Minutes of the regular session of Municipal Council held on November 20, 2007, in the Council Chambers of the Municipal Administration Building, Annapolis Royal, NS, at 10:00 a.m.

MOTION 071120.01 Minutes: October 16-07 Regular Session It was moved by Councillor McWade, seconded by Councillor Connell, that the minutes of the regular session of Council held on October 16, 2007, be approved as circulated. Motion carried unanimously.

Additions to the Addendum The following additions to the addendum were approved by consensus: NT1(A) Valley Waste-Resource Management Authority-Solid Waste Association of North America 2007 Professional Achievement/Life Member Award; NT2(A) Southshore/Valley Recreation Trail Association – Update; and NT4(B) Canada Post – Future Postal Service in Springfield; NT4(C) Lifeplex Leases – Update; and NT4(D) Peopleworx Employer of Choice Initiative – Letter of Support.

Re: Municipal Bylaw Amendments: Proposed C10 Annapolis County Police Advisory Board – The Municipal Clerk informed that the draft wording of the bylaw is being reviewed by the Departments of Justice and Service Nova Scotia and Municipal Relations as well as the Municipal Solicitor.

MOTION 071120.02 Municipal Bylaws: C10 Annapolis County Policy Advisory Board – 2nd Reading Tabled to December Council Session Upon motion of Councillor Terauds, seconded by Councillor Fowler, it was resolved that consideration of 2nd reading of the proposed C10 Annapolis County Police Advisory Board Bylaw be tabled to the December 18-07 session of Municipal Council. Motion carried unanimously.

Re: Celebrate Canada‟s First Democracy (250 Years)-Promotional Brochures – A letter dated October 23rd was received from Celebrate Canada‟s First Democracy, enclosing promotional brochures.

Re: Annapolis Valley Regional School Board-Bus Stop in Paradise – Council received a letter dated October 19th from the Superintendent of Schools advising that they are prepared to drop off students at an existing stop located 200 metres closer to the Jack and Jill Daycare Centre. Warden Newton informed that pursuant to the direction at Committee of the Whole, a letter has been forwarded requesting the attendance of appropriate representatives from the School Board to attend either this session or the December Committee of the Whole meeting to discuss this matter. Councillor Anderson moved, seconded by Councillor Connell, to receive same for information. Motion carried unanimously.

 Monthly Report – The Municipal Solicitor reported verbally on the following matters: o Hanse Society/Upper Clements Mortgage – Perusal of letter from Society‟s counsel and phone conference. o Mann Request for Response – Conference with Clerk regarding response. o Dog Bylaw Enforcement (Ferocious Dog at Gould’s Garage, Wilmot) – Phone conference with Clerk. o Youngs Cove Property – Receipt of duly executed Grant, recording same and sending original to CAO. o Property Evaluation – receipt and perusal of appraisal report.

MOTION 071120.03 Monthly Report of Municipal Solicitor It was moved by Councillor Vitiello, seconded by Councillor Trimper, that the monthly report of the Municipal Solicitor be accepted. Motion carried unanimously.

Re: Committee of the Whole (November 16th Meeting)

 Municipal Property: Former Parker’s Cove School, Release of County Interest - The CAO informed that he consulted with the Municipal Solicitor who advised that the $10,000 purchase price would be considered market value (in view of the condition of the building, the demonstration of appropriate use and significant investment by the owners) and a release would be appropriate.

MOTION 071120.04 Municipal Property: Parker’s Cove School, Release of County Interest Pursuant to the recommendation of Committee of the Whole; Deputy-Warden Ritchie moved, seconded by Councillor Terauds, that Municipal Council authorize the Municipal Solicitor to prepare a release of the County‟s first option to purchase this property and authorize the Warden and Clerk to sign necessary documentation.

 Community Recreation Grant Program

MOTION 071120.05 CRGP: Community Club of Clementsport ($500) In accordance with the recommendation of Committee of the Whole and Staff recommendation; Deputy-Warden Ritchie moved, seconded by Councillor McWade, that Municipal Council approve a grant in the amount of $500 (for a project totalling $1,598) to the Community Club of Clementsport from the 2007-08 Community Recreation Grant Program. Motion carried unanimously.

