Authorizing the City Manager to execute a Maintenance Agreement with the Massachusetts Department of Transportation Highway Division (“MassDOT”), granting the City of Lowell permission to install a shared-use path within the State Highway Layout (SHLO), located below the Lowell Connector bridge BR# L-15-080 and extending northeasterly to the River Meadow Brook in Lowell, Massachusetts.

The project passes through the MassDOT State Highway Layout as it passes under the Lowell Connector highway. In addition, the project would add a crosswalk and repair the sidewalk on the Industrial Avenue Bridge over the River Meadow Brook, which is owned by MassDOT. To construct the trail through these areas, the City must formally agree to maintain the trail and keep it free from hazardous conditions.

A Maintenance Agreement for such purpose is needed.

AGREEMENT MASSACHUSETTS DEPARTMENT OF TRANSPORTATION HIGHWAY DIVISION AND CITY OF LOWELL, MASSACHUSETTS

AGREEMENT, made this ______day of ______, 2021 by and between the Massachusetts Department of Transportation Highway Division, hereinafter called “MassDOT”, and the City of Lowell, hereinafter called the “City”.

WHEREAS, MassDOT has granted the City permission to install a shared-use path within the State Highway Layout (SHLO), located below the Lowell Connector bridge BR# L-15-080 and extending northeasterly to the River Meadow Brook in Lowell, Massachusetts, as shown on the attached plans prepared by TEC, Inc. on behalf of the City entitled, “Lowell Connector Trail” and dated 5/27/2021;

WHEREAS, the parties hereto have reached an agreement as to the future maintenance of the proposed shared-use path as shown on the attached set of plans prepared by TEC, Inc. on behalf of the City entitled, “Lowell Connector Trail” and dated, 5/27/2021;

NOW THEREFORE, in consideration thereof, MassDOT and the City hereby agree, each with the other, as follows:

The City agrees to maintain clear passage for pedestrians free from debris, obstructions, and vegetation; and perform repairs as necessary to maintain safe and complaint passage of pedestrians.

The City agrees to monitor trail conditions upon completion of construction activities and conduct trail maintenance activities so as to not impede travel or create unnecessary hazard to trail users. Trail maintenance activities shall include, but are not necessarily limited to, the maintenance and removal of live and dead vegetation from the trail corridor, pavement management, maintenance of the chain link fence, safety signage management, and drainage/ stormwater management.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and year first above written.

Dear Mayor Leahy and Members of the City Council:

Please find attached to this letter a draft Agreement between the Massachusetts Department of Transportation (MassDOT) and the City of Lowell (“Maintenance Agreement”) related to the Connector Trail project.

In 2019, the City of Lowell received an $180,000 grant from the Commonwealth’s MassTrails program and a $55,000 earmark facilitated by Senator Edward Kennedy for the Connector Trail, a project that will enhance .35 miles of rail bed connecting shopping centers and neighborhoods under the Lowell Connector highway, past unique and spectacular aerosol art that is continuously refreshed. Neighborhood pedestrians already use this rail bed for recreation and travel to work and shopping. The Connector Trail project will pave this path for accessibility, preserving the rotating aerosol art as a cultural centerpiece, serving not only the more than 2,000 people living in the half-mile radius from either end of the trail, but also people throughout Greater Lowell. In the long-term, the section of trail would be a link connecting the Bruce Freeman Rail Trail’s northern terminus, the 5.2 mile system of downtown Canalway trails, the Greenway, and the Merrimack River Trail to New Hampshire, closing one of the very last remaining gaps in the regional 200-mile Bay Circuit Trail.

The project passes through the MassDOT State Highway Layout as it passes under the Lowell Connector highway. In addition, the project would add a crosswalk and repair the sidewalk on the Industrial Avenue Bridge over the River Meadow Brook, which is owned by MassDOT. To construct the trail through these areas, the City must formally agree to maintain the trail and keep it free from hazardous conditions. This would not obligate the City to plow the trail. This applies only to the trail itself, not the sidewalk repairs and crosswalk.
