detailed in shifts (total 8 hours each). In case, one of the doctor (RMO/MO) is on leave then on that day atleast supporting paramedical staff should be available to attend emergencies/patients. Board directed office to chalk out detailed timing of Hospital staff (ix) Shri Madan Singh Bisht, Elected Member raised the issue of Sabji Mandi. He requested the Board to shift the Thelas of fruits and vegetables in Sabji Mandi situated at Sadar Bazar. CEO assured for taking action in this regard. (x) Smt. Shikha Nayar, Vice President and Smt. Meeta Sati stated the problem of car parking in Sadar Bazar and B.I Bazar of Cantt. area. They also stated that due to car parking in front of houses, the area becomes congested and create a big problem for cantt. residents. (xi) Smt. Shikha Nayar, Vice President and Shri Madan Singh Bisht, Elected Member gave a representation with request to President Cantonment Board for providing Canteen Facility for Cantt. Board employees. At this PCB stated that he will look into it on priority basis.
