    “Between the Creeks” Gwen Pettit This is a compilation of weekly newspaper columns on local history written by Gwen Pettit during 1986-1992 for the Allen Leader and the Allen American in Allen, Texas. Most of these articles were initially written and published, then run again later with changes and additions made. I compiled these articles from the Allen American on microfilm at the Allen Public Library and from the Allen Leader newspapers provided by Mike Williams. Then, I typed them into the computer and indexed them in 2006-07. Lois Curtis and then Rick Mann, Managing Editor of the Allen American gave permission for them to be reprinted on April 30, 2007, [email protected]. Please, contact me to obtain a free copy on a CD. I have given a copy of this to the Allen Public Library, the Harrington Library in Plano, the McKinney Library, the Allen Independent School District and the Lovejoy School District.     Prior Texas Constitutions Texas Independence The New Republic of Texas • The delegates of Texas met in Washington-on-the-Brazos in 1836 to sign a declaration of independence from Mexico and forge a constitution for the new republic. • The first constitution would outline the core principles of liberty, popular rule, and limited government. 2 Constitutional Government Key Terms Constitution: a document that establishes principles, powers, and responsibilities of government Bill of Rights: a formal declaration of rights of the citizens within government Social Contract: an agreement in which the governed give up freedoms in return for government protection 3 Constitutional Government Two Themes • Early Anglo Texans valued rugged individualism and were not inclined to give up their freedoms to government rule lightly: (1) Individual rights (2) Separation of powers 4 Roots of Rebellion Roots of Rebellion • The spirit of Texas was forged in direct reaction to tyranny from multiple governments and several overbearing rulers. • In 1822, Augustin de Iturbide seized power from the democratically chosen Mexican Congress. • In 1823, Iturbide was forced to abdicate. 5 Roots of Rebellion Roots of Rebellion • Following Iturbide’s departure, the Mexican Constitution of 1824 expanded settlement of the northern Mexico territory. • “Empresarios” were regional land distributors, serving as local recruiters and leaders of fixed areas of land and the people who settled there. • Stephen F. Austin served as an empresario. 6 Roots of Rebellion Key Terms Monarchy: a government run by a single individual, often a king or queen, until death or abdication Republic: a form of government in which people rule indirectly through elected representatives Sovereignty: authority over a political entity, such as a province or a state Separation of Powers: a system that vests political, judicial, and policymaking authority across different branches of government 7 Roots of Rebellion Mexican Constitution of 1824 • Empresarios (like Austin) would be in charge of the colonized territories.

The deci­ sion to add Texas to the Union was either directly or indirectly responsible for the acquisition of all of the territory of the United States south and west of the Louisiana Purchase. An­ nexation was also a critical issue in the presidential election of 1844 and the more general political struggle between Whigs and Democrats. Moreover, the dispute over Texas was a flashpoint in the evolving sectional conflict between the representatives of the free states and slave states.' The discussions of the issue in Congress had a dual aspect. Many of the arguments both for and against annexation were overtly phrased in terms of expediency. In addition, however, the debate over Texas had an important constitutional dimen­ sion, raising fundamental questions about the structure of the nation.

    THE TEXAS CONSTITUTION PART I Half the ballot items are ridiculous because they deal with doing away with a constable’s position in Erath County or somewhere and the other half no one can understand because they involve bond financing or some arcane part of the Constitution that has to be fixed. Former Texas Senator Bill Ratliff A Texas Tragedy CONSTITUTION OF 1876 The Texas Constitution, adopted in 1876 and amended many times since, is so restrictive that many scholars and politicians believe it is counterproductive to effective, modern governance. They believe the document, which is bogged down with statutory detail, is a textbook example of what a constitution should not be. State government functions despite its constitutional shackles: an institutionally weak chief executive; an outdated, part-time legislature; a poorly organized judiciary; and dedicated funds that limit the state’s budgetary options. But a total rewrite of the constitution has been elusive, thanks to numerous special interests that find security in the present document and from those who hold obsolete public offices in Texas and those who benefit from dedicated funds. Public ignorance and indifference to the problems created by the restrictive constitutional provisions also thwart an overhaul of the document. What is a constitution? o constitution o the fundamental law by which a state or nation is organized and governed o establishes the framework of government, assigns the powers and duties of governmental bodies, and defines the relationship between the people and their government o reflects fundamental political, economic and power relationships as determined by the culture, values and interests of the people who create it and the events of the period in which it was written o The US Constitution is the fundamental law of the United States, and a state constitution is the fundamental law of the state.

Richard Page, Lara Schwarz, & Nora Hellmold Vosburg) due for publication in 2016. https://scholarworks.iupui.edu Texas Alsatian, Medina County, Texas 1 Introduction: Historical background The Alsatian dialect was transported to Texas in the early 1800s, when entrepreneur Henri Castro recruited colonists from the French Alsace to comply with the Republic of Texas’ stipulations for populating one of his land grants located just west of San Antonio. Castro’s colonization efforts succeeded in bringing 2,134 German-speaking colonists from 1843 – 1847 (Jordan 2004: 45-7; Weaver 1985:109) to his land grants in Texas, which resulted in the establishment of four colonies: Castroville (1844); Quihi (1845); Vandenburg (1846); D’Hanis (1847). Castroville was the first and most successful settlement and serves as the focus of this chapter, as it constitutes the largest concentration of Alsatian speakers. This chapter provides both a descriptive account of the ancestral language, Alsatian, and more specifically as spoken today, as well as a discussion of sociolinguistic and linguistic processes (e.g., use, shift, variation, regularization, etc.) observed and documented since 2007. The casual observer might conclude that the colonists Castro brought to Texas were not German-speaking at all, but French.

She regarded these colonial possessions as being en- tirely the King's, for his use and benefit. She exploited them for royal profit through a tight trade monopoly and extended her laws into them. Her domination was approaching an end when the Anglo-Ameri- cans began to come into Texas. Moses Austin got permission from the Spanish government to take a colony into Texas in 1821. He died before he was able to complete his project and bequeathed the responsibility to his son, Stephen. In this same year Mexico and Spain were clashing. Iturbide led a pow- erful liberal movement based on unity of all classes, independence under a Bourbon prince with power limited by a constitution, and protection of the Catholic Church. Mexico proclaimed her independence from Spain and proceeded to the drafting of an extremely complex constitution.' It was completed and promulgated in 1824.

    n the saga of Texas history, no era is more distinctive or accented by epic events than Texas’ struggle for independence and its years as a sovereign republic. During the early 1800s, Spain enacted policies to fend off the encroachment of European rivals into its New World territories west of Louisiana. I As a last-ditch defense of what’s now Texas, the Spanish Crown allowed immigrants from the U.S. to settle between the Trinity and Guadalupe rivers. The first settlers were the Old Three Hundred families who established Stephen F. Austin’s initial colony. Lured by land as cheap as four cents per acre, homesteaders came to Texas, first in a trickle, then a flood. In 1821, sovereignty shifted when Mexico won independence from Spain, but Anglo-American immigrants soon outnumbered Tejanos (Mexican-Texans). Gen. Antonio López de Santa Anna seized control of Mexico in 1833 and gripped the country with ironhanded rule. By 1835, the dictator tried to stop immigration to Texas, limit settlers’ weapons, impose high tariffs and abolish slavery — changes resisted by most Texans.
