(2) These negotiations have been concluded to the satisfaction of the Commission. (3) The text of the Protocol negotiated with Tunisia provides, in Article 8(2), for the provisional application of the Protocol before its entry into force. (4) The Protocol should be signed and applied on a provisional basis, pending the completion of the procedures for its conclusion, HAS ADOPTED THIS DECISION: Article 1 1. The signing, on behalf of the European Union and its Member States, of the Protocol to the Euro-Mediterranean Association Agreement between the European Communities and their Member States, of the one part, and the Republic of Tunisia, of the other part, to take account of the accession of the Republic of Bulgaria and Romania to the European Union is hereby authorised on behalf of the Union and its Member States, subject to the conclusion of the Protocol. Article 2 The President of the Council is hereby authorised to designate the person(s) empowered to sign the Protocol, on behalf of the Union and its Member States. Article 3 The Protocol shall be applied provisionally from 1 January 2007, pending the completion of the procedures for its conclusion. MAVROYIANNIS 14.10.2014 EN Official Journal of the European Union L 296/3 PROTOCOL to the Euro-Mediterranean Agreement establishing an association between the European Commu nities and their Member States, of the one part, and the Republic of Tunisia, of the other part, to take account of the accession of the Republic of Bulgaria and Romania to the European Union THE KINGDOM OF BELGIUM, THE REPUBLIC OF BULGARIA, THE CZECH REPUBLIC, THE KINGDOM OF DENMARK, THE FEDERAL REPUBLIC OF GERMANY, THE REPUBLIC OF ESTONIA, THE HELLENIC REPUBLIC, THE KINGDOM OF SPAIN, THE FRENCH REPUBLIC, IRELAND, THE ITALIAN REPUBLIC, THE REPUBLIC OF CYPRUS, THE REPUBLIC OF LATVIA, THE REPUBLIC OF LITHUANIA, THE GRAND DUCHY OF LUXEMBOURG HUNGARY, MALTA, THE KINGDOM OF THE NETHERLANDS, THE REPUBLIC OF AUSTRIA, THE REPUBLIC OF POLAND, THE PORTUGUESE REPUBLIC, ROMANIA, THE REPUBLIC OF SLOVENIA, THE SLOVAK REPUBLIC, THE REPUBLIC OF FINLAND, THE KINGDOM OF SWEDEN, L 296/4 EN Official Journal of the European Union 14.10.2014 THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND, (hereinafter referred to as ‘Member States’), and THE EUROPEAN UNION, (hereinafter referred to as ‘Union’) of the one part, and THE REPUBLIC OF TUNISIA, (hereinafter referred to as ‘Tunisia’), of the other part CONSIDERING THAT The Euro-Mediterranean Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Tunisia, of the other part, hereinafter referred to as ‘the Euro-Mediterranean Agreement’ was signed in Brussels on 17 July 1995, entered into force on 1 March 1998 and was amended notably by the Protocol to the Euro-Mediterranean Agreement establishing an association between the Euro pean Community and its Member States, of the one part, and the Republic of Tunisia, of the other part, to take account of the accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union (1) and by Decision No 1/2006 of the EU-Tunisia Association Council of 28 July 2006 amending Protocol 4 to the Euro-Mediterranean Agreement concerning the definition of the concept of originating products and methods of administrative cooperation (2); CONSIDERING THAT the Treaty concerning the accession of the Republic of Bulgaria and Romania to the European Union (hereinafter referred to as ‘Treaty of Accession’) was signed in Luxembourg on 25 April 2005 and entered into force on 1 January 2007; CONSIDERING THAT Pursuant to Article 6(2) of the Act of accession of Bulgaria and Romania, the accession of the new Contracting Parties to the Euro-Mediterranean Agreement shall be agreed by the conclusion of a protocol to that Agree ment; CONSIDERING THAT Consultations pursuant to Article 23(2) of the Euro-Mediterranean Agreement have taken place in order to ensure that account has been taken of the mutual interests of the Union and Tunisia; CONSIDERING THAT Tunisia decided by Decree No 2007-995 of 24 April 2007 to apply the provisions of the Euro-Medi terranean Agreement to the Republic of Bulgaria and Romania from 1 January 2007. HAVE AGREED AS FOLLOWS: Article 1 The Republic of Bulgaria and Romania hereby become Parties to the Euro-Mediterranean Agreement, and shall respect ively take note and adopt, in the same manner as the other Member States of the Union, of the texts of the Agreement, and of the Joint Declarations, Unilateral Declarations and Exchanges of Letters.
