3 Executive summary

The intent of the Norway North Sea herring fishery to become MSC certified was first announced on 16th October 2007. The scope of certification was and remains up to the point of landing and chain of custody commences from point of landing. The fishery was recertified in 2014 and again on 30th July 2019. The default assessment tree set out in the MSC Fisheries Certification Requirements (FCR), version 2.0, was used for the second re-assessment. The fishery attained a score of 80 or more against each of the MSC Principles and did not score less than 60 against any of the individual MSC Criteria. In the second re-assessment (2019) the fishery achieved a score of below 80 against 1 scoring indicator (PI 1.2.2c) and hence one condition was set for continuing certification of the fishery. The fishery had no recommendations at the last reassessment.

Table 1 provides general information on CAB and Client. The UoC is defined in Table 5. Table 2 shows the principle scores from the recertification of 2019 and Table 3 the change in principle scores.

The status of the condition is: Condition 1 on PI 1.2.2c is On Schedule but the condition is closed at this audit and the issue transferred to Condition 2 due to a harmonization process in 2020 and therefore void. The new condition 2 is a result of the harmonisation of PI 1.2.2a (Harvest control rule).

The fishery remains certified based on this surveillance audit, see Table 4.

The timeline of this surveillance report is in accordance with a Variation Request of 03.02.2021 and MSC response of 18.02.2021 – see appendix 6.6.

The Norway North Sea herring fishery was first certified on 30th April 2009 and recertified in July 2014 and again in July 2019.

This first surveillance audit was carried out as an off-site, remote audit with meetings conducted on 16th February 2021 to 18th February 2021. The client, Ministry of Trade, Industry and Fisheries, the Directorate of Fisheries (DOF) and the Institute of Marine Research (IMR) were interviewed. For details of the audit see chapters 3.2.2 and 6.

The main findings at the surveillance audit were:

- Stock status remains as in previous years - Harvest strategy and harvest control rule remained unchanged - The stock assessment approach remained unchanged - Catch composition remains comparable to previous years - There are only minute records of catches of ETP species - The fishery covered the same grounds as in previous years - The management setup is unchanged - There is 1 condition (PI1.2.2c) that was found to be “On target”. The condition is transferred to Condition 2. Condition 1 is now void. - Rescoring of PI 1.2.2a (HCR) harmonised the score to 65 - Traceability issues are unchanged

3.1 The assessment process

The MSC Fisheries Certification Process v2.2 § 7.5.3 and the MSC- MSCI Vocabulary defines the Unit of Certification (UoC) (i.e., the unit entitled to receive an MSC certificate) as follows:

“The target stock(s) combined with the fishing gear type(s), vessel type(s) if relevant, and the fishing fleets or groups of vessels, or individual fishing operators pursuing that stock including entities initially intended to be covered by the certificate.”

The fisheries covered by this certification are described in Table 5.

3.2 History of the assessment

3.2.1 Summary of previous assessments The intent of the Norway North Sea herring fishery to become MSC certified was announced on 16th October 2007, and the fishery received its initial certification on 30th April 2009. The full assessment was based on an assessment tree defined by the responsible CAB and had four conditions. All conditions from the full assessment are fully met. The scope of MSC Fisheries certification is up to the point of landing and chain of custody commences from the point of landing. Four annual audits were completed during the initial certification period.

The first reassessment of the Norway North Sea herring fishery was announced on 2nd April 2013, and the continued certification of the fishery was confirmed through the release of the reassessment Public Certification Report of 3rd July 2014. The default assessment tree set out in the MSC Certification Requirements (CR) version 1.3 was used for this reassessment. No conditions or recommendations were set for the recertification of the Norway North Sea and Skagerrak herring fishery.

3.2.2 Summary of the second reassessment - 2019

The second reassessment audit was announced on the MSC website on 6th September 2018 followed by a supporting notice to stakeholders issued by MSC on the same date. Direct email notification was also sent to the stakeholders that had previously been identified for this fishery, inviting interested parties to contact the audit team. The default assessment tree set out in the FCR v2.0 was used as basis for this reassessment.