MOTION 071120.06 CRGP: Litchfield/Delaps Cove Community Hall ($500) As recommended by Committee of the Whole and Staff; Deputy-Warden Ritchie moved, seconded by Councillor Vitiello, that Municipal Council approve a grant in the amount of $500 (for a project totalling $3,000) to the Litchfield/Delaps Cove Community Hall from the 2007-08 Community Recreation Grant Program. Motion carried unanimously.

MOTION 071120.07 CRGP: West Paradise Community Hall ($500) Pursuant to the recommendation of Staff and Committee of the Whole; it was moved by Deputy-Warden Ritchie, seconded by Councillor Fowler, that Municipal Council approve a grant in the amount of $500 (for a project totalling $4,100) to the West Paradise Community Hall from the 2007-08 Community Recreation Grant Program. Motion carried unanimously.

 Supplementary Budget Estimates (5-Year Capital Budget)

MOTION 071120.08 Supplementary Budget Estimates: Annapolis Valley Exhibition ($39,000) In accordance with the recommendation of Committee of the Whole; Deputy-Warden Ritchie moved, seconded by Councillor Milo, that approval be given to revise Year 1 of the 2007-08 to 2011-12 Five-Year Capital Budget to include the supplementary capital budget estimate of $39,000 to provide an approval of a capital pledge grant to the Annapolis Valley Exhibition in view of special circumstances to be allocated from the Recreation & Culture Account Operating Reserve. Motion carried unanimously.

MOTION 071120.09 Supplementary Budget Estimates: Oakdene Community Centre (up to $12,712) As recommended by Committee of the Whole; it was moved by Deputy-Warden Ritchie, seconded by Councillor McWade, that approval be given to revise Year 1 of the 2007-08 to 2011-12 Five-Year Capital Budget to include the supplementary capital budget estimate of up to $12,712 to provide an approval of a capital pledge grant for the Oakdene Community Centre in view of special circumstances to be allocated from the Recreation & Culture Account Operating Reserve, subject to an application to Nova Scotia Health Promotion and Protection for provincial funding to reduce the County‟s cost sharing. Motion carried unanimously.

 Nictaux & District Volunteer Fire Department ($31,000 Debenture Payment)

MOTION 071120.10 Nictaux & District Volunteer Fire Dept. ($31,000 Debenture Payment) Pursuant to the recommendation of Committee of the Whole; Deputy-Warden Ritchie moved, seconded by Councillor Trimper, that Municipal Council authorize the Treasurer to accept a $31,000 lump sum payment from the Nictaux & District volunteer Fire Department and to repay the Nova Scotia Municipal Finance Corporation debenture principal of $15,500 on May 17th in each of 2008 and 2009 and debenture interest of $833.10 on May 17, 2008, and $416.55 on November 17, 2008, and May 17, 2009, from the general operating fund. Motion carried unanimously.

 Annapolis Royal Volunteer Fire Department ($26,000 Loan)

MOTION 071120.11 Annapolis Royal Volunteer Fire Dept. ($26,000 Loan) In accordance with the recommendation of Committee of the Whole; Deputy-Warden Ritchie moved, seconded by Councillor Anderson, that Municipal Council authorize a payment of $26,000 from the Fire Services Reserve Fund to the Operating Reserve Fund for loan principal on behalf of the Annapolis Royal Volunteer Fire Department. Motion carried unanimously.

 RCMP Community Program Officer

MOTION 071120.12 RCMP Community Program Officer As recommended by Committee of the Whole; it was moved by Deputy-Warden Ritchie, seconded by Councillor Vitiello, that the Council of the Municipality of the County of Annapolis approve the establishment of a one-year, term position for an Annapolis RCMP Community Program Officer as provided for in the 2007-08 Operating Fund Estimates, and authorize the CAO to execute a Memorandum of Understanding formalizing the employment and supervisory conditions for this project. Motion carried unanimously.

 Premier’s Award: Support Nomination of Nova Scotia Historic Places Initiative

MOTION 071120.13 Premier’s Award: Support Nomination of Nova Scotia Historic Places Initiative Pursuant to the recommendation of Committee of the Whole; Deputy-Warden Ritchie moved, seconded by Councillor Wilkins, that the Municipality of the County of Annapolis forward a letter co-signed by the Warden and Chair of the Heritage Advisory Committee supporting the nomination of the Nova Scotia Historic Places Initiative for the Premier‟s Award in the category of client service delivery/relationship building.

