Any mis- takes remain my own. 143 \\jciprod01\productn\H\HNR\21-1\HNR104.txt unknown Seq: 2 31-MAR-16 8:39 144 Harvard Negotiation Law Review [Vol. 21:143 Iran to “bring [Iranian] attention to . features of [the] Constitu- tion.”1 In writing this letter, the senators sought to alter the pro- gressing nuclear negotiations between the United States and the Republic of Iran.2 Such a letter may have been unprecedented in its approach, but legislators and those away from the negotiation table have constantly sought to influence the results from behind the table. Much has been written, both theory and application, on the bene- fits and costs of this “two-level game.” In a two-level game, the first level involves negotiation at the table between two nations; Level I negotiators are representatives of their nations. The second level in- volves convincing the domestic populace to accept the deal. The Level II negotiator is behind the table but is critical for any deal to be approved. As of yet, not much has been written on how Level I negotia- tors — those at the table — use Level II disagreement from behind the table to make a deal. With the congressional reactions to Iran and Cuba providing just two examples in 2015, congressional leaders con- stantly influence presidential negotiations. The challenge of ensuring a lasting negotiation will only rise as congressional skepticism of presidential action increases. This Article looks at theory and practice to answer the question: how do Level I actors negotiate in the face of active Level II disapproval? The answer depends heavily on the context of the negotiation, but at least four strategies emerge. First, a Level I negotiator can preempt disagreement with a Level II agitator by restricting the ac- tion set of the Level II agitator; the Logan Act of 1799 exemplifies this strategy. Second, the Level I negotiator can appease the Level II agitator by actively integrating it into the Level I process. The ap- proach of President Ronald Reagan during the Central American ne- gotiations around the Nicaraguan contras in 1987 illustrates this strategy. Third, a Level I negotiator can bifurcate her actions, staying steady on her positions at the Level I table while changing rhetoric to 1. Prime Minister Jawaharlal Nehru’s ap- proach to China between 1950 and 1972 shows this approach. Fi- nally, a Level I negotiator can stay steadfast in her beliefs despite the disagreement from the Level II agitator. The Iran case study of 2015 demonstrates this strategy. This Article does not seek to identify only one approach as suc- cessful or others as unsuccessful. Instead, it seeks to describe the his- tory of these cases, the facts that led to these choices being made, and the implications of those choices within that negotiation. With this knowledge, this Article strives to provide guidance to future Level I and Level II negotiators in potential strategies both at and behind the table. Ultimately, the decision about a strategy will be fact-based and may involve a combination of all four strategies at different times during a complex negotiation. The Article proceeds as follows. In Section II, I outline previous theoretical analyses addressing two-level negotiations. This Article builds on this past research by identifying ways in which an active Level II disapproval contributes to and deviates from the theory pre- viously laid out. In Section III, I look at the passage of the Logan Act to demonstrate how a Level I negotiator can attempt to preempt Level II interference. In Section IV, I go through three case studies demonstrating how different Level I negotiators have approached Level II disapproval. In Section V, I conclude that the Level I negotia- tor must work with facts on the ground to determine the set of strate- gies that will be most effective in negotiating a deal. II. A THEORETICAL GUIDE TO THE TWO-LEVEL NEGOTIATION Many international negotiations between nations involve two sets of negotiations: one between the executives representing their nations to create a deal, and the other between the executive and her domestic populace, represented by the legislature, to approve the deal.3 The former involves Level I negotiators; that is, negotiations on the terms binding the nations are Level I negotiations. The latter involves Level II negotiators; that is, Level II negotiations occur be- tween the executive and the domestic populace to market the deal internally. Level I negotiations are at the table, whereas Level II ne- gotiations are behind the table.4 3. See, e.g., Robert D. As stated by Robert Strauss of the Tokyo Round trade negotiations: “I spent as much time negotiating with domestic constituents (both industry and labor) and members of the U.S. Congress as I did negotiating with our foreign trading partners.”5 The dual nature of the negotiation leads to complication. Ra- tional moves on one board may in fact be counterproductive on the other board. Yet, while some deviation in rhetoric may be acceptable, drastic differences will undermine trust between the central figure and her counterparts on both boards. The more one uses prevarica- tion to sell the deal, the less likely the deal is to succeed.6 On top of this, the knowledge that any key player can walk away from the ne- gotiation at any time or be evicted by the domestic authority adds additional complexity.7 Many international negotiations, especially treaty negotiations, provide a third level of complexity. If Level I negotiations involve bar- gaining between the negotiators that lead to a tentative agreement, and Level II negotiations involve the domestic discussion to deter- mine whether to ratify the agreement, the domestic constituency re- tains a great deal of power over the negotiations; the legislature could ultimately approve or disapprove the deal.8 Any successful agree- ment involving two nations must fall within four win-sets: those of the two Level I actors and those of the two Level II actors. The larger each win-set is, the more likely they are to overlap.9 In addition, the relative size of the Level II win-sets will affect the distribution of the gains from the bargain; demonstration of a smaller Level II win-set by one nation can force the other nation to cater to these domestic realities. Win-set size can create opportunities. For example, an executive can send her domestic counterpart to discuss political problems and validate the limited size of the Level II win-set. “Having one’s hands tied can be a useful tool in exacting concessions.”10 However, this 5. Using security agencies to surveil and suppress political opponents is always a temptation for those in power. It is a temptation from which the United States has not escaped. The FBI’s director for life, J. Edgar Hoover, famously maintained his power by building files on numerous Washington politicians and putting his wiretapping and investigative capabilities at the service of Presidents pursuing political vendettas. That risk is making a comeback. The United States used the full force of its intelligence agencies to hold terrorism at bay for twenty years, but we paid too little attention to geopolitical adversaries who are now using chipping away at our strengths in ways we did not expect. As American intelligence reshapes itself to deal with new challenges from Russia and China, it is no longer hunting small groups of terrorists in distant deserts.