The audit team met with stakeholders on 16th & 17th October 2018 in Bergen and Oslo, Norway. Information was gathered from various stakeholders, including the Norwegian Ministry of Trade, Industry and Fisheries, the Fisheries Directorate, the Institute of Marine Research and the client fishery. It was confirmed that the fishery has developed as in previous years, that there were no changes in the management, control and enforcement and that the fleet changes are reflected in the updated vessel list.

The performance indicators and the relevant scoring systems were evaluated jointly by the assessment team and all scoring was based on unanimous conclusions by the entire team during the scoring meeting which took place in Oslo after the site visit. RBF was not used for this assessment.

The Norway North Sea herring fishery achieved a score of 80 or more for each of the three MSC Principles and did not score under 60 for any of the set MSC criteria. The fishery achieved a score of below 80 against 1 scoring indicator (PI 1.2.2c). A harmonised condition had already been set for this PI in the 4th surveillance audit (see report of 13th December 2018) for continued certification that the client is required to address. The condition is applicable to improve performance to at least the 80 level within the harmonised period set by the assessment team.

The scope of the MSC Fishery certification is up to the point of landing and Chain of Custody commences from the point of landing.

3.2.3 First annual surveillance- Year 2021

The first surveillance audit was announced on the MSC website on 12th January 2021 followed with a supporting notice to stakeholders issued by the MSC on 13.01.2021. Direct email notification was sent on 13th January 2021 to the stakeholders that had previously been identified for the fishery, inviting interested parties to contact the audit team.

The timeline of this surveillance audit has been subject to a 6-month extension due to the Covid 19 derogation of 27 March 2020. In addition to this FCP v2.2 § 7.28.2.1 has also been invoked to deal with the integration of the following audits for the same client:

1. Norway North Sea herring fishery - 1st surveillance audit 2. Norway North East Arctic saithe fishery - 2nd surveillance audit 3. Norway North Sea demersal fisheries – 2nd surveillance audit 4. Norway sandeel, pout & North Sea sprat fishery – 3rd surveillance audit 5. NFA Norway ling & tusk and NFA Norway lumpfish fisheries – 3rd surveillance audit

The off-site activities were held on 16th to 18th February 2021.

The audit was conducted according to MSC Fisheries Certification Process (FCP) version 2.2. The default assessment tree set out in the FCR v2.0 was used.

PI 1.2.2a was rescored as a result of harmonisation activities in April- June 2020 and the existing condition on PI 1.2.2c updated at this surveillance audit, as agreed at the harmonisation and in accordance with FCP v2.2 § 7.29.1.

3.3 Summary of surveillance audit findings

Condition 1 has been transferred to condition 2 as a result of the rescoring of PI 1.2.2a.

Status of the condition for this fishery is detailed in chapter 5.1.1 of this report.

3.4 Conclusion The fishery continues to be within the scope of the MSC fisheries standard (MSC FCP v2.2 § 7.4.2 & 7.12) according to the following determinations: 7.4.2.1: The fisheries do not target, under principle 1, amphibians, reptiles, birds or mammals. 7.4.2.2: The fisheries do not use poisons or explosives. 7.4.2.3: The fisheries are not conducted under a controversial unilateral exemption to an international agreement. 7.4.2.4: The fisheries client has not been prosecuted for forced or child labour violation in the last 2 years. 7.4.2.10: The fisheries client or client group does not include an entity that has been convicted for a shark finning violation in the last 2 years. 7.4.2.11: The fisheries have mechanisms for resolving disputes 7.4.2.12: The fisheries are not enhanced fisheries. 7.4.2.13: The fisheries are not an Introduced species- based fisheries. 7.12: The fishery is within the scope of the MSC Fisheries Standard The main findings of the surveillance audit are: • The fisheries, in 2020, are conducted with the same strategy, same gears and covering the same grounds as in previous years • The fisheries are documented at the same level as in previous years • The stocks remain healthy • Management regulations are unchanged. • Control and Enforcement activities and strategies were unchanged and no significant non-compliance has been reported • Research continues to improve understanding of the biology of fisheries • Traceability issues are unchanged • The assessment for the fishery had 1 condition which was found to be On Target. The condition was transferred to the new condition 2. • PI 1.2.2a was rescored at this surveillance audit. Rescored Performance Indicators are detailed in chapter 5.2 of this report.

