1 RECORD OF THE JANUARY TERM OF THE JOHNSON COUNTY COURT 1st Day’s Proceedings, 3rd Day of January, 2019 The Honorable Johnson County Commission met this day pursuant to adjournment. Present: Bill Gabel, Presiding Commissioner; John Marr, Eastern Commissioner; Charles Kavanaugh, Western Commissioner and Diane Thompson, County Clerk. The following proceedings were had to-wit: The monthly report of monies received in December, 2018 by Diane Thompson, County Clerk was approved. Deposited with the Treasurer was $22,219.48. Fees received in December, 2018 from Jan Jones, outgoing Recorder of Deeds were approved as submitted by Stormy Taylor, newly elected Recorder of Deeds. Fees deposited with the Treasurer were $28,873.25. Also submitted 2018 year end totals for allocations $398,178.60. The Commissioners met with a citizen regarding concerns about the discussed tax for County Law Enforcement for the April 2019 election. The Commissioners met with Dale Jarman, Ebanie Shaw, Carla Shaw, and Stephen Mukembo for the University of Missouri Extension Council Monthly Update. The Johnson County Commission held a public hearing at 10:30 a.m., as advertised to adopt the 2019 Johnson County Budget. Those additionally present were County Clerk Diane Thompson, County Auditor Chad Davis, Emergency Management Agency Director Troy Armstrong, County Clerk Chief Deputy Jennifer Powers. Commissioner Kavanaugh motioned to adopt and approve the 2019 Johnson County Budget Commissioner Marr seconded the motion. Motion approved unanimously. Presiding Commissioner Gabel presented the 2019 Budget Message. Commissioner Kavanaugh motioned and Commissioner Marr seconded to approve the 2019 Annual Disbursements. Motion approved unanimously. WHEREAS, Johnson County Commission hereby authorizes the Auditor to pay the following entities during the year 2019: Annual Disbursement 2019 Payment Notes Lease Revenue • Justice Center $455,000.00 $37,916.66 per month University of MO Extension $58,250.00 $4,854.16 per month Children’s Mercy Hospital $12,000.00 Annually – June Soil & Water Conservation $7,500.00 Annually – February Warrensburg Cemetery Association $1,000.00 Annually Prosecuting Attorney Retirement Fund $11,628.00 Annually Westchester Plaza • Public Defender rent $18,075.00 $1,506.25 per month WHEREAS, the 2019 budget has been adopted with said payments appropriated; and, NOW, THEREFORE, the Johnson County Commission approves the Annual Disbursements for 2019 and authorizes payments to be made accordingly. Commissioner Kavanaugh motioned and Commissioner Marr seconded to approve the renewal of Outstanding Lease Purchases. Motion approved unanimously. WHEREAS, Johnson County has previously entered into the following leases: Annual Payment Payment Description Lessor Due Date 2019 Payment Fund Skid Steer Annual Lease Cat Financial 18-Jan $6,300.00 006 Motor Grader John Deere 20-Mar $241,188.88 018 Track Loader Cat Financial 31-Mar $43,153.92 006 Reclaimer Cat Financial 15-Jul $61,673.84 078 Voting Machines US Bank 15-Dec $74,006.80 001 WHEREAS, Johnson County wishes to continue the leases for 2019; and, WHEREAS, the 2019 budget has been adopted with said lease payments appropriated; and, NOW, THEREFORE, the Johnson County Commission approves the continuation of the leases for 2019 and authorizes payments to be made accordingly. Commissioner Kavanaugh motioned and Commissioner Marr seconded to approve the transfer from Tax Maintenance Fund to General Revenue. Motion approved unanimously. WHEREAS, the Collector’s Maintenance Fund was established pursuant to 52.312 RSMo for the purpose of funding additional costs and expenses incurred in the office of collector; and, WHEREAS, 52.317(1) RSMo states that any moneys accumulated and remaining in the tax maintenance fund as of December thirty-first each year in all counties other than counties of the first class shall be limited to an amount equal to the previous year’s approved budget for the office of collector. Any moneys remaining in the tax maintenance fund as of December thirty-first each year that exceed the