THE WEST VIRGINIA PUBLIC EMPLOYEES GRIEVANCE BOARD EDWARD SMARR and JOSHUA SCHULTHEISZ, Grievants, v. Docket No. 2020-1488-CONS DIVISION OF CORRECTIONS AND REHABILITATION/ BUREAU OF PRISONS AND JAILS/ ST. MARYS CORRECTIONAL CENTER AND JAIL, Respondent. DECISION Grievants, Edward Smarr and Joshua Schultheisz, were employed by Respondent, Division of Corrections and Rehabilitation, at St. Marys Correctional Center and Jail (SMCCJ). Respondent dismissed Grievants during their probationary period of employment. On January 17, 2020, Grievant Schultheisz filed his grievance (Docket No. 2020- 0858-MAPS) stating, “Wrongfully accused of actions according to WV DCR, Commissioner, and Governor. Religious representation sought by state officials before investigation concluded. Wrongful Termination Resulting in permanent dismissal. Penalized for following orders from senior officer.” As relief, he requests, “Public apology from all who slandered and settlement for troubled times.”1 On January 19, 2020, Grievant Smarr filed his grievance (Docket No. 2020-0822-MAPS) stating the same. 1“The remedy of a public apology is not available as relief from this Grievance Board.” Lawrence v. Bluefield State Coll., Docket No. 2008-0666-BSC (June 19, 2008); Emrick v. Wood County Bd. of Educ., Docket No. 03-54-300 (Mar. 9, 2004); Hall v. W. Va. Div. of Corr., Docket No. 89-CORR-687 (Oct. 19, 1990). The undersigned will not further address Grievants’ request for an apology. 1 Grievants filed directly to level three of the grievance process.2 The two grievances were consolidated into the current action on June 5, 2020. A level three hearing was held on July 8, 2020, before the undersigned at the Grievance Board’s Westover, West Virginia office. -

The first view suggests that the extreme right ideology has been an integral part of modern Greek political history because of its tradition of far-right dictatorships. The other view emphasizes the fact that the extreme right in Greece never actually existed simply because of the lack of a nationalist middle class. In effect, the emergence of Golden Dawn is simply an epiphenomenon of the economic crisis. At the same time, a broad new trend was adopted not only by the mass media but also -unfortunately– the academia in order to expand – by using false criteria - the political boundaries of the extreme right, to characterize as many parties as possible as extreme right. In any case, the years after the fall of the Greek junta (from 1974 until today) there are mainly two right-wing parties in the Greek political life: the “United Nationalist Movement” (ENEK in its Greek acronym), a fridge organisation acted during the mid 80’s and has ceased to exist, and the Golden Dawn, whose electoral success provoked an important political and social debate. -

Open up the newspaper, even in the U.S., and almost everyday there is evidence that Europeans, or at least significant segments of the population, have not learned from the horrors of the 20th century. Although there are powerful forces working against this, the politics of racial and religious hatred is still very much with Europe. There are alarming manifestations of both anti-Semitism and Islamophobia on a regular basis, in Europe, east and west, north and south. The latest include the antics of the anti-Semitic “humor” of Dieudonne M'bala M'bala with his popularization of the “quenelle,” and the attempts of the French authorities to control this latest fad. Thus, as I composed this lecture, I read in my morning New York Times that a French appeals court ruled to uphold bans on Dieudonne’s performances. Yet, the banning of an innovative form of hate speech, such as this move, does not seem to have its desired effect, despite the actions of officials and the approval of intellectual celebrities, such as Bernard Henry - Levy. Many beyond polite official and intellectual circles persist in their politically incorrect convictions and actions. 1 There has been a documented rise in anti-Semitism, specifically as European Jews understand their own situation, according to an important EU study. And very much along with this rise of anti- Semitism, there is an even more significant rise in Islamophobia. According to a study by the Pew Global Attitudes Project, Islamophobia and anti-Semitism are rising in Continental Europe, with the level of Islamophobia outstripping anti-Semitism, as such xenophobic attitudes are in decline in the U.S. -

Für viele Überlebende der nationalsozialistischen Gewalttaten war das Jahr 1945 zwar das Jahr ihrer Rettung, aber nur bedingt auch das Jahr ihrer Befreiung. Denn nun begann für sie der meist vergebliche Versuch, das erlittene Geschehen zu vergessen oder in sich selbst zu verschließen, um in einer allzu rasch zur Normalität zurückkehrenden Außenwelt das gerettete Leben überhaupt weiterführen zu können. Nicht zuletzt deshalb vermochten viele Überlebende erst im Alter ihre Berichte aufzuzeichnen. Die Autorin einer bruchstückhaft rekonstruierten Chronik der eigenen Familie war am 8. Mai 1945 sieben Jahre alt, lebte bei einer Pflegefamilie und hatte an die Schrecken, die sie bereits erlitten hatte, keine Erinnerung mehr. Jahrzehnte später beginnt sie damit, sich aus zufällig überlieferten Dokumenten, alten Akten und verstreuten Fotografien ein lückenhaftes Bild vom Schicksal ihrer Eltern und der eigenen Vorgeschichte zusammenzusetzen. Sie findet heraus, dass ihre Eltern im August 1935 heiraten wollten, aber vom Hamburger Standesbeamten abgewiesen wurden, weil die Mutter Jüdin war. Zu diesem Zeitpunkt gab es zwar noch keine formale juristische Absicherung für das Verbot von "Mischehen", aber die Schlinge war schon gelegt. Im April 1935 hatte das Reichsinnenministerium den Begriff der "Mischehe" von bisher konfessionell gemischten Ehen zu solchen von Personen unterschiedlicher "rassischer Zugehörigkeit" umdefiniert und die Standesämter angewiesen, entsprechende Anträge nicht mehr zu bearbeiten. -
