  • Fine Imposed Against Mars for Violating the Prohibition to Put a Merger Into Effect
Startseite News Fine imposed against Mars for violating the prohibition to put a merger into effect Date of issue: 15.12.2008 The Bundeskartellamt has imposed a fine totalling 4.5 million euros against the American company Mars Inc., McLean (Virginia) for violating the prohibition to put into effect its acquisition of the American pet food manufacturer Nutro Products, Inc., City of Industry/California. By completing its share acquisition Mars consciously defied provisions of German competition law. This was the first fine to be imposed for this category of competition law violation on the basis of the Bundeskartellamt's fine guidelines from the year 2006. This is the highest fine to be imposed by the Bundeskartellamt for a violation of the prohibition to put a merger into effect. Mars is a manufacturer of pet food, confectionary (including the brand names Mars, Bounty, Milky Way, M&M’s) and foodstuffs. In Germany its pet food products are sold, among others, under the brand names Royal Canin, Pedigree, Frolic, Chappi, Cesar, Whiskas, Kitekat und Sheba. In terms of dog and cat food sales Mars is by far the leading supplier of these products in Germany. Nutro Products is an American producer of dog and cat food which in Europe has up to now distributed its products under the brand name Nutro Choice via independent retailers to specialised pet supply shops. The company has all its production sites in the USA. Its activities are concentrated in North America. In May 2007 Mars notified its intention to acquire Nutro Products to the authorities in Germany, Austria and the USA.

Contact: Caroline Guth [email protected] 312.988.2410 Debra Fair [email protected] 615-807-4605 FOR IMMEDIATE RELEASE NUTRO PRODUCTS’ NATURAL CHOICE® DOG FOOD AND THE NATIONAL DISASTER SEARCH DOG FOUNDATION JOIN FORCES TO RAISE AWARENESS FOR CANINE SEARCH TEAMS Focus Will Be To Help Strengthen America’s Emergency Response Network CITY OF INDUSTRY, Calif., (September 9, 2008) – Canine search teams play a critical role in our society. Both handler and dog – paired together and bound by selflessness, devotion, and an unwavering commitment to find life amidst the rubble – serve as working heroes who help save lives in the aftermath of a natural disaster or a terrorist attack. Today, America is in need of more certified teams. Meeting this challenge is the ultimate goal of The National Disaster Search Dog Foundation (SDF), a non-profit organization that gained notoriety in the wake of Sept. 11th. In an effort to support SDF’s mission, the NATURAL CHOICE® Brand, a leading premium pet food manufactured by Nutro Products, has become the organization’s exclusive pet-food partner. “For nearly a decade, Nutro Products has donated pet food to handlers to help alleviate the additional out-of-pocket dollars spent to nourish these heroes, and we want to continue to do so as the number of teams increase,” says Debra Tosch, Executive Director, SDF. “NATURAL CHOICE® dog food is committed to providing superior nutrition to the dozens of SDF canine disaster search teams by helping to provide them with the sustained energy, strength and stamina they need to deliver peak performance.” Located in Ojai, Calif., the Search Dog Foundation produces highly-trained, FEMA-certified canine search teams.