above-established limits shall be transferred to county general revenue by the following January fifteenth of each year; and, WHEREAS, the Adopted 2019 Budget shows a balance of $184,815.96 as of December 31, 2018 in the Collector’s Maintenance Fund; and, WHEREAS, the approved 2018 budget for the Johnson County Collector was $135,000 and, NOW, THEREFORE, the Johnson County Commission hereby authorizes the Auditor to transfers the difference of $49,000 from the Collector’s Maintenance Fund (15) to General Revenue (001-000-45831) by January 15, 2019 pursuant to 52.317(1) RSMo. Commissioner Marr stated the County could take care of restoring the property and reseeding. Pat Doyle stated the pipeline typically provides a monetary reimbursement (approximately $200.00) for the work and any product. The Commissioners accepted the summary settlement report of Heather Reynolds, Treasurer, for the month of December, 2018. Adjournment was at 4:00 p.m. The next meeting will convene on January 7, 2019. Present: Bill Gabel, Presiding Commissioner; John Marr, Eastern Commissioner; Charles Kavanaugh, Western Commissioner and Diane Thompson, County Clerk. The following proceedings were had to-wit: The Commissioners met with Troy Armstrong regarding the Emergency Management Agency Bi-Weekly Update. Armstrong noted City of Knob Noster named the Police Chief the Interim Emergency Management. The Commissioners reviewed and approved minutes from the previous week. Commissioner Kavanaugh motioned and Commissioner Marr seconded to approve the distribution of online auction funds. Motion approved unanimously. WHEREAS, Johnson County Road and Bridge Department and Bridge Construction sold the following items in an online sale on Purple Wave, Incorporated with an auction date of December 18, 2018; and, WHEREAS, the Commissioners have received check number 47630 from Purple Wave, Incorporated in the amount of $136,825.00; and, NOW, THEREFORE, the Johnson County Commission authorizes the Johnson County Treasurer to deposit the funds as follows: Road & Bridge - Sale of Equipment (Account #002-000-44305) 2011 John Deere 770G Motor Grader $75,000 (6) Belly Dump Trailer Tarps $750 2000 Ingersoll Rand 110D Pro-Pac Series Single Drum Vibratory Roller $37,500 2008 Freightliner Business Class M12 Dump Truck $22,500 TOTAL $135,750 Bridge Construction - Sale of Equipment (Account #006-000-44305) 1994 Chevrolet C1500 Pickup Truck $575 1992 GMC 1500 Pickup Truck $500 TOTAL $1,075 GRAND TOTAL $136,825 The Commissioners met with Gary Bell, Road and Bridge Supervisor, regarding maintenance of the newly constructed Spirit Trail (West of Warrensburg) and maintenance of a road aprons where County Roads meet State Highways. The Commissioners received the following from the Johnson County Community Health Services in accordance with Section 205.090 of the County Health Center Law: 1. Official minutes of proceedings of the Board of Trustees, Sworn statement of receipts and expenditures during the preceding calendar year, 2. Approved operating budget for fiscal year ending June 30, 2019 Also enclosed were comparison receipts and expenditures for calendar years 2017 and 2018, the audited financial statements for the past fiscal year and monthly activity reports. The Commissioners received notice from Missouri Association of Counties regarding Bill of Costs Alternative Jail Sanction as a follow-up to the September 25, 2018 letter. Adjournment was at 4:00 p.m. The next meeting will convene on January 8, 2019. Present: Bill Gabel, Presiding Commissioner; John Marr, Eastern Commissioner; Charles Kavanaugh, Western Commissioner and Diane Thompson, County Clerk. The following proceedings were had to-wit: Accounts payable in the amount of $1,194,728.76 was reviewed and approved for payment. It was noted that the last bill payments were completed December 17, 2018. The Commissioners met with Tracy Brantner regarding the Johnson County Economic Development Corporation Monthly Update. Discussion included: • Shamrock Business Park – Brantner will call Troy Yackel January 10, 2019 to confirm a deadline
