APPROVING LOCAL AGENCY AGREEMENT FOR THE JURISDICTIONAL TRANSFER OF ANDERSON ROAD FROM ILLINOIS ROUTE 38 TO PRAIRIE VALLEY STREET FROM THE VILLAGE OF ELBURN TO THE COUNTY OF KANE
WHEREAS, the Illinois Constitution of 1970, Article VII , Section 10 and the Illinois Compiled Statutes (5 IL9S 220/1 et seq.) authorizes the Village of Elburn (Village), the County of Kane (County) and the State of Illinois, acting through its Department of Transportation (lOOT) iO cooperate in the performance of their respective duties and responsibilities by contracts and other agreements; and
WHEREAS, the Village has exclusive jurisdiction over Anderson Road and desires to transfer exclusive jurisdiction of Anderson Road from Illinois Route 38 to Prairie Valley Street in its entirety to the County under the terms and conditions as set forth in the Local Agency Agreement for Jurisdictional Transfer (a copy of which is on file with the Kane County Clerk); and
WHEREAS, the County and the Village by County Board Resolution No. 12-137, previously entered into an agreement dated May 11, 2012 to facilitate the construction of Anderson Road Extended including a bridge over the Union Pacific Railroad tracks and the METRA coach yard east of Elburn, Illinois; and
WHEREAS, the jurisdictional transfer of Anderson Road is required in order to accomplish the construction of Anderson Road Extended; and
WHEREAS, the County desires to accept exclusive jurisdiction of Anderson Road from Illinois Route 38 to Prairie Valley Street pursuant to the aforementioned agreements.
NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane accept exclusive jurisdiction of Anderson Road from Illinois Route 38 to Prairie Valley Street from the Village of Elburn and that the County Board Chairman is hereby authorized to execute jurisdictional transfer agreement and any other documents necessary to accomplish the same; said jurisdictional transfer shall be effective in accordance with the Local Agency Agreement for Jurisdictional Transfer executed by the County of Kane, the Village of Elburn and the Illinois Department of Transportation.
BE IT FURTHER RESOLVED that upon Illinois Department of Transportation approval, the above highway location, identified as Anderson Road from Illinois Route 38 to Prairie Valley Street be permanently added to the highway system of Kane County as County Highway 85. ..

NOW THEREFORE IT IS AGREED that the corporate authority of said municipality will pass an ordinance providing for the transfer of the above location and shall attach hereto and make a part thereof a copy of the ordinance, and Include for Counties Only WHEREAS, the authority to make changes to the County Highway System is granted to the County by Section 5-105 of the Illinois Highway Code. NOW THEREFORE IT IS AGREED that the County Board of said County will pass a resolution providing for the transfer of the above location and shall attach hereto and make a part thereof a copy of the resolution, and Include for Township/Road Districts Only WHEREAS, the authority to make changes to the Township Road District System is granted to the Highway Commrssioner under Section 6-201 .3 of the Illinois Highway Code.
The Conveyor Agrees to prepare a map of the above location and attach a copy of such location map hereto.
