The first will be a great and total eclipse, on Friday March 15th, at 9h. 28m. morning, but by reason of the moon's south latitude, her shadow will not touch any part of North America. The course of the general eclipse will be from southwest to north- east, from the Pacific Ocean a little west of Chili to the Arabian Gulf and southeastern part of the Mediterranean Sea. The termination of this grand and sublime phenomenon will probably be witnessed from the summit of some of those stupendous monuments of ancient industry and folly, the vast and lofty pyramids on the banks of the Nile in lower Egypt. The principal cities and places that will be to- tally shadowed in this eclipse, are Valparaiso, Mendoza, Cordova, Assumption, St. Salvador and Pernambuco, in South America, and Sierra Leone, Teemboo, Tombucto and Fezzan, in Africa. At each of these places the duration of total darkness will be from one to six minutes, and several of the planets and fixed stars will probably be visible. 2. The other will also be a grand and beautiful eclipse, on Satur- day, September 7th, at 5h. 35m. evening, but on account of the Mnon's low latitude, and happening so late in the afternoon, no part of it will be visible in North America. -

Essential Question: How did the constitutional system described in The Federalist Papers contribute to our national ideas about equality? Lesson Overview This two-part lesson explores the Federalist Papers. First, students engage in a discussion about how they get information about current issues. Next, they read a short history of the Federalist Papers and work in small groups to closely examine the text. Then, student pairs analyze primary source manuscripts concerning the Federalist Papers and relate these documents to what they have already learned. In an optional interactive activity, students now work in small groups to research a Federalist or Anti-Federalist and role-play this person in a classroom debate on the adoption of the Constitution. Extended writing and primary source activities follow that allow students to use their understanding of the history and significance of the Federalist Papers. Lesson Objectives Students will be able to: • Explain arguments for the necessity of a Constitution and a bill of rights. • Define democracy and republic and explain James Madison’s use of these terms. • Describe the political philosophy underpinning the Constitution as specified in the Federalist Papers using primary source examples. • Discuss and defend the ideas of the leading Federalists and Anti-Federalists on several issues in a classroom role-play debate. (Optional Activity) • Develop critical thinking, writing skills, and facility with textual evidence by examining the strengths of either Federalism or Anti-Federalism. (Optional/Extended Activities) • Use both research skills and creative writing techniques to draft a dialogue between two contemporary figures that reflects differences in Federalist and Anti-Federalist philosophies. -

EDITOEIAL COMMENT 403 IN MEMORIAM—ROBERT BACON' On the twenty-ninth day of May, 1919, Robert Bacon, a life mem ber of the American Society of International Law, and at one time Assistant, and Secretary of State, Ambassador to France, Major, Lieu tenant-Colonel, and Colonel in the American Expeditionary forces in France, died, in the fifty-eighth year of his age, in a hospital in the City of New York. The thing at hand he did, and did well, in college, in business, in civil life and in the military service of his country. As undergraduate of Harvard, in the class of his life-long friend Theodore Roosevelt, he was a good student and easily first in athletics. In business he became the partner and confidant of the late John Pierpont Morgan. Appointed Assistant Secretary of State by Secretary Root, that great statesman and competent judge of men said of him and to him: You have proved yourself far more able and forceful than I dared to hope— possessed of courage to take responsibility and conduct great affairs without flinching or the loss of judgment or nerve—competent to fill any post of govern ment with distinction and success. More than that, you have had the imagina tion to realize the ultimate objects of policy, and tireless energy and enthusiasm and self-devotion in pressing towards those objects, and your brave-hearted cheer fulness and power of friendship and steadfast loyalty have been noble and beautiful. I am sure you have a still more distinguished career before you for all who love you to rejoice in. -

Like It or Not, Trump Has a Point: FISA Reform and the Appearance of Partisanship in Intelligence Investigations by Stewart Baker1 To protect the country from existential threats, its intelligence capabilities need to be extraordinary -- and extraordinarily intrusive. The more intrusive they are, the greater the risk they will be abused. So, since the attacks of 9/11, debate over civil liberties has focused almost exclusively on the threat that intelligence abuses pose to the individuals and disfavored minorities. That made sense when our intelligence agencies were focused on terrorism carried out by small groups of individuals. But a look around the world shows that intelligence agencies can be abused in ways that are even more dangerous, not just to individuals but to democracy. Using security agencies to surveil and suppress political opponents is always a temptation for those in power. It is a temptation from which the United States has not escaped. The FBI’s director for life, J. Edgar Hoover, famously maintained his power by building files on numerous Washington politicians and putting his wiretapping and investigative capabilities at the service of Presidents pursuing political vendettas. That risk is making a comeback. The United States used the full force of its intelligence agencies to hold terrorism at bay for twenty years, but we paid too little attention to geopolitical adversaries who are now using chipping away at our strengths in ways we did not expect. As American intelligence reshapes itself to deal with new challenges from Russia and China, it is no longer hunting small groups of terrorists in distant deserts. -