 Heritage Registered Property: Old Troop Barn, Granville Centre

MOTION 071120.14 Heritage Registered Property: Old Troop Barn, Granville Centre As recommended by Committee of the Whole and in view of the structural assessment report which indicated significant costs would be required to stabilize and preserve the Old Troop Barn; it was moved by Deputy-Warden Ritchie, seconded by Councillor Wilkins, that Municipal Council to advise the property owner the Municipality will not be proceeding with acquiring the property and to request permission to make a photographic record. Motion carried unanimously.

 Sidewalk Winter Maintenance, Paradise – Tender Not Accepted

MOTION 071120.15 Sidewalk Winter Maintenance, Paradise – Tender Not Accepted In accordance with the recommendation of Committee of the Whole, it was moved by Deputy-Warden Ritchie, seconded by Councillor McWade, that Municipal Council not accept the tender received for providing winter maintenance for the Paradise sidewalk. Motion carried unanimously.

Re: Nominating Committee (November 20th Meeting)

 2006-08 Citizen Appointments to Standing & Special Committees of Council

MOTION 071120.16 2006-08 Citizen Appointment – Planning Advisory Committee In accordance with the recommendation of the Nominating Committee; Councillor Wilkins moved, seconded by Deputy-Warden Ritchie, that Mr. Gary Mailman be appointed on an interim basis to the Planning Advisory Committee effective immediately with the term to expire November 30, 2008. Motion carried unanimously.

 2007-08 Councillor Appointments to Standing & Special Committees of Council

MOTION 071120.17 2007-08 Councillor Appointments to Standing & Special Committees Pursuant to the recommendation of the Nominating Committee; Councillor Wilkins moved, seconded by Councillor Connell, that the 2007-08 appointments of Councillors to Standing and Special Committees of Council be approved as attached. Motion carried unanimously. See Schedule A to the minutes.

Other Business:

Re: Clam Industry Issue – A letter dated October 19th was received from the Minister of Fisheries and Aquaculture, advising that since the clam licenses and leases have already been issued, Departmental Staff will endeavour to forward future questions about the lessee‟s business planning or operational matters to Innovative Fishery Products Incorporated and the County can choose to contact them directly. Council also received the letter dated September 27th which was forwarded to the Minister requesting a Page 4 of 9 SCHEDUDLE A Council Minutes November 20, 2007 corresponding numbered response to detailed questions, noting that a response from the Department is required rather than the Lessee in view of the Province‟s role as a trustee of natural resources on behalf of the residents of Nova Scotia. Councillor Vitiello informed that he had been advised by Departmental Staff that in a meeting answers were provided to the stakeholders‟ questions and the Department will respond to specific questions of the Municipality. Staff informed that both the Annapolis Watershed Resource Committee and Clean Annapolis River Project have indicated they have not received a response to their questions/concerns.

MOTION 071120.18 Clam Industry Issue – Response from the Minister Upon motion of Councillor Vitiello, seconded by Councillor Connell, it was resolved that the letter from the Minister of Fisheries & Aquaculture regarding the clam industry issue be accepted for information. Motion carried unanimously.

The Warden indicated that he will respond to the Minister regarding two to three specific issues, and it was the consensus that the matter of receiving an appropriate response be discussed with the MLAs for the region.

New Business:

Re: Municipal Bylaws: Addition to M5 Full Tax Exemption Bylaw – Council was advised that Staff is recommending the addition of a property which meets the criteria for full tax exemption status.

MOTION 071120.19 Municipal Bylaws: Addition to M5 Full Tax Exemption Bylaw As recommended by Staff; Councillor Connell moved, seconded by Councillor Anderson, that first reading be given to amend M5 Full Tax Exemption Bylaw by adding the following property listing inclusive of all area rates effective April 1, 2007:

Re: FCM Members Advisory: Municipal Partnership Program – The foregoing Advisory dated November 1st advising of the opportunity to participate in a 2.5 year partnership with Mtwara Mikindani Municipality with the aim of improving municipal affairs managements and community services. It was moved by Councillor Vitiello, seconded by Councillor Wilkins, that the Advisory be received for information. Motion carried unanimously.