INTRODUCTION This chapter provides a detailed historical account of the development and evolution of federal mandatory minimum penalties. It then describes the development of the two statutory mechanisms for obtaining relief from mandatory minimum penalties. B. MANDATORY MINIMUM PENALTIES IN THE EARLY REPUBLIC Congress has used mandatory minimum penalties since it enacted the first federal penal laws in the late 18th century. Mandatory minimum penalties have always been prescribed for a core set of serious offenses, such as murder and treason, and also have been enacted to address immediate problems and exigencies. The Constitution authorizes Congress to establish criminal offenses and to set the punishments for those offenses,17 but there were no federal crimes when the First Congress convened in New York in March 1789.18 Congress created the first comprehensive series of federal offenses with the passage of the 1790 Crimes Act, which specified 23 federal crimes.19 Seven of the offenses in the 1790 Crimes Act carried a mandatory death penalty: treason, murder, three offenses relating to piracy, forgery of a public security of the United States, and the rescue of a person convicted of a capital crime.20 One of the piracy offenses specified four different forms of criminal conduct, arguably increasing to 10 the number of offenses carrying a mandatory minimum penalty.21 Treason, 17 See U.S. Const. art.     INTRODUCTION THE FOUNDATIONS OF DIPLOMATIC SECURITY INTRODUCTION 8 THE FOUNDATIONS OF DIPLOMATIC SECURITY Diplomatic security is as old as diplomacy itself. Initially, diplomatic security was primarily the secure conveyance of government communications using couriers and codes. The Persian, Babylonian, Egyptian, Chinese, Greek, Roman, Aztec, and Incan empires developed courier services to carry imperial messages. The Greeks and Romans also developed ciphers to preserve confidentiality of diplomatic messages.1 By the Renaissance (1500s), codes had emerged, and Spanish, French, English, Vatican, and Venetian foreign ministers routinely used ciphers and codes when writing to their diplomats abroad. The European monarchies also developed courier networks to carry messages. Courier work was seen as a training ground for diplomats because couriers had to exercise discretion, know the local language, and employ disguises to avoid detection.2 Colonial-era leaders in North America were acutely aware of the need to protect their correspondence.     To: The Honorable Justices of the Supreme Court of the State of Minnesota From: Leonard Roy Date: March 28, 2017 Re: Rule 10 and proposed amendments (Tribal Court Orders and Judgments) Honorable Justices, thank you for allowing me to submit this testimony on the proposed Rule 10 amendments under consideration. I am Leonard Roy, a White Earth Tribal member, and I oppose Rule 10 and the proposed amendments because it negatively affects Tribal members. On October 29, 2002, the Supreme Court of the State of Minnesota considered the possibility of granting full faith and credit to Tribal Courts.1 Specifically, the petition for adoption of a rule of procedure for the recognition of Tribal Court orders and judgments was presented. However, the Supreme Court decided not to provide full recognition. During the hearing, Tribal members claimed that no separation of powers existed in the Minnesota Chippewa Tribe Constitution.2 Specifically, Tribal members from the Minnesota Chippewa Tribe—which includes White Earth Reservation, Bois Forte Reservation, Mille Lacs Reservation, Fon Du Lac Reservation, Grand Portage Reservation, and Leech Lake Reservation—claimed that an independent judiciary did not exist. This was true in 2002 and it is still true today. While the Minnesota Chippewa Tribe and its Bands have made great progress towards professionalizing and institutionalizing Tribal Courts, the Tribe has yet to amend its Constitution to create Tribal Courts. To complicate the matter even further, Minnesota passed Rule 10 that provided a modicum of recognition for Tribal Court decisions.3 This has led to the hearing today. This Constitutional impasse was evident at the Minnesota Chippewa Tribe’s Special Meeting held on March 15, 2017.

