Caibidil 1 Réamhrá 1.1 Réamhrá Caibidil 1 Réamhrá 1.1 Réamhrá Leagtar amach straitéis iomlán do phleanáil cheart agus d’fhorbairt inbhuanaithe Chontae Lú thar thréimhse an phlean i bPlean Forbartha Chontae Lú 2009-2015 . Féachtar le cothromaíocht a bhaint amach idir an leas coiteann agus leas an duine aonair i spásphleanáil tríd an bplean forbartha. Go nuige seo bhí rannpháirtíocht agus comhpháirtíocht thar barr ar siúl ar bhonn áitiúil idir Comhairle Contae Lú, gníomhaireachtaí poiblí, soláthraithe seirbhíse, an earnáil phríobháideach agus an pobal i gcoitinne. Sa Phlean seo déantar tógáil bhreise ar athbhreithniú Phlean Forbartha Chontae Lú 2003 – 2009 , agus cuirtear san áireamh buntreochtaí forbartha a tharla le déanaí, forbairtí i mbeartais ar bhonn áitiúil, náisiúnta agus réigiúnach agus ceanglais dhlíthiúla an AE, lena n-áirítear Measúnacht Straitéise Timpeallachta a chur i bhfeidhm ar phleananna agus ar chláir ar leith. Sa phlean sin, tugtar aghaidh ar réimsí freagrachta sonracha an údaráis phleanála, mar atá bóithre agus seirbhísí sláintíochta, tithíocht, straitéis lonnaíochta, caomhnú, oidhreacht agus bonneagar pobail agus sóisialta, ach ag an am céanna leagtar amach fís níos fadtéarmaí don bhealach ina bhféadfar an Contae a fhorbairt agus an timpeallacht a chaomhnú agus a fheabhsú, trí phrionsabail na forbartha inbhuanaithe a úsáid. Tá forbairt inbhuanaithe ag croílár an phróisis phleanála anois mar thoradh ar mhéadú ar imní maidir leis an timpeallacht ar a bhfuil beartais náisiúnta agus idirnáisiúnta dírithe le blianta beaga anuas. Tá forbairt inbhuanaithe sainmhínithe ag Brundtland mar fhorbairt a fhreastalaíonn ar riachtanais an lae inniu gan cur isteach ar ábaltacht na nglún atá le teacht chun freastal ar a riachtanais féin. Tá sonraí breise faoi thiomantas Chomhairle Contae Lú d’fhorbairt inbhuanaithe ar fud an phlean. 1.1.1 Raon Feidhme an Phlean Clúdaíonn raon an Phlean Forbartha ceantar riaracháin Chontae Lú, ach amháin teorainneacha bardasacha Chomhairle Baile Dhún Dealgan chomh maith le purláin Dhún Dealgan atá mar ábhar i bPlean Forbartha Dhún Dealgan agus a Phurláin 2009- 2015 . Tá teorainneacha bardasacha Chomhairle Baile Dhroichead Átha as an áireamh chomh maith. Ní leagtar amach beartais mhionsonracha do bhailte agus do shráidbhailte aonaracha sa chontae ach amháin i gcás na nAonad Forbartha Catagóir ll(a) agus ll(b). Bainfear amach mionsonraí na mbeartas do bhailte agus sráidbhailte aonaracha ar fud an chontae trí athbhreithniú na bpleananna ceantar áitiúil a thosóidh le linn tréimhse oibriúcháin an Phlean. 1.1.2 Teideal an Phlean Beidh Plean Forbartha Chontae Lú 2009-2015 mar theideal ar an bPlean Forbartha seo. Dréacht Phlean Forbartha Chontae Lú 2009 - 2015 1 Caibidil 1 Réamhrá 1.1.3 Stádas Dlíthiúil Tá an plean seo ullmhaithe de réir cheanglais na nAchtanna um Pleanáil agus Forbairt 2000-2006 . Nuair a ghlacfar leis cuirfear in ionad Phlean Forbartha Chontae Lú 2003- 2009 é atá ann faoi láthair. De réir Mír 9(1) an Achta um Pleanáil agus Forbairt 2000 tá ceanglas ar gach Údarás Pleanála athbhreithniu a dhéanamh ar an bplean forbartha atá acu agus plean forbartha a dhéanamh gach 6ú bliain. Is é an creat dlíthiúil d’ullmhúchán