Re: National Defence: Municipal Approval of Wind Turbines – A letter dated November 1st was received from Major J.D. Tromp advising that in order to ensure the potential impact of a proposed wind turbine project is evaluated with respect to their operations, he requested that any application to locate a wind turbine project within 10 kms of the Greenwood airfield or within 60 kms of the Stronach Mountain air traffic control radar be reviewed by National Defence staff prior to the Municipality providing any approvals.

MOTION 071120.20 National Defence: Impact of Wind Turbine Projects-14 Wing Greenwood Upon motion of Councillor Vitiello, seconded by Councillor Milo, it was resolved that this matter be referred to Staff to confirm zoning requirements of National Defence and

report back at a future meeting, with a copy of the foregoing letter to be forwarded to the East End Area Advisory Committee. Motion carried unanimously.

Re: Proclamation of November as “CPR Awareness Month” – An email sent October 12th was received from the Heart and Stroke Foundation of Nova Scotia requesting Council‟s consideration to proclaim November as “CPR Awareness Month”. Councillor Fowler moved, seconded by Councillor Wilkins, that the foregoing be received for information. Motion carried unanimously.

Correspondence:

Re: Card of Appreciation from A/A Carolyn Young – A card of thanks was submitted by Administrative Assistant Carolyn Young for the flowers and Campbell Photograph in recognition of her successful completion of the National Advanced Certificate in Local Authority Administration Level II. The CAO publicly recognized the effort of Ms. Young to complete a very rigorous and comprehensive program. Deputy-Warden Ritchie moved, seconded by Councillor Milo, that the foregoing correspondence be received for information.

Annual Report:

Re: Kings Transit Authority Annual Report – General Manager Ron Mullins presented the annual report for the Kings Transit Authority, with the following being highlighted: o Bus Route – Ridership was 24,608 producing revenues of $55,866 (exceeding budget figures of 22,630 and $47,791 respectively). o Annapolis East Bus Route - Ridership was 47,649 producing revenues of $134,887 (which compares to budget figures of 61,533 and $128,404 respectively). o Items since year end - received new El Dorados in July. - faced construction delays (Brickton Bridge and Coldbrook). - New Hants County service started September 4th. - New route brochures being worked on. - recently issued a request for proposals for video surveillance cameras for our buses. - recently issued a request for proposals for new feeder buses being allocated to Hants County (anticipated arrival in next couple of weeks). - security an issue new at the Bridgetown Public Works garage (two recent break-ins). The CAO noted that the ARC site is being evaluated as an alternative. - creating a Disability Advisory Group to assist riders with special needs.

The CAO also provided the following update: 1. Staff is working on a new management agreement which will be presented at a future meeting; 2. the Annapolis West route will continue to travel to Weymouth; and 3. a retired County-owned bus will be provided to Kings Transit at a residual cost of $1,000 (to be used for spare parts).

After a brief question-and-answer period, Councillors conveyed congratulations on a successful program.

Re: Annapolis County Active Living Strategy & Club 400, 2007 RNS Mayflower Community Cooperation Award – Recreation Coordinator Debra Ryan and Active Living Coordinator Andre Bouchard provided the following update on the Annapolis County Active Living Strategy and Club 400 Program: o Challenge of Physical Inactivity – 2 million deaths every year, 2 times the risk of cardiovascular disease, stroke, diabetes and obesity. Increased risk of some cancers and mental health problems. o Physical Activity & Healthy Eating – Could prevent 80% of high cholesterol, ½ of cancers, and 60% of Type II diabetes. It would result in physical, mental and social benefits. o Annapolis County Recreation Interests Study 2004 – Walking identified as #1 interest. Concern noted that attention is needed for youth activities. 60% who were satisfied with their level of activity were not active enough. o Strategy Components – Included are Policy & Program Development, Community Mobilization, Active Community Environments, Public Awareness & Social Marketing and Evaluation & Monitoring. o Enhance Public Health – Must activate „couch potatoes‟ and engage in 30 minutes of moderate activity most days of the week. o Environment Role – Components to enhance active healthy living include policy development and Active Community Environments.