    Chapter 1 The Alien and Sedition Crisis Craig R. Smith ess than seven years after the First Amendment was made part of the LConstitution, it came under attack. This chapter demonstrates that the challenges to the First Amendment were politically motivated when the nation was perceived to be in serious danger. Facing a war with France and the potential of internal subversion, founders such as Alexander Hamilton and John Adams rationalized extra-constitutional activity on the part of the government. Despite protests from Democratic-Republicans, the Congress approved, and the executive branch carried out, legislation that muzzled freedom of expression. That action forced defenders of the Constitution to come forward and resolve the crisis in favor of the original, broader applica- tion of the First Amendment.1 Hamilton had been instrumental in the writing of the Constitution and in the monumental rhetorical effort to ensure its ratifi cation. His essays in the Federalist Papers are among the most powerful. Like John Adams and for a long time James Madison, Hamilton did not believe that a bill of rights should be included in the Constitution. He believed that enumerating specifi c rights in the Constitution would imply that nonenumerated rights could be taken away from the states and their citizens by the Congress.2 Hamilton argued in Federalist number 84 that if such a list of rights were included in the Constitution, then any rights left off the list would go unprotected by the Constitution. “Here, in strictness, the people surrender nothing, and as they retain every thing, they have no need of particular reservations.” He went on to claim that the clause stating “We the people” guaranteed all natural rights to the people; not listing individual rights in the Constitution implied that these rights were the birthright of mankind.

Freeman Legislative Attorney January 12, 2018 The Logan Act, which has been the subject of much recent debate, generally makes it illegal for U.S. citizens to engage in unauthorized diplomacy with foreign countries with intent to “influence the measures or conduct” of a foreign government or to “defeat the measures of the United States . .” Prosecutors have only brought two Logan Act indictments since its enactment, neither of which led to conviction. As stated by one commentator, the Act has been called a “dead letter,” an “anachronism,” a “curious federalist antique,” “the most moribund of federal statutes,” and an “eighteenth century relic that slumbers in splendid disregard.” Others have noted that the statute is not completely moribund—the State Department has occasionally enforced the Logan Act’s prohibitions by way of passport suspensions and travel restrictions, and there has been a successful court martial of a U.S. serviceman for conduct of the kind barred by the statute. But regardless of the debate over the Logan Act’s precise history, its sparse use in its intended criminal context is undisputed, which raises significant legal questions for Congress. This Sidebar explores the Logan Act, and addresses why the statute has had such limited usage, including a brief explanation of some of the constitutional concerns that surround the law. The resignation of President Donald Trump’s national security advisor, retired Lt. General Michael T. Flynn, brings an arcane criminal statute known as the Logan Act into national focus. Interestingly, the Logan Act is the result of the actions of a notable citizen of Philadelphia. During hostilities with France in 1798, Dr. George Logan, a prominent physician and a member of the Pennsylvania legislature, went to Paris and met with officials of the French government. Dr. Logan, well known as a pacifist, engaged those officials in discussions aimed to improve the relations between France and the United States. Shortly after, tensions between the countries eased but likely for other reasons. Nevertheless, the efforts of Dr. Logan received praise in the United States. The Federalist Party, which was then in power and for partisan reasons, objected to the alleged interference by Dr. Logan in the affairs between France and the United States. As a result, the Logan Act was quickly proposed and enacted in 1799. The Logan Act prohibits any citizen, without authority of the United States, to directly or indirectly communicate “… with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States ....” A violation of the Logan Act is a felony punishable by a fine and/or imprisonment of not more than three (3) years.

Wong All Rights Reserved ii ABSTRACT Americans view neutrality in the 1790s as the far-seeing wisdom of the Founders and a weak power’s common-sense approach to a transatlantic war in which it could not afford to get involved. Far from this benign image of prudence, however, neutrality in the Early Republic was controversial: it was a style and paradigm of foreign policy that grappled with the consequences of a democratic politics exacerbated by diplomatic crises. Far from promoting tranquility, neutrality provoked uproar from the very beginning. Intense print battles erupted over sensational exposés of foreign influence and conspiracy, reverberating through the international, national, and local levels simultaneously. Print exposés of foreign intrigue provoked partisan warfare that raised the larger, unsettled (and unsettling) issues of the national interest, the exercise of federal power, and the relationship between the people and their government. This dynamic reflected and exacerbated preexisting sectional fissures in the union, triggering recourse to the politics of slavery. As a result, the politics of slavery calibrated the competing national visions of the emerging Federalists and Republicans, defining the limits of American independence while challenging the ability of the United States to remain neutral.