Phlean Forbartha an tAcht um Pleanáil agus Forbairt 2000-2006. De bhun na reachtaíochta sin, ní mór straitéis iomlán do phleanáil cheart agus forbhairt inbhuanaithe an Chontae a bheith leagtha amach sa phlean. Caithfidh sé bheith comhsheasmhach chomh maith le cibé pleananna, beartais nó straitéisí náisiúnta atá bainteach le pleanáil cheart agus forbairt inbhuanaithe. Caithfear roinnt cuspóirí sainordaitheacha a chur san áireamh sa Phlean chomh maith do na nithe seo: • Criosú talún (taobh istigh de cheantair uirbeacha amháin) • Soláthar bonneagair • Caomhnú agus cosaint an chomhshaoil • Comhtháthú riachtanais shóisialta, phobail agus chultúir leis an bpleanáil • Forbairt inbhuanaithe an cheantair • Caomhnú carachtair an tírdhreacha • Limistéir Chaomhnaithe Ailtireachta • Cosaint struchtúr agus caomhnú Limistéir Chaomhnaithe Ailtireachta • Athnuachan agus forbairt ceantar a bhfuil athghiniúint de dhíth orthu • Soláthar cóiríochta don lucht siúil • Caomhnú, feabhsú agus leathnú taitneamhachtaí agus áiseanna chaitheamh aimsire • Treoir um Mórthimpistí (suímh de chuid Seveso) • Soláthar saoráidí don phobal Is é an tAcht um Pleanáil agus Forbairt 2000 an Príomh-Acht a bhaineann le reachtaíocht um Pleanáil agus Forbairt sa tír. San Acht sin rinneadh comhdhlúthú ar an reachtaíocht phleanála go léir a bhí ann roimhe sin, agus rinneadh soiléiriú agus simpliú ar an gcreat reachtaíochta ionas go raibh sé ina aon phíosa amháin de reachtaíocht féinchuimsitheach. Tá an tAcht 2000 fós mar bhonn don chód pleanála in Éirinn. Leagtar amach ann sonraí na dtreoracha pleanála réigiúnaí, pleananna forbartha agus pleananna ceantar áitiúil chomh maith le creat bunúsach an chórais bhainistíocht forbartha agus ceada. Bhí roinnt athruithe sa reachtaíocht ón bhliain 2000 agus leagtar amach thíos na cinn is suntasaí díobh; • An tAcht um Pleanáil agus Forbairt (Leasú) 2002 inar athraíodh Cuid V den Acht um Pleanáil agus Forbairt 2000 agus ullmhúchán pleananna ceantar áitiúil. • An tAcht Tithíochta (Forálacha Ilghnéitheacha) 2004 , ina ndearnadh athruithe móra do Chuid V den Acht um Pleanáil agus Forbairt 2000 . • An tAcht um Pleanáil agus Forbairt (Bonneagar Straitéiseach) 2006 , inar foráladh go, i measc nithe eile, mbunófar nós imeachta ceada chun éifeachta do chineáil ar leith de bhonneagar mór agus do chruthú shainrannán taobh istigh den Bhord Pleanála chun cinntí a dhéanamh maidir le tograí mar sin. Dréacht Phlean Forbartha Chontae Lú 2009 – 2015 2 Caibidil 1 Réamhrá 1.2 Athbhreithniú Phlean Forbartha Chontae Lú 2003-2009 Bhí fás eacnamaíochta agus forbartha gan sárú ar fud Chontae Lú, díreach mar a bhí ar fud na tíre, sna blianta 2003-2009. Sa Phlean Forbartha Chontae 2003-2009 cuireadh creat oibre ar bun d’fhorbairt fhisiciúil, shóisialta agus eacnamaíoch Chontae Lú agus do chaomhnú, cosaint agus feabhsú oidhreacht agus taitneamhachta an Chontae. Mar gheall air sin, i dtéarmaí úsáid talún, bhí coinneáil mhéadú daonra, mar fhreagra straitéiseach, indéanta thar thréimhse an phlean. Bhí straitéis lonnaíochta sa Phlean inar aithníodh an brú mór maidir le forbairt a bhain le Lú mar gheall ar cé chomh gar is atá sé do mhorcheantar Bhaile Átha Cliath, agus chomh maith leis sin mar gheall ar a shuíomh straitéiseach ag lárphointe Chonair Bhaile Átha Cliath go Béal Feirste. Bhí ról tábhachtach ag an bPlean Forbartha Contae 2003-2009 chomh maith i mbunadh an chomhthéacs d’ullmhúchán roinnt ionstraimí a bhain le hábhar agus ar ghlac an Chomhairle leo ina dhiaidh sin. Áiríodh orthu siúd an Straitéis Tithíochta agus an Straitéis Mhiondíola . 