NANCY LAMBTON Ann Katharine Swynford Lambton 1912–2008 ANN KATHARINE SWYNFORD LAMBTON was one of the few outstanding scholars of the Persian language and Persian history that Britain has produced since the subject developed within the wider academic discipline of oriental languages in the nineteenth century. Early in her career she established a reputation as the pre-eminent specialist in all matters Persian: language and grammar, history and political thought in the Islamic period, religion, current events and contemporary political analysis were all considered to lie within her expertise. For many both within and out- side the scholarly community she was the ultimate authority in all these specialisations. There have been few scholars who have so dominated their field for such a long period. For close on seven decades in an exceptionally long, active life she published her research with single-minded determina- tion, for a quarter of a century she held the senior chair in Persian in British universities, and throughout much of her adult life she was thought to be an informal advisor to politicians, diplomats, and oil company directors. Inevitably in a life that spanned some of the decisive events in Iran’s history from the Allied occupation and fall of Reza Shah in 1941, the Azarbaijan crisis in 1946, the coup d’état of 1953, the land reforms of the early 1960s, and the Islamic Revolution of 1979, in all of which she was alleged to have played some part, myths and legends rapidly accumulated about her. Admired by many for her scholarly achievements, demonised by others for her political involvement, fictionalised in the post-revolutionary Iranian press as the eminence grise of British Intelligence, credited with single- handedly breaking up a German espionage operation in the Second World War, and briefly portrayed in a recent English novel—James Buchan’sA Biographical Memoirs of Fellows of the British Academy, XII, 235–273. -
Queering International Law's Sexual Subject Through Islamic Legal
Towards a Sexual Pluriverse: Queering International Law’s Sexual Subject Through Islamic Legal Histories Azeezah Kanji The emergence of rights for sexual minorities as a subject of concern in international human rights discourse has prompted opposition from Muslim-majority states and Muslim scholars claiming that such rights are fundamentally antithetical to Islamic law. Other scholars, however, have disagreed, justifying the extension of rights and legal protection for sexual minorities using arguments drawn from the Qur’an, the sunnah (practice and sayings of the Prophet Muhammad), and classical fiqh (jurisprudence). Interventions on all sides, however, tend to omit the question of how sexual identity is produced and configured as an object of legal regulation in the modern nation-state (in contrast to the pre-modern polity in which Islamic law developed), instead taking these basic terms of the debate largely for granted. However, the rupture effected by the (violently colonial) transition to modernity in the interrelationships between the state, the law, and sexuality renders the grafting of classical Islamic legal norms – whether supporting or opposing contemporary formulations of human rights – onto the modern nation-state problematic. Drawing on the recent work of historians of sexuality and criminal law in Muslim- majority societies, I will re-situate the current discourse against the backdrop of the construction of modern sexual identities – and their legal regulation – through processes of colonialism, modernization, and nation-state formation. I will use the contestations over sexual minority rights as a site for considering the broader problematic of how human rights are formulated and debated – and the question of their universality or relativity considered – in the shadow of (post?)colonial modernity: its institutions, epistemologies, and identity formations. -

The Türkmen-Saljūq Relationship in Twelfth-Century Iran: New Elements Based on a Contrastive Analysis of Three Inšā⁾ Documents
THE TÜRKMEN-SALJŪQ RELATIONSHIP IN TWELFTH-CENTURY IRAN: NEW ELEMENTS BASED ON A CONTRASTIVE ANALYSIS OF THREE INŠĀ⁾ DOCUMENTS David Durand-Guédy* Martin-Luther-Universität, Halle-Wittenberg Abstract This article is based on a contrastive analysis of three decrees dealing with the administration of nomadic pastoralists in twelfth-century Iran, two issued by the Saljūq sultan Sanjar and one by a dinasty of slave emirs (the Atabegs of Azarbaijan). The starting hypothesis is that the differences between these contractual documents should not be reduced simply to differences in formulation, but may highlight a diffrence between two types of rule. The respect, empathy and leniency shown toward the nomad elites by the Saljūq sultan is the product not only of a particular situation (the conjuncture of the geographic situation of the nomads and the political context), but also more especially of the close relationship between the Saljūqs and the Türkmens, who considered themselves as having a common ancestry. On the basis of this analysis, the very identity of the Saljūq kingship can be reassessed. The most complicated of the questions which had to be solved by the bureaucracy [of the Saljūqs] was how to deal with the Turkish invaders who had entered the country together with the sovereign, and who had no desire at all to change to a settled life and submit to the same administration as the remaining mass of the population. Between God and Society Divine Speech and Norm-Construction in Islamic Theology and Jurisprudence Omar Farahat Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in the Graduate School of Arts and Sciences COLUMBIA UNIVERSITY 2016 © 2016 Omar Farahat All rights reserved Abstract Between God and Society Divine Speech and Norm-Construction in Islamic Theology and Jurisprudence Omar Farahat The role of divine Revelation in the process of construction of normative judgments has long occupied scholars of religion in general, and Islam in particular. In the area of Islamic studies, numerous works were dedicated to the elucidation of various trends of thought on the question of the methods of formulation of norms and values. Many of those studies suppose a distinction between textualist and rationalist theories, and use this framework to explain the most influential Muslim views on this issue. In contemporary philosophical theology and the philosophy of religion, theorists of religious meta-ethics draw upon the medieval and early modern Christian debates almost exclusively. Reconstructing the philosophical foundations of classical Islamic models of norm-construction, which arise within both theological and jurisprudential works, has not received sufficient attention in either discipline. In this study, I explore eleventh century debates on the place of divine Revelation in the formulation of normative judgments in Islamic theology and jurisprudence, and bring this analysis in dialogue with current questions in philosophical theology. By reconstructing the epistemological, metaphysical and semantic foundations of those debates, I show that two general trends emerge on the question of the depth with which Revelation interferes in human moral reasoning, which generally correspond to recent debates between natural reason and divine command theorists in contemporary philosophical theology. -

Ann K.S. Lambton (1912–2008) and Persian Studies1 DAVID O. MORGAN The last occasion on which I addressed the Society, in 2000, was, like today’s, a memorial lecture: to honour the memory of Professor Charles Beckingham. I spoke then about a subject that combined Professor Beckingham’s interests with my own: Ibn Battuta and the Mongols.2 As it happens, I have already done something similar for Professor Lambton: a 90th birthday lecture to the British Institute of Persian Studies, in 2002, when my subject was a reappraisal of the Mongol period in Iran.3 This was given in the presence of the honorand: a slightly daunting experience; and those who knew her will not be surprised to learn that she was by no means uncritical, if not necessarily of what I said, then certainly of my delivery of it. So I decided that today I would talk about Professor Lambton herself, and attempt to discuss and evaluate her contribution to the field of study which she adorned for so long. I am not entirely certain what it was that pointed the young Ann Lambton in the direction of Persia (a term she preferred to the now more academically and politically respectable “Iran”). In her early career, her two most significant mentors were Sir Hamilton Gibb (1895–1971), who was Professor of Arabic at SOAS in the 1930s, and Sir Reader Bullard (1885–1976), the British Minister and later Ambassador to Iran, for whom she worked as Press Attachee´ in Tehran during the Second World War. Neither of these great men had much time for Persia or the Persians; so the explanation is not to be found with them; and in any case she had already committed herself to the study of Persian before she encountered them.
