CAS XXV CONTEMPORARY AUSTRIANAUSTRIAN STUDIES STUDIES | VOLUME VOLUME 25 25 This volume celebrates the study of Austria in the twentieth century by historians, political scientists and social scientists produced in the previous twenty-four volumes of Contemporary Austrian Studies. One contributor from each of the previous volumes has been asked to update the state of scholarship in the field addressed in the respective volume. The title “Austrian Studies Today,” then, attempts to reflect the state of the art of historical and social science related Bischof, Karlhofer (Eds.) • Austrian Studies Today studies of Austria over the past century, without claiming to be comprehensive. The volume thus covers many important themes of Austrian contemporary history and politics since the collapse of the Habsburg Monarchy in 1918—from World War I and its legacies, to the rise of authoritarian regimes in the 1930s and 1940s, to the reconstruction of republican Austria after World War II, the years of Grand Coalition governments and the Kreisky era, all the way to Austria joining the European Union in 1995 and its impact on Austria’s international status and domestic politics. Aber die wichtigste ist wohl: Pölzl besitzt ein hoch entwi- Gckeltes Gespür für den gezielten Einsatz von Macht. Im Juni 2005 führte Niederösterreichs Landeshauptmann Erwin Pröll die Handymastensteuer ein. Pölzl, damals Chef von T-Mobile, wollte das nicht schlucken. Von geschickten Be- ratern eingefädelt, fand im zwölften Stock eines Hoch- hauses am Donaukanal in Wien ein diskretes Treffen statt. Und wenig später erschien in Österreichs größter und ein- flussreichster Tageszeitung, der „Kronen Zeitung“, ein Ar- tikel mit der Überschrift: „Österreicher gegen Handymas- tensteuer“. Es sollte nicht die einzige Story mit diesem Tenor bleiben. Der Machtkampf war entschieden: Die Mobilfunker gelobten, ihre Masten in Zukunft gemeinsam zu nutzen, und Pröll trat den geordneten Rückzug an. Am 15. Dezem- ber 2005 wurde im niederösterreichischen Landtag die Handymastensteuer wieder abgeschafft. The Bulletin
THE BULLETIN The Bulletin is a publication of the European Commission for Democracy through Law. It reports regularly on the case-law of constitutional courts and courts of equivalent jurisdiction in Europe, including the European Court of Human Rights and the Court of Justice of the European Communities, as well as in certain other countries of the world. The Bulletin is published three times a year, each issue reporting the most important case-law during a four months period (volumes numbered 1 to 3). The last two volumes of the series concerning the same year are actually published and delivered in the following year, i.e. volume 1 of the 2002 Edition in 2002, volumes 2 and 3 in 2003. Its aim is to allow judges and constitutional law specialists to be informed quickly about the most important judgments in this field. The exchange of information and ideas among old and new democracies in the field of judge-made law is of vital importance. Such an exchange and such cooperation, it is hoped, will not only be of benefit to the newly established constitutional courts, but will also enrich the case-law of the existing courts. The main purpose of the Bulletin on Constitutional Case-law is to foster such an exchange and to assist national judges in solving critical questions of law which often arise simultaneously in different countries. The Commission is grateful to liaison officers of constitutional and other equivalent courts, who regularly prepare the contributions reproduced in this publication. As such, the summaries of decisions and opinions published in the Bulletin do not constitute an official record of court decisions and should not be considered as offering or purporting to offer an authoritative interpretation of the law. -

Johler Project assistant at the Institute of Public Law, State and Administrative Science at the University of Innsbruck and the Liechtenstein Institute abstract From a comparative perspective, the Austrian Federal Constitution appears rather centralized, given that the majority of legislative competences are allocated at the federal level. However, a closer look indicates that the Länder (the federal units) gain con- siderable political weight by serving as the administrative centre of gravity; namely, the Länder execute their own laws and most of the laws based on the federation’s subject-matters. Hence, one might speak of “administrative federalism”. History shows that Austrian poli- tics resemble a tug-of-war over the federal division of (legislative) competences. The newly elected coalition government’s program joins the ranks of long-winded discussions on how to make Austrian federalism more efficient.