There have been no material changes to the status of the target stock, ecosystem impact nor the management system since reassessment. Overall, the fishery continues to be fully compliant with the standards set for MSC certification. The assessment team concludes that the MSC Certificate for the fishery shall remain active, subject to annual surveillance review.

4.2 Background 4.2.1 Stock Status

Spawning-stock biomass (SSB) fluctuated between 1.5 and 2.7 million tonnes between 1998 and 2018, and in all these years it was above MSY Btrigger but dropped below in 2020. Fishing mortality (F) has been below FMSY since 1996. Recruitment (R) has been relatively low since 2002, with very low recruitment in 2015 and 2017.

4.2.2 Harvest Strategy and Harvest Control Rule

ICES has provided advice on the long-term management strategies of North Sea herring based on a joint request from the European Union and Norway (ICES, 2019c). Until such time as one of the options is agreed by both parties, ICES will continue to provide advice based on the MSY approach. The status is unchanged compared to previous years.

4.2.3 Stock assessment and Data The data available are as in previous years. The stock assessment methodology is unchanged in the form of an Age- based analytical assessment, SAM (ICES, 2020) HAWG. The approach uses catches in the model and in the forecast.

4.2.4 Impact on the ecosystem The by-catches remained unchanged, Table 9 . There are no significant catches of ETP species. The geographical distribution of the fishery remained unchanged Figure 2

4.2.5 Impact on habitats There has not been a shift in overlap with sensitive habitats, just better information on where they occur and the geographical distribution of the fishery. No overlap between VMEs and fishing operations has been demonstrated.

4.2.6 Changes to the management system The management system of the North Sea herring, being managed as a shared stock between EU and Norway, is changed from 2021 to North Sea herring being shared between Norway, EU and UK. At the time of the site visit the consequences of this change was unknown as the annual negotiations were not completed. However, for the audit period there has been no changes.

The internal Norwegian management system is unchanged. Control and enforcements activities remained at the same level as in previous years. There are no indications of systematic non-compliance.

4.2.7 Changes to relevant regulations The change in the Norwegian ERS regulation is not relevant for the herring fleet as these vessels (> 15m) have been subject to the regulation for many years.

4.2.8 Changes to personnel involved in science, management or industry. There has been no change in key personnel involved with the Norwegian North Sea herring fishery.

4.2.9 Changes that impact Traceability There are no changes that effect Chain of Custody considerations since the PCR of 25th July 2019. There are no changes to the systems of tracking and tracing in the fishery which are considered sufficient to make sure all fish and fish products identified and sold as certified by the fishery originate from the certified fishery. Norway North Sea herring products landed by Norwegian vessels, involved in these fisheries, recorded by the Directorate of Fisheries and the sales organizations, and sold through or by approval from the sales organizations are eligible to enter further Chain of Custody. The list of vessels is updated at every assessment and is an appendix to this annual report – see chapter 6.6 The scope of the MSC Fishery certification remains unchanged and is up to the point of landing and Chain of Custody commences from the point of landing and sale.

The main market remains unchanged. Main products are processed and packed herring. Some quantities are sold as fillets and as whole round-frozen fish. Main market for Norway North Sea herring is the EU (Germany, Denmark, Netherlands and Poland), with occasional exports to Nigeria. The list of updated landing sites is available in chapter 6.7.

The client Norges Fiskarlag (The Norwegian Fishermen's Association) was founded in 1926 and is based on memberships in local and regional fishermen's associations. The association has a total of 110 local chapters and two semi-independent group organizations with approximately 4300 members from across the country. It has 7 regional associations and 2 group organizations all of which are part of the client group. The sales organizations are owned by fishermen and boat-owners (although details of the mechanisms that form the electoral basis may vary). The sales organizations are, therefore, all a part of the “MSC client group project” and are together with NFA (and the Norwegian Seafood Council) bound by contract to perform the certifications and provide financing for direct and indirect costs. The sales organization, Norges Sildesalgslag, performs all herring sales through auctions and does not take ownership of the product or handle the products. They act solely as an intermediary between the vessel owners and the buyers.

