Smart Adeyemi THE SENATE, NOTES with serious concern the illegal publications, distribution and sales of the laws passed by the National Assembly on the streets of Abuja and other parts of the country; PRINTED BY NATIONAL ASSEMBLY PRESS, ABUJA 37 Thursday, 28th July, 2011 25 OBSERVES that as soon as the National Assembly passes a Bill and it is assented to by the President, C- in-C the next day you would see different versions of such an Act being hawked in major cities across the country, especially in the Federal Capital Territory (FCT), Abuja; AWARE that before an Act of the National Assembly is made public it would have been duly gazetted which is a proof of the true copy; OBSERVES that section 5 of the Authentication Act Cap A2 LFN 2004 stipulates that the printing of any Act of the National Assembly shall be done by the Government printer who shall endorse on the back that it is published by authority; OBSERVES also that section 6 of the same Act stipulates that every Act of the National Assembly published by authority shall be received in a court and by all persons as sufficient evidence that it has been assented to in the President’s name; NOTES that in contravention of section 5 and 6 of the Authentication Act as cited above, some Nigerian publishers flood the streets of Nigeria with anonymous but fake copies of Laws passed by the National Assembly; WORRIED that some of the laws passed by the National Assembly that have been bastardized by these printers include 1999 Constitution (Amendments) as well as the Electoral Act Amendments Act 2010. Accordingly resolves to: i. CONDEMN the practice of illegal printing of the Laws passed by the National Assembly; and ii. URGE Mr. President, C-IN-C, to direct the Ministry of Justice to set in motion immediate steps to put an end to this illegal act. CONSIDERATION OF A BILL 1.     14 July 2017 Mr. Abubakar Malami (SAN) Attorney-General of the Federation and Minister of Justice, Federal Ministry of Justice, Shehu Shagari Way, Abuja Dear Mr. Abubakar Malami (SAN), Re: Request to challenge the legality of states’ laws granting former governors and now serving senators and ministers double pay, life pensions and seek recovery of over N40bn of public funds Socio-Economic Rights and Accountability Project (SERAP) is writing to request you to use your good offices as a defender of public interest, and exercise your powers under Section 174(1) of the Constitution of Nigeria 1999 (as amended), to urgently institute appropriate legal actions to challenge the legality of states’ laws permitting former governors, who are now senators and ministers to enjoy governors’ emoluments while drawing normal salaries and allowances in their new political offices; and to seek full recovery of public funds from those involved. This request is entirely consistent with Nigeria’s international anticorruption obligations under the UN Convention against Corruption, to which the country is a state party. We request that you take this step within 7 days of the receipt and/or publication of this letter, failing which SERAP will institute legal proceedings to compel the discharge of constitutional duty and full compliance with Nigeria’s international obligations and commitments.