1.3 An Fhís do Chontae Lú Is é Contae Lú an contae is lú in Éirinn ach mar sin féin tá sé ar cheann de na cinn is mó daonra agus is urbaí lasmuigh de Bhaile Átha Cliath. Séard is cúis leis sin ná dhá cheann de na bailte móra cúigeacha is mó sa tír a bheith taobh istigh dá theorainneacha. De réir Daonáireamh 2006 bhí daonra de 110,894 sa chontae. Is ionann seo agus méadú de 8.9% ar an tréimhse sé bliana roimhe sin. Mar gheall ar a shuíomh straitéiseach ar Chonair eacnamaíoch Bhaile Átha Cliath/Béal Feirste, rochtain ar phoirt an chósta thoir agus aerfoirt idirnáisiúnta, agus an bonneagar bóithre agus iarnróid atá ag feabhsú go mór, tá suíomh maith ag an gcontae maidir le méadú leanúnach ar fhás an daonra agus na heacnamaíochta amach anseo. Is é cur chun cinn agus rialúchán fhorbairt an chontae amach anseo, ar bhealach a fheabhsóidh caighdeáin mhaireachtála agus a mbeidh forbairt shóisialta agus chutúir mar thoradh air dá n-áitreabhaigh, gan baol d’ábaltacht mhuintir Lú sa todhchaí déanamh amhlaidh, an dúshlán atá roimh Chomhairle Chontae Lú i gcomhpháirtíocht le Comhairle Baile Dhún Dealgan agus Comhairle Toghlach Dhroichead Átha. Is í an fhís do Chontae Lú amach anseo ná áit: • Inar mian le daoine cónaí, oibriú, cuairt a thabhairt air agus infheistiú a dhéanamh ann amach anseo • Ina bhfuil pleanáil mhaith, bainistíocht mhaith, sábháilteacht agus cuimsitheacht • Ina bhfuil comhionannas deise do chách Is féidir an fhís do Chontae Lú, mar atá sí cumhdaithe sa phlean forbartha seo, a bhaint amach. Iarrtar ann contae atá rathúil agus rafar a sholáthar tríd an bpróiseas pleanála gan aon duine nó grúpa sóisialta a fhágáil gan tairbhí na forbartha. Cumhdaítear ann chomh maith inbhuanaitheacht chomhshaoil, eacnamaíochta agus shóisialta, mar phrionsabail, lena n-áirítear cosaint acmhainní, oidhreachta agus timpeallachta an chontae idir nadúrtha agus tógtha. Dréacht Phlean Forbartha Chontae Lú 2009 – 2015 3 Caibidil 1 Réamhrá 1.4 Cuspóirí Straitéiseacha Féachfar leis an bhfís sin a chur i gcrích trí iarracht a dhéanamh cuspóirí straitéiseacha iomlána an phlean seo a bhaint amach: 1. Treoraigh forbairt nua de réir na straitéise lonnaíochta, a mbeidh forbairt inbhuanaithe an chontae don tréimhse 2009-2015 agus ar aghaidh mar thoradh uirthi. Beidh gá le forbairt a bheith inrochtana, tiosach ar fhuinneamh agus le bonneagar agus seirbhísí d’ardchaighdeán san áireamh. 2. Éascaigh forfheidhmiú Straitéis Fhorbairt Eacnamaíoch Indecon do Chontae Lú 2009- 2015. Iarrfar anseo, chomh fada agus is féidir, deiseanna fostaíochta a chur ar fáil in áiteanna atá gar do formhór mhuintir an Chontae. 3. Éascaigh agus cuir chun cinn forbairt eacnamaíoch an chontae bunaithe ar shaothrú an suímh fábhraigh atá aige ar lárphointe Chonair Bhaile Átha Cliath-Béal Feirste agus an nasc a sholáthraionn sin do mhargaí agus seirbhísí lasmuigh.

