WORKING GROUP PRESENTATION The publication of this guide responds to an ethical duty and the mandate of Law 14/2012, dated 28 June, on non-discrimination based on gender identity and recognition of the rights of transsexual persons, and also to the Basque Government’s commitment to people. We believe respect for personal dignity to be a fundamental human right which involves free personal self- determination, which in turn includes each person’s sexual identity, although this may not coincide with the sex they were assigned at birth. Persons in situation of transsexuality are, even today, a vulnerable collective, as recognised by Law 14/2012, dated 28 June, on non-discrimination based on gender identity and recognition of the rights of transsexual persons, and also Decree 147/2015, dated 21 July, together with the Declaration of Rights and Duties of persons in the health system of the Basque Country. That condition of vulnerability demands specific public policies to eliminate any discrimination to which they can be exposed during the exercising out of their civic rights and responsibilities. Transsexuality is not a disorder, nor a mental illness, nor a sociopathy, it is a fact of diversity, one more variant in human diversity, which can be manifested from earliest childhood and which, in many cases, requires coordinated action in the fields of education, social work and healthcare. Although the cited Law 14/2012 urges the publication of a clinical guide for the health care of transsexual persons, we in the Government are of the opinion that the guide should include the three fields, so that the same document covers the actions and recommendations in an integrated manner. The writing of this guide has been carried out by means of a highly participative working group 7 from the fields of the affected persons (through their associations), from Osakidetza (Basque Health Service) and the Basque Government (through the three departments we represent). The intention was to have all possible points of view and sensibilities present in the writing of the guide, so therefore the profiles of those persons making up the group were varied with regard to the areas of knowledge, experience and competences (affected persons, technical staff, both clinical and from the fields of education and social policies, managers and directors) and with regard those they represent (institutions, scientific and professional societies and associations for affected and interested persons). Precisely this heterogeneity of profiles and sensibilities has made possible a multidisciplinary result of great intellectual and ethical richness, but it has also led to great difficulties when the time came to reach a consensus on an acceptable text for everyone. Our thanks go to all those persons who participated in the writing of this guide for their technical efforts and the consensus they reached. The Basque Government presents this guide as a living thing, not the end of the road. We are sure that it will serve to move forward in the non-discrimination of the collective of transsexual persons and with diversity in the expression of gender and as a support to professionals in the fields of social policy, educational and health for ensuring best practices are used in the care of these persons. TREND ALERT: COMING OUT OF THE CLOSET near Seattle, tucked away off the Puget Sound, there’s a sovereign nation whose citizens can marry whoever they choose. They’re called the Suquamish, and they were there before Washington was a president, much less a state. The Suquamish enjoy the right to same-sex marriage, thanks to Heather Purser, a 29- year-old lesbian tribal member who grew up near the reservation. She’d already tried to come out of the closet twice during her childhood, and retreated both times before she arrived at Western Washington University and started attending LGBT events. “I saw that I could be safe there,” she says. “I decided I wanted to have that feeling back home, too.” Purser began speaking with her tribe about same-sex marriage in 2007. A year later, she addressed the tribal council, which cautiously encouraged her cause. She did her research: contacting a tribe that had recently passed a similar law, requesting copies of their ordinance, reviewing it with an attorney, and translating it into Suquamish.