The inter-annual variation of TAC is constrained by these harvest control rules to “…no more than 15% greater or 15% less than the TAC of the preceding year.” At the meeting of the EU and Norway delegations in December 2017 the Parties concluded that “…it would be appropriate to follow the ICES MSY advice rather than the management strategy.” The TAC set for 2018 therefore exceeds the inter-annual constraints set out in the harvest control rules and was based on a value of F that exceeds the value set out in the harvest control rules. Also in 2019 the TAC was set above what ICES advised. It is noted that Inter-annual TAC variations have exceeded the levels required by the harvest control rules for this fishery before, resulting in a condition of certification that was raised in 2011 and closed in 2014. The principal tool used to achieve the exploitation levels required under the harvest control rules for the North Sea herring fishery is the TAC agreed annually between the EU and Norway. The harvest control rules for North Sea herring fisheries are set out in the Long- Term Management Strategy agreed between the EU and Norway on 1st January 2015. These harvest control rules require, inter alia, that the TAC shall be calculated using a value of F of no more than 0.26 (or a lower value if the stock is under 1.5Mt). The inter-annual variation of TAC is constrained by these harvest control rules to “…no more than 15% greater or 15% less than the TAC of the preceding year.” At the meeting of the EU and Norway delegations in December 2017 the parties agreed to follow the ICES advice pertaining at that time (which was that Fmsy was 0.33 rather than the previous estimate of 0.26). This was based on changes in the time series of natural mortality made by the ICES assessment working group. The meeting concluded that “…it would be appropriate to follow the ICES MSY advice rather than the management strategy. The TAC of 600,588t represents a 25% increase compared to 2017.”

The TAC set for 2018 therefore exceeds the inter-annual constraints set out in the harvest control rules and was based on a value of F that exceeds the value set out in the harvest control rules. It will, nevertheless, control the exploitation of North Sea herring during 2018.

It is noted that: Justification a) At the time when the 2018 TAC was agreed, ICES had advised that an F value of 0.33 would be consistent with MSY. b) The ICES advice for the North Sea herring fishery in 2019 would indicate a TAC of 311,572t. Attaining this level of exploitation would require a further breach of the harvest control rules presently in place (because the TAC would need to fall by nearly 50% between 2018-19). c) Inter-annual TAC variations have exceeded the levels required by the harvest control rules for this fishery before, resulting in a condition of certification that was raised in 2011 and closed in 2014. It is further noted that in June 2018, Norway and the EU made a formal request to ICES to provide advice on proposals for revised harvest control rules for the fishery that would allow the TAC to be based on the current ICES estimate of Ftarget and which would allow for a larger inter-annual variation. The harvest control rules in place for the fishery might therefore change. ICES have not yet provided a response to this request.

Having considered the information available, it is concluded that the SG60 requirements for this SI are met because there is evidence that the harvest control tools used to implement the harvest control rules have been effective in controlling the exploitation of North Sea herring in the past. The inter-annual variation of TAC between 2017 and 2018 exceeded the constraints specified in the harvest control rules for this fishery and have resulted in an exploitation level in 2018 that is higher than the level set out in the HCRs. As a result, the TAC has allowed for a level of exploitation that is higher than that set out in the HCRs, so the SG80 requirements are not considered to be met.

5.3.2 Progress against conditions

There is 1 condition on the Norway North Sea herring fishery which pertains to PI 1.2.2 c. After the harmonisation with FROM Nord North Sea and Eastern Channel pelagic trawl herring fishery in April 2020 the condition is extended to include SI 1.2.2a and transferred to Condition 2. As per the Guidance for MSC Fisheries CABs relating to the Covid- 19 Derogation v2.0 and therefore in accordance with FCP v2.2 clause PB1.3.3.4 b, the rescoring is done at this audit.

10.12.2022 The deadline for this condition has been extended to the 4th surveillance in June 2024 according to Derogation 6: Covid-19 Fishery Conditions Extension of 28th Condition deadline March 2021. Derogation 6 is applicable as this condition has been transferred from condition 1 because of the harmonisation of PI 1.2.2a but the milestones and deadline retain the original timelines. Year 3 (10.06.2023): Evidence shall be presented to demonstrate that well- defined Harvest Control Rule is in place and the harvest control tools are being used to restore fishing mortality to a level that is closer to the value set out in the harvest control rules in force. 5.4 Client Action Plan