E/05/001) Competition Act 2002 Decision of The Competition Authority (Case COM/05/03) The alleged predation by the Drogheda Independent Company Limited in the market for advertising in local newspapers in the greater Drogheda area Date of Decision: 7th December 2004 EXECUTIVE SUMMARY The Competition Authority (“the Authority”) has taken the view that alleged predatory conduct by the Drogheda Independent Company Limited (“the DIC”) does not breach the Competition Act 2002. This view is taken on the basis that the DIC is not dominant nor could its alleged conduct constitute an abuse. The alleged conduct is arguably pro-consumer and more indicative of intense competition in the market than predatory conduct by a dominant undertaking. The Authority’s investigation was prompted by complaints from the publisher of the Drogheda Leader (“the Leader”) alleging that the DIC was abusing a dominant position by: launching the Drogheda Independent Weekend Extra (“the Extra”) in 1997, selling advertising below cost since 1997, and selectively discounting the price of advertising in the Extra during January and February 2003. The Authority rejected the first two of these allegations on the basis that the DIC’s actions could not plausibly be considered as predation and the theory of predation was inconsistent with market facts. The Authority therefore only outlines in detail its analysis of the allegation of below cost selling of advertising space in the Extra during early 2003 in this decision note. The Authority considers that the relevant market in which the DIC competes is the market for advertising in local newspapers in the greater Drogheda area.

The aim of this thesis is to illustrate the impact of partition on the border counties of Cavan and Monaghan in the period 1914 to 1926. Partition had a profound impact on this region in political, economic and social terms. People from all walks of life in the region were adversely affected by the partition of Ireland which was brought about by the Government of Ireland Act of December 1920. The period 1914-1920 which witnessed the imposition of partition was extremely fraught in Cavan and Monaghan as tensions mounted between nationalists and unionists over the regions future. This work examines these tensions and shows how sectarian animosities built up in the region.

Chapter 1- Introduction INTRODUCTION TO REPORT 1.1 In March of 2008, the then Minister for Enterprise, Trade and Employment, Micheál Martin T.D., announced the establishment of an advisory group (the Group) to review the current legislative framework regarding the public interest aspects of media mergers in Ireland. This review was undertaken in the context of a wider review taking place on the operation and implementation of the Competition Act 2002. 1.2 The Group was asked to examine the provisions of the Competition Act 2002 in relation to media mergers and in particular the “relevant criteria” specified in the Act, by reference to which the Minister currently considers media mergers. 1.3 The Terms of Reference of the Group were:- To review and to consider the current levels of plurality and diversity in the media sector in Ireland. To examine and review the “relevant criteria” as currently defined in the Act. To examine and consider how the application of the “relevant criteria” should be given effect and by whom. To examine the role of the Minister in assessing the “relevant criteria” from a public interest perspective and the best mechanism to do so. Dated 9 October 2019 Introduction 1. On 9 May 2019, in accordance with section 18(1)(b) of the Competition Act 2002, as amended (the “Act”), the Competition and Consumer Protection Commission (the “Commission”) received a notification of a proposed acquisition whereby Mediaforce (Holdings) Limited through Formpress Publishing Limited (“Formpress”) would acquire certain business assets of Midland Tribune Limited (“Midland Tribune”) from Alpha Publications Limited (“Alpha Publications”)1 (the “Proposed Transaction”). 2. Given that both Formpress and Midland Tribune carry on a “media business” within the State (as defined in section 28A(1) of the Act), the Commission considers that the Proposed Transaction constitutes a “media merger” for the purposes of Part 3A of the Act.