MOTION 071120.22 Active Living Strategy & Club 400 Report and Community Cooperation Award Upon motion of Councillor Connell, seconded by Councillor Fowler, that the report on the Active Living Strategy & Club 400, with commendation to Staff for receiving the 2007 Mayflower Community Cooperation Award. Motion carried unanimously.

Addendum Items:

Re: Valley Waste-Resource Management Authority-Solid Waste Association of North America 2007 Professional Achievement / Life Member Award – Deputy-Warden Ritchie informed that at a recent conference the General Manager for VWRM was recognized for his contribution to the Solid Waste Association of North America and professional achievement. Motion carried unanimously.

MOTION 071120.23 VWRM: Congratulations to General Manager for Professional / Life Award Deputy-Warden Ritchie moved, seconded by Councillor Milo, that a letter of congratulations be forwarded to Ross Maybee, General Manager of the Valley Waste- Resource Management Authority for receiving the Solid Waste Association of North America 2007 Professional Achievement/Life Member Award. Motion carried unanimously.

Re: Southshore / Annapolis Valley Recreational Trails Association – Councillor Terauds provided the following update: o the New Germany to Springfield trail (mostly CN railline) has been initiated with $42,000 being received. o the Davidson Mill Trail (about 34 kilometres from Springfield to Nictaux Falls) has received $160,000 from partners towards a project estimated at $200,000 with a completion date in 2009. o Crossburn Snowmobile Conferences are doing a $25,000 rebuild of the bridge in Middleton which should be finished in the Spring 2008. o Rick Jakes has been hired as the Annapolis County Recreation Trails Coordinator. o Challenges still remain regarding potential liabilities and land-use conflicts in populated areas.

Re: Annapolis Valley Recreation Trails Society – Councillor Connell reported that the Society has completed the guard rail trail system in the Town of Middleton which took approximately 1.5 years to finish (from Kings County line to Brickton). He noted it was likely that the next project would take place in the Annapolis Royal area.

Re: Town of Bridgetown, Joint New Year‟s Levee 2008 – Council received a letter dated November 1st from the Town of Bridgetown extending an invitation for the County to participate in a joint New Year‟s Levee at the Bridgetown Legion. Deputy-Warden Ritchie moved, seconded by Councillor Vitiello, that this correspondence be received for information. Motion carried unanimously.

Re: Canada Post: Postal Service in Springfield Area – Councillor Terauds reported that the Post Master in Springfield is retiring in July 2008 after 25 years of service and the community has concerns that this position and current post office will be eliminated.

MOTION 071120.24 Canada Post: Postal Service in Springfield Area Councillor Terauds moved, seconded by Councillor McWade, that:

Whereas the Canada Post Corporation is owned by and responsible to the Government of Canada;

And Whereas the Government of Canada issued an indefinite moratorium on rural Post Office closures in 1994;

And Whereas the Government of Canada reconfirmed their commitment to rural postal service on August 25, 2005, in the following statement issued by the Hon. John McCallum, “I can state definitively that, if there is a post office in your community today, it will continue to be there into the future”;

And Whereas the management of the Canada Post Corporation is currently having to consider options regarding the Springfield post office on a permanent basis and may be considering closing this office;

And Whereas the Springfield Post Office provides a vital facility and function to this remote community.

Therefore Be It Resolved that the Council for the Municipality of the County of Annapolis demand that the Government of Canada order the management of the Canada Post Corporation to immediately abandon any consideration to close rural Post Offices and the Government of Canada order the management of the Canada Post Corporation to immediate action to appoint a permanent postmaster in the Community of Springfield to create a succession and continuity of the service “into the future”.

It was moved by Councillor Terauds, seconded by Councillor McWade, that a survey be designed to be circulated in the Springfield area to confirm the community‟s commitment. Motion carried unanimously.

Re: Lifeplex Lease and Rental Option – The CAO informed that negotiations will be proceeding with a professional to rent a small office area for a one-year lease in the mall (former campaign office.) It was the consensus that the CAO proceed to negotiate this lease. He also requested Council‟s consideration to look at other retail usages for the area previously identified for a pharmacy (which could take 2 to 3 years or more). It was the consensus that the CAO proceed at his discretion.

Re: Property with Outstanding Taxes – The CAO noted that there are several properties which could be considered for sale at a purchase price other than outstanding taxes and costs whereas there was no interest expressed in such property at the last tax sale.
