The legal outcomes the Gunditjmara achieved in the 1980s are often overlooked in the history of land rights and native title in Australia. The High Court Onus v Alcoa case and the subsequent settlement negotiated with the State of Victoria, sit alongside other well known bench marks in our land rights history, including the Gurindji strike (also known as the Wave Hill Walk-Off) and land claim that led to the development of land rights legislation in the Northern Territory. This publication links the experiences in the 1980s with the Gunditjmara’s present day recognition of native title, and considers the possibilities and limitations of native title within the broader context of land justice. The purpose of the field trips was to document the languages and songs of the Madhi Madhi, Parnkalla, Kurnai, Gunditjmara, Yorta Yorta, Paakantyi, Ngarigo, Wemba Wemba and Wergaia peoples. -

Queensland II’s1 recognition of Indigenous peoples’ rights to their traditional lands, the jurisprudence of native title has undergone significant development. The High Court of Australia decisions in Ward2 and Yorta Yorta3 in 2002 sought to clarify the nature of native title and its place within Australian property law, and within the legal system more generally. Since these decisions, lower courts have had time to apply them to native title issues across the country. This Article briefly examines the history of the doctrine of discovery in Australia as a background to the delayed recognition of Indigenous rights in lands and resources. -

P129: The Personal Archives of Alfred Reginald RADCLIFFE-BROWN (1881- 1955), Professor of Anthropology 1926 – 1931 Contents Date Range: 1915-1951 Shelf Metre: 0.16 Accession: Series 2: Gift and deposit register p162 Alfred Reginald Radcliffe-Brown was born on 17 January 1881 at Aston, Warwickshire, England, second son of Alfred Brown, manufacturer's clerk and his wife Hannah, nee Radcliffe. He was educated at King Edward's School, Birmingham, and Trinity College, Cambridge (B.A. 1905, M. A. 1909), graduating with first class honours in the moral sciences tripos. He studied psychology under W. H. R. Rivers, who, with A. C. Haddon, led him towards social anthropology. Elected Anthony Wilkin student in ethnology in 1906 (and 1909), he spent two years in the field in the Andaman Islands. A fellow of Trinity (1908 - 1914), he lectured twice a week on ethnology at the London School of Economics and visited Paris where he met Emily Durkheim. At Cambridge on 19 April 1910 he married Winifred Marie Lyon; they were divorced in 1938. Radcliffe-Brown (then known as AR Brown) joined E. L. Grant Watson and Daisy Bates in an expedition to the North-West of Western Australia studying the remnants of Aboriginal tribes for some two years from 1910, but friction developed between Brown and Mrs. Bates. Brown published his research from that time in an article titled “Three Tribes of Western Australia”, The Journal of the Royal Anthropological Institute of Great Britain and Ireland, Vol. 43, (Jan. - Jun., 1913), pp. 143-194. At the 1914 meeting of the British Association for the Advancement of Science in Melbourne, Daisy Bates accused Brown of gross plagiarism. -

Indigenous oral history brings life to our community narratives and portrays so well the customs, beliefs and values of our old people. Much of our present day knowledge system relies on what has been handed down to us generation after generation. Learning through intergenerational exchange this Indigenous oral history research thesis focuses on Indigenous methodologies and ways of being. Prime to this is a focus on understanding cultural safety and protecting Indigenous spoken knowledge through intellectual property and copyright law. From an Indigenous and Wiradjuri perspective the research follows a journey of exploration into maintaining and strengthening ethical research practices based on traditional value systems. The journey looks broadly at the landscape of oral traditions both locally and internationally, so the terms Indigenous for the global experience; Aboriginal and Torres Strait Islander for the Australian experience; and Wiradjuri for my own tribal identity are all used within the research dialogue. ! !
