AFFIDAV MICH E .BAD N .D I, Michael M. Baden, M.D., hereby declares under penalty of perjury as follows: 1. I am a physician licensed t0 practice medicine in New York State, Board- certified in Anatomic Pathology, Clinical Pathology and Forensic Pathology, a former Chief Medical Examiner of New York City and the former Chief Forensic Pathologist for the New York State Police. Attached hereto as Exhibit A is a copy of my curriculum vitae. 2. I have reviewed the 1993 autopsy report, scene and autopsy photographs, photographs of sneakers recovered from Mr. Ledell Lee, the Arkansas State Crime Laboratory reports, the FBI laboratory report, the serology report and the trial testimonies of Dr. William Sturner, Mr. Kermit Channel and Mr. Berwin Monroe which were provided to me in the case of State ofArkansas v. Ledell Lee, No. CR-96-0553 relative to the death of Mrs. Debra Kay Reese. 3. The cause of Mrs. Reese’s death was attributed to “Craniocerebral trauma with multiple skin and soft tissue lacerations,” fractures of the nose, right zygoma, large laceration of the skin of the right forehead, and fracture of the right cricoid cartilage with hemorrhage into the muscles of her neck. She was struck on the head multiple times with a blunt object and was strangled. There were also "bruises of the knuckles of both hands." 4. A transfer imprint pattern and adjacent orbital laceration and nasal laceration are present on Mrs. Reese’s right cheek. (State‘s Exhibit 60; LL-009453] 5. The underlying nasal bone, and the adjacent zygomatic bone, which is a very strong bone, are fractured which required a very forceful impact directly to the right cheek 6. The injury pattern is not consistent with having been inicted by a blow from the small wooden smooth bat recovered at the scene. [State’s Exhibit 60; LLv-009432] 7. The injury pattern is not consistent “with force being applied from elsewhere, the top or sides of the head" that pressed her right cheek against the soft rug as testified to at trial. [R2259]. Such force would be insufficient to fracture the zygoma bone, there was no corresponding impact force on the top or sides of her head, and the rug pattern is inconsistent with the skin imprint. 8. The skin imprint and zygoma are consistent with having been inicted by footwear that was stomped directly onto Mrs. Reese’s exposed right cheek as she lay on the oor 9. The injury pattern on Mrs. Reese’s face is not consistent with having been inflicted by the sneakers recovered from Mr. Lee. The soles of Mr. Lee’s sneakers have a much more closely spaced and more solid linear pattern than was transferred in the cheek imprint. 10. The injuries to Mrs. Reese’s head and neck, fracture of her cricoid cartilage, and bruises to her hands demonstrate that she was physically resisting while she was manually strangled which would cause close physical contact and result in the transfer of blood from Mrs. Reese onto the skin and clothes of the assailant. 11. Additional transfer of Mrs. Reese’s blood onto the perpetrator’s skin and clothing would have occurred when her body was lifted onto the bed with blood dripping from the multiple head lacerations. 12. The many injuries Mrs. Reese incurred during the close contact with her assailant would have transferred considerable amounts of blood onto the skin and clothing of the perpetrator. The presence of only a single “pinhead in size, very, very small" drop of blood described by the State serologist as being present on the tongue of each of Mr. Lee’s shoes, and the absence of any blood on Mr. Lee’s t-shirt or jeans, are inconsistent with these items having been worn by the person who committed this murder. new meats Michael M.
