Her dissertation focuses on human rights in health care, specifically: the right to health, freedom of religion and the prohibition on discrimination. Her position at the Faculty of Law at Uppsala University involves research and teaching in the field of medical law, social rights law, administrative law, and human rights law. She is also a Course Director for a Medical Law course at the Faculty of Law and responsible for a course on freedom of religion in secular and religious cultures at the Faculty of Theology in Uppsala. Since 2014 she has been teaching a summer course, together with Santa Slokenberga, at the Summer Institute in Bioethics at Yale University on comparative human rights and health. Jameson Garland holds a doctoral degree in Medical Law from Uppsala University, as well as a Juris Doctor in Law from Harvard University, where he was also a Fellow at the Center for the History of Medicine. His primary scholarly work in medical law currently focuses on science, evidence, and its relationship to pediatric medicine. His dissertation focused on the

Marcum ABSTRACT Although biomedicine is responsible for the “miracles” of modern medicine, paradoxically it has also led to a quality-of-care crisis in which many patients feel disenfranchised from the health-care industry. To address this crisis, several medical commentators make an appeal for humanizing biomedicine, which has led to shifts in the philosophical boundaries of medical knowledge and practice. In this paper, the metaphysical, epistemological, and ethical boundaries of biomedicine and its human - ized versions are investigated and compared to one another. Biomedicine is founded on a metaphysical position of mechanistic monism, an epistemology of objective knowing, and an ethic of emotionally detached concern. In humanizing modern medicine, these boundaries are often shifted to a metaphysical position of dualism/holism, an episte - mology of subject knowing, and an ethic of empathic care. In a concluding section, the question is discussed whether these shifts in the philosophical boundaries are adequate to resolve the quality-of-care crisis. Engel At a recent conference on psychiatric education, many psychiatrists seemed to be saying to medicine, “Please take us back and we will never again deviate from the ‘medical model.’” For, as one critical psy- chiatrist put it, “Psychiatry has become a hodgepodge of unscientific opinions, assorted philosophies and ‘schools of thought,’ mixed meta- phors, role diffusion, propaganda, and politicking for ‘mental health’ and other esoteric goals” (1). In contrast, the rest of medicine appears neat and tidy. It has a firm base in the biological sciences, enormous technologic resources at its command, and a record of astonishing achievement in elucidating mechanisms of disease and devising new treatments. It would seem that psychiatry would do well to emulate its sister medical disciplines by finally embracing once and for all the medical model of disease. But I do not accept such a premise. Rather, I contend that all medicine is in crisis and, further, that medicine’s crisis derives from the same basic fault as psychiatry’s, namely, adherence to a model of disease no longer adequate for the scientific tasks and social responsibilities of either medicine or psychiatry. The importance of how physicians conceptualize disease derives from how such con- cepts determine what are considered the proper boundaries of pro- fessional responsibility and how they influence attitudes toward and behavior with patients. Psychiatry’s crisis revolves around the ques- tion of whether the categories of human distress with which it is con- cerned are properly considered “disease” as currently conceptualized and whether exercise of the traditional authority of the physician is Reprinted with permission.

Naming the Subject The designation “Biomedicine” as the name of the professional medicine of the West emphasizes the fact that this is a preeminently biological medicine. As such, it can be distinguished from the professional medicines of other cultures and, like them, its designation can be considered a proper noun and capitalized. The label Biomedicine was for these reasons conferred by Gaines and Hahn (1985) on what had variously been labeled “scientific medicine,” “cosmopolitan medicine,” “Western medicine,” “allopathic medicine” and simply, “medicine” (Engel 1980; Kleinman 1980; Leslie 1976; Mishler 1981). “Medicine” as a label was particularly problematic: it effectively devalued the health care systems of other cultures as "non-medical," “ethnomedical,” or merely “folk”--and thus inefficacious--systems based on “belief” rather than presumably certain medical “knowledge”(Good 1994). The term "allopathic" is still often employed as it designates the biomedical tradition of working “against pathology,” wherein the treatment is meant to oppose or attack the disease as directly as possible. In contrast, “homeopathic” derives from the Greek homoios--“similar or like treatment”--and pathos (suffering, disease). In this model, medicines produce symptoms similar to the illnesses that they are intended to treat. Today, the designation Biomedicine is employed as a useful shorthand more or less ubiquitously in medical anthropology and other fields (though often it is not capitalized).