Alexander Hamilton to John Jay on African-American Soldiers (March, 14, 1779) On March 14, 1779, Alexander Hamilton wrote this letter to John Jay regarding the recruitment of black soldiers. Hamilton expressed his opinion that former slaves might prove even better soldiers than the whites. Unlike many of his contemporaries, he rejected prejudices about the natural abilities of African-Americans and attributed any of their deficiencies to their social condition as slaves. As you read the letter, consider why Hamilton advocated giving the slaves "their freedom with their muskets" and what effect he thought this would have on slaves throughout the South. How did he propose to overcome the objections of slaveowners? Why was his plan rejected by congress? Col Laurens, who will have the honor of delivering you this letter, is on his way to South Carolina, on a project, which I think, in the present situation of affairs there, is a very good one and deserves every kind of support and encouragement. This is to raise two three or four batalions of negroes; with the assistance of the government of that state, by contributions from the owners in proportion to the number they possess. If you should think proper to enter upon the subject with him, he will give you a detail of his plan. He wishes to have it recommended by Congress to the state; and, as an inducement, that they would engage to take those batalions into Continental pay. It appears to me, that an expedient of this kind, in the present state of Southern affairs, is the most rational, that can be adopted, and promises very important advantages. -

Mandatory Minimum Penalties and Statutory Relief Mechanisms
Chapter 2 HISTORY OF MANDATORY MINIMUM PENALTIES AND STATUTORY RELIEF MECHANISMS A. INTRODUCTION This chapter provides a detailed historical account of the development and evolution of federal mandatory minimum penalties. It then describes the development of the two statutory mechanisms for obtaining relief from mandatory minimum penalties. B. MANDATORY MINIMUM PENALTIES IN THE EARLY REPUBLIC Congress has used mandatory minimum penalties since it enacted the first federal penal laws in the late 18th century. Mandatory minimum penalties have always been prescribed for a core set of serious offenses, such as murder and treason, and also have been enacted to address immediate problems and exigencies. The Constitution authorizes Congress to establish criminal offenses and to set the punishments for those offenses,17 but there were no federal crimes when the First Congress convened in New York in March 1789.18 Congress created the first comprehensive series of federal offenses with the passage of the 1790 Crimes Act, which specified 23 federal crimes.19 Seven of the offenses in the 1790 Crimes Act carried a mandatory death penalty: treason, murder, three offenses relating to piracy, forgery of a public security of the United States, and the rescue of a person convicted of a capital crime.20 One of the piracy offenses specified four different forms of criminal conduct, arguably increasing to 10 the number of offenses carrying a mandatory minimum penalty.21 Treason, 17 See U.S. Const. art. Six Unknown Named Agents of Federal Bureau of Narcot- ics. As the current Court has turned against Bivens—seemingly confining it to three specific contexts created by Bivens and two follow-on decisions in 1979 and 1980—scholars and liti- gants have developed a set of claims to respond to the Court’s critique. The Court now views the judicially created Bivens cause of action and remedy as a separation-of-powers foul; Congress is said to be the institution which should weigh the costs and benefits of allowing constitutional tort suits against federal officers for damages, especially in areas like national security or foreign affairs in which the political branches might be thought to have constitutional primacy. -

The United States as an Idea: Constitutional Reflections H. Jefferson Powell* I’d like to begin my remarks with two completely unoriginal observations. The first is that United States is a nation that rests on ideas, in a sense that isn’t quite true of many other nations. What we mean by, say, Denmark, or my ancestral country of Wales, certainly is tied up with ideas about what it means to be Danish or Welsh. To be Welsh is, among other things, to belong to a nation of poets: the greatest cultural achievement for any Welshman or woman—leaving aside organized sports!—is to be crowned Bard (chief poet) at the National Eisteddfod. But the ideas that characterize Denmark or Wales belong to a national community that did not begin with ideas and a conscious decision. There was no convention that established Denmark, no declaration that announced Wales, and it is pointless to ask when either nation was created.1 Both emerged out of “the mists of time,” out of a particular human experience of geography, culture, language, religion, perceived physical kinship, and so on. -
