MEDIA POLICY AND FREE SPEECH: THE FIRST AMENDMENT AT WAR WITH ITSELF Ellen P. Goodman* I. INTRODUCTION A symposium on “reclaiming” the First Amendment for media policy begs the question from what and whom the First Amendment must be reclaimed. Who has it and what are they doing with it? Since we also gather to commemorate the fortieth anniversary of Jerome Barron’s watershed article, Access to the Press ,1 I consider these questions as they relate to his aspirations for a more pluralistic system of communication. 2 Media policy, as I define it, consists of regulatory interventions specifically designed to promote communicative opportunities. Communications and copyright law are the federal government’s two principal tools in this project. 3 Such an expansive definition of media policy is not uniformly accepted today and certainly would not have been in 1967 when Access to the Press was published. Then, media policy was virtually coextensive with broadcast regulation. The comprehensive system of subsidies at the federal level for noncommercial media had only just begun with the passage of the Public Broadcasting Act that same year. 4 The regulation of mere communications carriers, like telephones, was thought to have little to do with speech. The Battle Over the FCC Blue Book: Determining the Role of Broadcast Media in a Democratic Society, 1945–8 Abstract During the 1940s a media reform movement of grassroots activists and a progressive Federal Communication Commission (FCC) emerged to challenge the commercial interests consolidating control of US media. A key initiative born out of this movement was the so-called Blue Book, a high-water mark for FCC progressive activism that mandated social responsibility obligations for broadcasters in return for their use of the public airwaves. Ultimately, red-baiting tactics defeated the policy initiatives outlined in the Blue Book and the media reform movement was largely contained. Media Ownership Regulation, the First Amendment, and Democracy’s Future Adam Candeub* Unprecedented consolidation has swept the media industries. At the same time, court rulings have savaged the Federal Communication Commission’s (FCC) limits on corporate control of radio, television, and newspapers, leading to stacks of proceedings languishing at the FCC. These rulings have fomented a vocal political struggle between consumer groups advocating ownership restrictions and the media industry pressuring for deregulation. This Article argues that the FCC’s regulations have failed because they have misconstrued their goal, viewing media ownership as a sort of antitrust law for the “marketplace of ideas.” The FCC attempts to find the “optimal number” of independently owned media outlets, which it assumes will create a sufficient diversity of voices and viewpoints. As this Article shows, using this antitrust metaphor to guide policy confuses social and economic goals, creating an incoherent regulatory standard ripe for judicial reversal. Rather than attempting to identify the optimal number of media outlets, the FCC should strengthen the vital function the media plays in a democratic society: decreasing citizens’ costs in monitoring government. Introduction 1.1 What is media regulation? The `media' whose regulation I am discussing are the public means of mass communication, especially the press, radio and television, but also including film and recorded music as well as a number of newer means of distribution by way of cable, satellite, discs, tapes, etc. Of increasing importance is the internet, which can now be regarded as a `mass medium' in its own right on the grounds of its gradual diffusion to majorities in many countries and its use for a number of public communication functions in the sphere of both entertainment and information. The boundary between public and private communication is an important one from the point of view of regulation, but it is much less easy to identify than in the past, especially in relation to the internet which serves as means of personal communication as well as a means of dissemination and form of publication. To some extent, the same applies to mobile phones. Regulation refers to the whole process of control or guidance, by established rules and procedures, applied by governments and other political and administrative authorities to all kinds of media activities. Thus regulation is always a potential intervention in ongoing activities, usually for some stated “public interest” goal, but also to serve the needs of the market (for instance, by supporting competition) or for reasons of technical efficiency (for instance, setting technical standards).