In June 2018, EU and Norway met to discuss long term management strategies for the jointly managed stocks, including North Sea herring. An advice request was drafted and sent to ICES seeking options for revised long- term management strategies, this included North Sea herring. The key component embedded in the long- term management strategy will be a precautionary harvest control rule. On receiving the request, ICES notified EU and Norway that given the extensive scope of work involved the advice could not be delivered before the first quarter of 2019. EU and Norway accepted this timeframe. In the meantime, the parties informed ICES to provide the 2019 TAC advice based on MSY principles. The outline plan is that EU and Norway will meet shortly after the ICES LTMS options have been delivered in 2019 to agree a new LTMS for North Sea herring. Once this has been agreed ICES will be asked to provide the 2020 TAC advice based on the new LTMS.

Year 1 (2019): NFA will continue its work as a long- standing member of the Norwegian delegation to the coastal states negotiations and argue for the 2019 TAC to be set at a level based on the harvest control rule in place at the time the TAC is determined. Furthermore, NFA will participate at the ICES workshop drafting the options for a new long- term management strategy. NFA will participate in the EU/Norway meeting considering the Client Action plan ICES LTMS options.

Year 2 (2020): NFA will continue to work with the Norwegian Ministry of trade, industry and fisheries (“Ministry”) and participate in delegations to coastal states negotiations with the goal to set the 2020 TAC based on the harvest control rule in place at the time the TAC is determined.

Year 3 (2021) NFA will continue to work with the Ministry and participate in delegations to coastal states negotiations with the goal set the 2021 TAC based on the harvest control rule in place at the time the TAC is determined.

Year 4 (2024) NFA will continue to work with the Ministry and participate in delegations to coastal states negotiations with the goal set the 2022 TAC based on the harvest control rule in place at the time the TAC is determined.

Within SA4, evidence should be available to allow for a rescoring of 1.2.2 to a level of 80 or above. None. The condition relies upon NFAs well-established position as a delegation participant Consultation on at coastal states negotiations and as a recognized stakeholder with significant lobbying condition power towards Norwegian management authorities. The DNV GL assessment team for the Norway North Sea herring fishery reviewed your email below and concur with your conclusions. We do not feel that PI 1.1.1a is affected for our fishery. The lower limit for the 2019 estimate SSB is about 1.3 mill (2.5% lower limit) while the Blim is 800 kt. The stock is an autumn spawner spawning with a peak in September the estimate of which, for the future is around 1.3 mill tons with a lower limit above 900 kt. Scoring of 1.1.1a is not affected

PI 1.1.1b concerns fluctuating around MSY, e.g. as indicated by CU for a generation time, and since F is still around FMSY the decline can be ascribed to ‘fluctuations’

(1) An 80 score may also be met where stock size is very substantially higher than Bpa, for instance greater than 2 x Bpa (Btrigger) (Froese et al, 2014), irrespective of the above F proxies (2)

Our rationale for a score of 80: The generation time (GT) is assumed to be given by the proxy GT = AM50 + 1/M, where AM50 is the age at 50% maturity, and M is natural mortality. Considering that AM50 = 3 and M2-6 ≈ 0.35 (ICES, 2019b) it results that GT = 6. Retaining this last value, one GT ago from 2018 (last available data) falls in 2012, and two GTs ago

F has been below FMSY since at least 2002, a starting point from which SSB remained >MSY Btrigger and >>Bpa, hence at least SG80 is met according to point 1). Furthermore, SSB has been above the 2xBpa threshold value (1.8 million t) since 2010 and therefore at least SG80 is met according to point 2).

While point (2) no longer holds true (SSB is believed to be at around ~1.29 million tonnes), point (1) still holds true. My opinion is that an expedited audit is not required in light of the new information, as it does not trigger any changes in scoring and does not trigger clause 7.29.1 of FCP 2.2.

A fishery I am still involved with is the NIPSG North Sea herring. John Nichols is P1.

We have been having discussions with PFA/SPSG/DFPO (LR) and FROM Nord (CU Pesca) over scoring of PI 1.2.2. We have resolved on a score of 65 for this PI – SI a and SI c both scoring 65. Your scoring for NFA is slightly different (70).

Could you discuss with Hans and confirm that you are happy to harmonise with this scoring? I attach John’s rationale FYI. We will then all be on the same page. I don’t think this will significantly affect your existing condition.
